AN ORDINANCE APPROPRIATING THE SUM OF FIFTEEN THOUSAND AND
EIGHTEEN AND 25/100 DOLLARS ($15,018.25)PLUS INTER-
EST, OUT OF THE GENERAL FUND OF THE CITY OF RICHMOND,
INDIANA, FOR THE PURPOSE OF PAYING B-10 JUDGMENTS
AGAINST SAID CITY GROWING OUT OF THE ACCIDENT TO
L-MVIS EV111ARD REED IN GLEN MILLER PARK, AND DECLAR-
ING AN EXTRAORDINARY EMERGENCY FOR THE PASSING
-OF THE SAME.
AREAS, on the 16th day of November, 1938, two judg.
ments were rendered against the City of Richmond, Indiana, in
the Wayne Circuit Court of Indiana, as follows: one judgment
in favor of Lewis Edward Reed, being Cause Number 29374 in
said court, for Fourteen Thousand Dollars ($14,000.00) together
with costs, and the other judgment in favor of Wayne Reedy
father of said Lewis Edward Reed, being Cause Number 29375 in
said court, in the sum. of Six Thousand Dollars ($6000.00),
together with costs; And,
WHEREAS, said judgments were in full satisfaction
and discharge of all liability on the part of said City
growing out of an accident which occurred on the 29th day
of July, 1938, in Glen Miller Park in said city, when a bear
owned and kept by said City chewed the left leg of said Lewis
which
Edward Reed, causing the same, to be amputated, and/liability
on the part of said City was insured against in the Indemnity
Insurance Company of North America to the amount of Five
Thousand Dollars ($5000.00); And,
WHEREAS, said insurance company after an investiga-
tion of said accident agreed with said City`to pay said sum
of Five Thousand Dollars ($5000.00) as its part of said judg-
mentq leaving a balance of Fifteen Thousand Dollars (615,000.00)
together with costs and interest on said judgments to be paid
by said City of Richmond, Indiana;

Indiana, hereby certify, as follows: 44
That on December 5, 1938, .the Common Council of the
City of Richmond, Indiana, at its regular meeting held on such
date, determined, as an extraordinary emergency,.that it was
necessary to expend' for said City ,of Richmond .the sum of Fifteen
Thousand and Eighteen and 25/100 Dollars ($150018.25) to pay
and discharge two judgments against said City, and which said
expenditure was not set out in the published budget of said City
for the current year,'nor in the modified budget, -as fixed by
the State.Board of Tax Commissioners;
That thereafter said officers. gave ten days' -notice
to the tax payers of said City of such determination, and that
a hearing would be held thereon December 19, 1938, which said
notice was published as by law required in the Palladium and
Item, two newspapers of said City, said notice appearing on
December 8 and 15, 1938, as shown in proof of publication at-
ta.ched hereto;
That on said 19th day of .December, 1938, said Common
Council held such hearing, and thereafter on the 3d day of
January, 1939, said Common Council by unanimous.vote adopted
the ordinance appropriating said sum of money,which ordinance
is attached hereto.
