HILLSBOROUGH TOWN BOARD
May 13, 2002
7:30 PM, Town Barn
The Hillsborough Town Board held a Closed Session on May 13, 2002 at 7:30 PM in the
Hillsborough Town Barn. Present for the Closed Session were Mayor Joe Phelps, and
Commissioners Frances Dancy, Evelyn Lloyd, Mark Sheridan, and Michael Gering. Absent
from the Closed Session was Commissioner Kenneth Chavious. Staff present were Town
Manager Eric Peterson, Town Clerk Donna Armbrister, Assistant Town Manager/Public Works
Director Demetrlc Potts, Town Engineer Kenny Keel, Finance Director Sherry Carter, and Town
Attorney Bob Hornik
Mayor Joe Phelps opened the Closed Session.
11. CLOSED SESSION
A. Closed Session to Discuss Potential Property Acquisition
Town Manager Eric Peterson informed the Board that the Town has received an offer from the
Windham/Scott family to sell the property located at 121 W. Tryon Street (known as the Scott
House) to the Town for $250,000. This offer will be valid through May 31, 2002.
After some discussion by the Board, they authorized the Manager to make contact with the
family to investigate obtaining a key so the Board could view the property.
B. Closed Session to Discuss a Legal Matter
Town Attorney Bob Hornik presented a draft right-of-way easement and agreement between the
Town and Mr. and Mrs. Caruthers. This agreement sets forth two (2) easements that the Town
will be granting to the Caruthers in connection with the final settlement of their case. Per the
agreement, the Town will pay to the Caruthers $4,033.71 to relocate a fence on their property.
The payment is being made for relocation payments under Article 2, Chapter 133 of the North
Carolina General Statutes and is being made in satisfaction of a pending counterclaim that the
Caruthers asserted in the condemnation action for relocation assistance.
Upon a motion by Commissioner Sheridan, seconded by Commissioner Dancy, the Board
