CHAPTi'R 6 ARTICLE 2 -~ Sec. 2-19: ORDINANCE PROVIDING ,FOR A LOCAL IMPROVEMENT CONSISTItdG OF TiiE CONSTRUCTION AND INSTALLATION OF AN INTERCEPTOR SANITARY SEWER SYSTEM WESTERLY FROM THE EXISTING LINE 0~' THE MUNICIPAL SEWER SYSTEM OF THE VILLAGE OF PLAINFIELD LOCATED AT THE DUPAGE RIVER TO THE EASTERLY IIOUNDARY LINE OF WHISPERING CREEK SUBDIVISION, IN SECTION 17, TOWNSHIP 36 .NORTH, RANGE 9 EAST OF THE TfiIRD PRINCIPAL MERIDIAN, WILL COUNTY, xLLINOI5. (WHISPERING CREEK SPECIAL ASSESSMENT NUMBER 2) BE IT ORDAINED by the President and Board of Trustees a~ the Village of Plainfield, Will County, Illinois, as follows: Sec.2-19--1: Improvement Described. A local improvement shall be constructed in the Village of Pla na. field consisting of: Construction and installation of an Interceptor Sanitary Sewer System westerly from the existing line of the Munici-~ pal Sewer System of the Village of Plainfield located at the DuPage River to the easterly boundary line of Whispering Creek Subdivision, in Section 17, Township 36 North, Range 9 East of the Third Principal Meridian, Will County, Illinois. Sec. 2-19-2; Contents of Improvement. Said improvement. shall con- sist of the construction and installation of sewer pipe, necessary fittings and joints, valves, manholes, frames, covers and steps, all as set forth in the estimate of cost att=ached hereto and incor- porated herein by reference and shall include necessary excavations, backfilling, testing and sterilization, seeding, clean up and all other appurtenant work. Village Datum for the purpose of this improvement is fixed and established as the official datum of the United States Geological Survey. All materials of every kind and character to be used in the construction of this improvement shall be first class quality, suitable for the purpose £or which they are to be used, and subject to the inspection and approval of the Baard of Local Improvements of the Village of Plainfield, Will County, Ill i-- nois. All work shall be constructed in a workmanlike manner under the superintendence of the Board of Local Improvements of the Village of Plainfield, Illinois. • ... , All construction methods and materials used in constructa.on of the improvement hereia~ provided for shall conform with the American Society of Testing Materials Designations as set forth in the plans and specifications attached hereto, a copy of. which is on file with the Village Clerk of the Village of Plainfield. The quantities and types of materials to be used are as set forth in the estimate of cost attached hereto and incorporated herein by reference. Sec. 2-19-3: Recommendation, Costs, Plans Incorporated by Reference. The recommendation of the Board of Local Improvements, the estimate of cost thereof and the plans all hereto attached and incorporated herein by reference be and the same hereby are approved. Sec.2-19-4: Costs. That said improvement shall be made and the cost thereof which is estimated to be $287,000.00 shall be paid for by special assessment in accordance with, Article 9, Division 2 of Chapter 24 of the Illinois Municipal Code, an amount not exceeding $17,220.00 is hereby provided for to apply towards the payment of all lawful costs and expenses incurred in making, levying and collect- ing the assessment for said improvement but not including attorneys fees. ~.~~;.~ ~~.,~~ Sec. 2-19-5: S ecial Assessment Pa ments and Interest. 'The aggregate ~~~~1~"' ~ amount herein ordered to be assessed and each individual assessment ~~-~~~ shall be divided into ten (l0) installments which shall bear .interest at the rate of six per cent (6~) per annum until paid all in the manner and in accordance with the provisions of the aforesaid Article 9, Division 2 of Chapter 24 of the Illinois Municipal. Code. Sec. 2-19-6: Bonds, For the purpose of anticipating the collection of the second and succeeding installments of said assessment for said improvement, bonds shall be issued payable out of said install- ments, bearing interest at the rate of six per cent (6~) per annum, payable annually, and signed by the President of the Village and attested by the. Village Clerk, under the corporate seal of the Village. The bonds shall be issued in accordance with and shall in all respects conform to the provisions of Article 9, Division 2 of Chapter 24 of the Illinois Municipal Code, as amended. Sec..2-19--7: President to file Court Petition. Charles F. Pottorff, President of the Board o Trustees of the Village of Plainfield, is designated as the person to file a petition in the Circuit Court of Will County, Illinois, as provided by law in the name of the Village, praying that steps may be taken to ascertain the just compensation to be made for private property taken or damaged to be acquired for the said improvement and to ascertain what property will be benefited by said improvement and the amount of such benefit and also that steps be taken to levy a special assessment for said. improvement in accord- ance with the provisions of this ordinance and in the manner prescribed by law.
