Card Lot 18, Portion of Lot 17, Block E, San Mateo Heights #2 The block books of the Engineering Department have recognized a split of this property for quite some time, although there is no recorded less -than -five lot subdivision of the property in question. As is shown on our block book maps, each parcel has over 5,000 square feet. The Engineering Department has accepted the maps we are now working with as being legally split lots or parcels. Appar- ently, the Planning Department does not agree that this property was a legal split since the owner had sold off a piece of property in 1951 and their conten- tion is that 1947 was the accepted date as to all prior splits becoming legal without the recording of less -than -five lot subdivision maps. This property also involves a set of garages. The split divides the garage in half but no separation of the garages actually exists. There being a difference of opinion between the Engineering Department and the Planning Department, I called Arthur Herzfeld, City Attorney and to the best of my ability explained to him the situation as I saw it. As I understood, Mr. Harzfeld's opinion is that if a parcel of property had been sold off prior to the new zoning ordinance which is to cone into effect October 18, 1961, and whether the owner had filed a less -than -five lot subdivision or not, and if the parcels have 5,000 square feet or better and do comply with the existing ordinance, then they will comply with the new zoning ordinance even if the new ordinance requires 6,000 square feet for apartment house construction. In other words, if the owners desire to tear down the existing apartment house, they would have a legal right to build a new apartment house even if the property does not have 6,000 square feet. As far as the garages being non -separa- ted and the lot line running through the garages, subdivision of land is one thing and location of building another. Therefore, the existing garages do not make the subdivision of this property illegal. The owner of one of the parcels, Mr. John Hanlon, care in this morning, Wednesday, October 18, and I explained to him the opinion of the City Attorney, but he would have to file a less -than -five lot subdivision before he would be allow- ed to rebuild on the property. c;G JOHN E.
