Home My Public Portal About1169-1938 - Appropriation of monies for Public AuditoriumORDINANCE OF APPROPRIATIM OF MONIES FOR PUBLIC AUDITORIUM BE IT OR)AINED by the Common Council of the City of Richmond, Indiana, that WHEREAS heretofore the United States of America, by and thru the Federal Emergency Administration of Public Works made its offer of grant-in-aid to the City of Richmond, Indiana, in sum of One Hundred Three Thousand Nine Hundred Nine Dollars ($103,909) to assist the City in the pro-kision and construction of public auditorium; and which offer of grant-in-aid by due Resolution of the Common Council of the City of Richmond, Ind- iana, has been duly accepted and said Federal Emergency Admin- istration of Public Works has been duly so advised; AND WHEREAS the Common Council of the City of Richmond, Indiana, did on the 51f day of July, 1958, adopt its certain o'Ordinance of Determination to Construct Public Auditorium", reference to which Ordinance is herein made the same as though incorporated herein in full; and in said Ordinance was set forth the require- ment that eventually the acceptance of said grant-in-aid would require the expenditure by the City of Richmond, Indiana, of its own funds the sum of approximately One Hundred Twenty-seven Thousand Dollars ($127,000), thus providing eventual Construc- tion Fund for such public auditorium some Two Hundred Thirty Thousand Nine Hundred Nine Dollars (1�230,909); and now is being given notice as by law provided of the adoption of said Ordin- ance of Determination, to the taxpayers of the City of Richmond, Indiana, as condition precedent for further action in the premises; AND Vw1HEREA1.5,heretofore there has been circulated for execution among the owners of taxable real estate in the municipal corpo- ration, City of Richmond, Indiana, form of petition to the Common Council of City bf Richmond, Indiana, petitioning the said Common Council in request and approval of proposition to provide such public auditorium, and in petitioning that the t City of Richmmid, Indiana, be and become fully authorized. and empowered to issue, negotiate and sell the obligations to.pay,.. (bonds) of said City, of Richmond, Indiana, in,the principal sumof $127,000 for purposes aforesaid; and which petition(s) having been executed'by more,than fifty owners of taxable real estate in.. the 'City 'of Richmond, .Indiana, a municipal corpora- tion.,in the State -of ' Indiana, and. h.aving' been duly verified and .certified and filed with the Common Counoil' of the City of Richmond.; Indiana,.'and having been,duly examined and approved by said Common Council, and found 'to be ,in compliance with the provisions of the laws of .State of Indiana, , in: such cases made and provided; and said Common. Council of the City of Richmond, Indiana,. having by its Resolution duly -.adopted July 18, 1938,$ ,shown such approval, and again determined to issue the bonds petitioned for; and further has ordered notice to be given as by law provided to the taxpayers .of.the City of:Richmond, Indiana, and to all others concern-ed, .and 'especially to owners of taxable real estate in' -.said City, of the receipt and, filing of said petition and of the action. thereon, and of the deter- mination to issue the bonds petitioned for, " ,reference to which Resolution of the.Common Council of -the City of Richmond, Indiana, is made the -same -as though incorporated herein,in full; AND .WHEREAS heretofore the Common Council .'of . the City of Rich- mond., Indiana, has found in its opinion and j ud gm.ent it is necessary and 'expedient and to the best. interests_ of the City of .Richmond, Indiana, t.o provide .for, the citizens of the City such public auditorium,.and that an,emergency exists that at. once , same should be done 3 . NOW THEREFORE BE'IT ORDAINED by the Common Council of the City of Richmond, Indiana Section One:, That the Common Council of:the City of Richmond,: Indiana, -upon its review -of things- done and .steps taken in matter of provision .and: construction of a`.public auditorium for the .citizens of the -.City of -Richmond; Indiana, ratifies and confirms all things heretofore done, and declares the pro- vision of such public auditorium as a necessary public city institution so to' be established and provided, -when and as all 't further .proceedings .in keeping with the provisions, of the Laws of State of Indiana,''are and can be complied 'with in' order. Section Two: That when and as the grant-in-aid from the United States of America in the sum of. $103, 909. to the . City of Rich- mond, Indiana., to assist the City of Richmond,,Indiana, in the. provision and. construction of public auditorium, becomes and is available following the provision'of.necessary'additional monies by the City of Richmond, Indiana, .-itself, some- #127,000., the ,same grant-in-aid, or gift, be received and accepted by th4said City, and that in .-such receipt the City of Richmond, Indiana, shall and does agree to ' all the conditions and terms accompanying the same as may be required, set out and defined, by the. United States -of America, the Federal Emergency Administration of Public Works, or other federal agency acting in.the premises, and that the City of Richmond, -,Indiana, shall and does by such receipt bind and obligat6citself to carry out such conditions and terms; and all officers and employees of the, City of Richmond; Indiana, having any duties in the premises. are- instructed accordingly•: Section Three: That now the Cormn.on,Council of the City of Richmond, Indiana, having found the emergency to exist as hereinbefore .stated., and such Common Council as. the , proper legal officers of the municipal corporation contemplating to meet the emergency, does now determine herewith and approve the expend17 Lure of more money by appropriation for -the current year than - was set out in detail in the published budget of the City of Richmond; Indiana; and this Common',Council of the City of Richmond, Indiana, shall give,ten'days notice by publication, as by law provided, fixing a date when the action of this Common Council shall further be -formally considered and determined upon, and at. whi.ch'meeting taxpayers of 'the City of Richmond, Indiana, shall have a .right 'to• be heard thereon.. That now this Cormnon Council of the City of Richmond, Indiana, funds the costs of such provision and construction of public auditorium will cost the approximate. sum of $230,909..,, which with the grant-in-aid of the United States '-.of America contri- . buted thereto,leaves 127,000. to be'.met and paid by the City of Richmond:,, Indiana- and which .cost so to -be met will be in excess of the sum. available' therefor out .:of. any annual levy of taxes; and that in order. to procure the necessary funds it will, 'be necessary for this Common Council for and in behalf of. the City of Richmond, :Indiana, to, on passage. of an ordinance for -that purpose, provide for an issuance, and sale: of bonds of the City of Richmond`, Indiana;. the' same for the •purpose of procuring `ouch money to be . used in . such , legitimate: exercise of the corporate power-s of .,said City' of, Richmond. That now this Common Council of the:C.ity of.
