I (90 X— I InMx to: ORDINANCE AN ORDINANCE VACATING A CERTAIN ALLEY WITHIN THE CITY OF IONA, IDAHO; PARTICULARLY DESCRIBING THE SAID ALLEY; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER ON BEHALF OF THE CITY A QUITCLAIM DEED CONVEYING A PORTION OF THE VACATED ALLEY TO THE UWNER OF THEADJACENT LAND; PROVIDING FOR EFFECTIVE DATE OF ORDINANCE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Vacation of Alley. A portion of a public alley located adjacent to Lot 3, Block 12, according to the original plat of the Village of Iona, Bonneville County, Idaho, is not used or needed for public purposes. This alley is particularly described in Exhibit "A"attached hereto. Pursuant to the provisions of Idaho Code Sections 50-311 and 50-1325, as amended, this street is hereby vacated in favor of the adjacent landowners named in Section 2 of this Ordinance. Section 2. Execution of Quitclaim Deed Authorized. The Mayor and City Clerk are authorized and directed to execute and deliver a Quitclaim Deed conveying said vacated alley to the following, namely: Name Address Reta T. Armstrong P.O. Box 173 Iona, ID 83427 Section 3. Vacation of Alley. A portion of a public alley located adjacent to Lot 2, Block 12, according to the original plat of the Village of Iona, Bonneville County, Idaho, is not used or needed for public purposes. This alley is particularly described in Exhibit "B" attached hereto. Pursuant to the provisions of Idaho Code Sections 50-311 and 50-1325, as amended, this street is hereby vacated in favor of the adjacent landowners named in Section 2 of this Ordinance. Section 4. Execution of Quitclaim Deed Authorized. The Mayor and City Clerk are authorized and directed to execute and deliver a Quitclaim Deed conveying said vacated alley to the following, namely: Name Address Wallace Shane Brown and 143 W. 4th N. Linda Brown Rigby, ID 83442 Section 5. Effective Date. This Ordinance shall be in full force and effect from and after its passage, execution and publication in the manner provided by law. Robyn Ke City Clerk -3- EXHIBIT A LEGAL DESCRIPTION FOR CITY OF IONA (NORTH HALF ALLEY, BLOCK 12) Beginning at the Southwest corner of Lot 3, Block 12 of the Village of Iona as shown and recorded in the Bonneville County courthouse as the Official Plat of the Village of Iona and Denning Addition to the Village of Iona, Instrument No. 318911, the Southeast Quarter of Section 1 and part of the Northeast Quarter of Section 12, Township 2 North, Range 38 East of the Boise Meridian, Bonneville County, Idaho and running thence N.85°45'31"E. 296.87 feet along the south line of said Lot 3 extended to the east line of said Block 12; thence S.00°14120"E. 10.02 feet along said east line; thence S.85°45131"W. 297.02 feet to the west line of said Block 12; thence N.00°37'32"E. 10.04 feet along said=west line to the point of beginning.
