the Bay of San Frane:see, and at periudu of uaeually high tides the Salt WLtere of said
Bay are liable to overflow 'and immediate portions of said lands ; and

was edartructed by the predecessors in interest of the parties of the first part hereto,
along a portion of Said premises and parallel with the said Bay of San Francisco,

maintained by the predecessors in interest of said parties of the first part and by said
parties of the first part; and

near said Bay settled materially ,and the efficiency of the said dike or tide water levee
was somewhat sunken and lowered, and materially impaired, by reason whereof, the said

or reconstructing ,raining ,repairing and maintaining that certain old pike or levee located
in the lasterly portion of the parcels of lard i:e_c.in.bove described which said old
dike or levee is the cr=giral dike or levee constructed thirty years or thereabouts since by
Agnes Bowie ,now deceaseda together with the rigi.t of ingress. and egreco to and from the same
for the sole purpose of gonstructing or reconntructing ,raining ,repairing and thereafter
maintaining said repaird and receretructed dike or levee.
TO EMT AND TO HOLD, said easement for the team of years from the date hereof, subject
to the undertaking by said parties of the•first part to keep and maintain said dike
or levee in serviceable condition and repair zo as to prevent the waters of the Lay of
San Francisco, from overflowing the premises aforesaid .
This casement is expressly made subject to said condition of maintenance and repair during
the term hereof, by said parties of the second part and in event that at any time during •
said term said parties of the Second part shall fail or neglect to keep and maintain said'.di're
or levee,or any portion thereof, in good and eervioeable condition and repair as aforesaid
then and in said event this grant or easement ,and all rights of the parties of the Second
part hereunder shall terminate and lepee,and shall forthwith become void and without force
or effect .

Dear Mr. Nalloctt:
The six foot change along the Si, side of Parcel 2 was to accommodate Luilding
additions rot* housing a,e.:hanical equipment. Additional information was
requested Lo show sound insulation to reduce equipment noises and :.,enefit
residents in the adjacent apartment. The revised drawings were only recently
received and approved.
As you know, land developed with commercial buildings may oe resubdivided
and resubdivided again. In order that the present delineation of parcels to
definitely established, :he City of San Mateo requests that a Parcel :dap be
prepared and recorued. Toe Parcel Map should ue prepared in accordance
with the State Subdivision Map Act as amended uy Article a, Parcel Maps
(added by Statutes 1965, Chapter 1180.:Section la) effective September 17,1965.
The Resubdivision application can be approved when augmented by a Parcel Map
for this property.

mentioned described real property is a Safeway Store and a
Super "S" Market which is being operated and maintained by
the respective lessees of said retail outlets under leases
dated January 30, 1964 and as amended May 13, 1964, June 19,
1964 and September 23, 1964. That provided for maid leases
was the undertaking and agreement on the part of the Lessor
of said premises, which the undersigned owners have succeeded
to by reason of the purchase of the real property and improve-
ments located thereon from their predecessor, the Lessor of
the aforementioned premises that all of the aforementioned
property other than that portion upon which buildings have
been constructed or upon which buildings may be constructed
in addition to the aforementioned demised premises, which was
understood by the aforementioned lessees, shall be preserved
as open and common areas to be used for pedestrian and/or
vehicular traffic necessary for the ingress and egress in and
to the property upon which the said buildings have been con-
structed for the sale and offering for sale of merchandise,
services and commodities.
The undersigned owners for the purpose and purposes
of preserving the required open area and common areas, as is
-covenanted and agreed to under the aforementioned leases, and
to make this a charge, restriction and covenant upon the en-
tire parcel of land as described herein and upon any smaller
parcel segregated from said larger parcel and conveyed to any
other person, firm, association or organization, do hereby
declare that if any portion of the aforementioned described
real property is divided into one or more parcels and by reason
thereof separate ownerships are acquired therefor, the common
areas as the same are required to exist under the aforemention-
ed leases shall be a covenant and servitude running against
any such parcel for the benefit of any other parcel and for the

benefit of any parcel as against any other parcel. Thus,
