AN ORDINANCE TO REGULATE .THE.. TRANSMISSION OF RADIO.
PRODUCED SOUND OR SOUND FROM SOUND AMPLIF10ATION
DEVICES FROM BUILDINGS- OR OTHER AREAS, OR, ON .OR
ALONG STREETS, ALLEYS OR OTHER PUBLIC PLACES -AND TO
REGULATE THE ,USE OF HORNS AND OTHER VIARNING - SIGNALS
ON MOTOR VEHICLES IN THE CITY OF RICHMOND,'PIAYNE
COUNTY, INDIANA AND PROVIDING A PENALTY FOR THE VIO'',
LATION ZIEREOF -
Be it Ordained by the Common Louncil of the City
of Richmond, .4vayne County, Indiana, as follows:
SECTION 1. -It shall be unlawful for ' any person,
persons, firm, association, or 'corporation to maintain;
operate, or to permit or tolerate the maintenance and
operation in or upon any -building or -'in .or upon any
premises or in or upon the public streets or alleys
within the city limits of Richmond, Indiana, any 'radio
device or mechanical musical instrument.` or device of. _
any kind - singly or, in conjunction with each other or
any eleotrical'. or meciianioal device singly or in con-
junction with- each other, for the amplification of
sound, - whereby .said `sound emitting therefrom" is east
direotly upon and .into. the 'publie streets or parks,
either for, the purpos,e';,of -advertising, in any. form or
for,the purpose of.drawing'or attracting the attention
of the public.,, or rich is zo 'placed. and operated that
the sounds emitting therefrom can be -heard to the
anno.yance_._.or:..ineonvenience of , the public ,on the streets
or in the public parks of slid 'city orof persons in
neighboring premises, abutting or not,. without first
procuring the. written consent of the ,Mayor of said Ci ty:.
SECTION ,2 It shall be ,unlawful for" any person,.
persons, firm, association or, :coorporation to, maintain
and operate or to permit or tolerate the maintenance
.and ..operation of - any radio or mechanical,.. singly or in

oon junction, sound producing or sound .amplification
device, along or upon the streets,.. highways,. or alleys
-.or in, and upon the roads and highways. of the public
parks of said ,city when .the same is mounted -in or upon
or attached to. any vehicle motor or otherwise whether
moving, standing still, ,wi thout first procuring the
written• conPent of the Mayor of said; city.,
Nothing herein shall be construed as applying to the
ordinary use and operation of ordinary automobile radios
through whioh-4a .being transmitted• regular.• recognized
channel broadcasts, emitting. From licensed broadcasting
stations.
SECTION, 3.. It -shall be unlawful for,'th'e 'operstor
of any vehicle .to 'sound -any horn or other warning device
- - except when reasonably ne-oessary- for the`, prevention of
accidents.
—SECTION SECTION 4. All ordinances or parts. or '.ordinances
in conflict herewith , are `%appeeled.
SECTION 5. Should any ,part or parts of this ordinance
be held to, be .unconstitutional,: -such -finding shall not effect
the ' validity .of , the remaining parts of this, ordinance.
SECTION 6:.. Any person,. persons, firm, association
or corporation who violates,.disobeys;.omits,.aegleots•,,.'
refuses, rAsists the enforoement" of , "or'.,,fails, .to comply`
with any. one or all .of ,th'e ' provi sions of . this ordinance
shall be' fined not "to' -'exceed, one hundred' dollars.. Each
day that any violation continues or -is' perpetrated shall
ooiistitute- a separate offense.':"
