The following were noted present: Boll Call Councilmembers Vincent Bellino " Jorge Diaz Dennis DiMascio Randy Krum " Joseph W. Sitarz Also noted present was Kathleen M. Barney, Municipal Clerk and Noted Present Michael Sica. Noted absent were Borough Attorney Robert J. Bergen and [Voted Absent Councilwoman Susan Naples. The 2015 Annual Notice was mailed to The Home News Tribune, Staterent of PIeetirg The Star Ledger and posted on the bulletin board on January 5, Notice 2015. Notice was published in The Home News Tribune on January 7, 2015 and The Star Ledger on January 8, 2015. The Meeting was opened with a minute of Silent Prayer and the Silent Prayer and Pledge Pledge of Allegiance led by Mayor Daniel J. Reiman of Allegiance Minutes for Approval Minutes for Approval. Kanrh 26, 2015 Upon MMS &C, by Councilmembers Sitarz and Bellino and unanimous affirmative vote of the five (5) Councilmembers present the minutes of March 26, 2015 were approved as transcribed and engrossed by the Clerk. 1. April 9, 2015 Public Portions on PUBLIC PORTION ON RESOLUTIONS /AGENDA ITEMS & NEW Resolutions /Agerda item & Nccv Business BUSINESS WAS OPENED TO THE PUBLIC: Open to Public Upon MMS &C by Councilmembers Diaz and Krum and unanimous affirmative vote of the five (5) members present, the public portion on Resolution /Agenda Items and New Business was opened to the public. There were no comments from the public. Closed to Public Upon MMS &C by Councilmembers Diaz and Krum and unanimous affirmative vote of the five (5) members present, the public portion of this meeting was closed. Resolutions Resolutions — 1. Directing the Issuance of Various Raffle Licenses. 2. Authorizing Execution of Shared Services Agreement with Woodbridge Twp. 3. Support of A4235, the "Transparent Tax Act of 2015" Questions /Cafrrents Councilman Diaz said he had questions on Resolutions #2 and #3. Mayor Reiman said Resolution #2 Authorizing Execution of Shared Services Agreement with Woodbridge Township. This is generally with the ... (inaudible) .... Resolution #3.The Transparent Act of 2015, there is an Assembly Bill 4235 we would require. Right now we collect now all the taxes. Somebody doesn't pay their taxes we still have to give the School Board 100% of whatever they say they are entitled to. On the Tax Bill this would identify everything from the cost to collect the taxes to what the uncollected taxes were. So, when - somebody files a tax appeal we don't get money back from the County or the schools, the city eats all of that. So we wind up eating all of the cost of the tax collection and distribution and the only entity when we bill 100% 2. April 9, 2015 we get about 90 %. Every other entity is made whole. This would help that so if there is a Tax Appeal, we'd get our money back from the other entities that received money. Councilmember Sitarz asked about Resolution #4. Mayor Reiman said this is the Marina /Waterfront Project. This is a recorder with legal proceeding. Mr. Wolf, who is a partner in this firm, has been handling our legal defense and appeal on this. We expect to have a final decision from the Army Corp & Coast Guard in the next couple of months but there is daily interaction with his office and the professional staff as well as the DEP, Army Corp and Coast Guard. Overall, things look well. 4. Professional Services - Bathgate, Wegener & Wolf, Re: Marina /Waterfront Project. 5. Amendment to the 2015 Temporary Budget. _ 6. Grant Agreement Between the Borough and NJDEP for a Coastal Vulnerability Assessment Report & Municipal Public Access Plan. 7. Refund of Tax and /or Sewer Fee Overpayments: Resolutions #15 -82 through #15 -87 were introduced by the Mayor and referred to the Council for action. Councilmember Naples was noted absent. 9 -'-'clerk's Note Please note that Resolution #1 on the Agenda, "Directing the Issuance of Various Raffle Licenses" was omitted from the Consent Agenda. Payrent of Bills Mayor Reiman Re: Closing of Cooke Ave. niiich is part of Arts District Tmater Project & the ioterfront closing for Prologis Payment of Bills- Mayor Reiman said there were two (2) items added to the Bill List, the closing for 5 -7 -9 Cooke Avenue which is part of the Arts District Theater Project and the waterfront closing for Prologis. We have to acquire an additional 2.3 acres, roughly, of wetlands mitigation credits from Prologis in anticipation of the Marina Project. 4. April 9, 2015 Upon MMS &C by Councilmembers Sitarz and Bellino all bills Bill List appearing on the prepared list, properly audited and signed were ordered to be paid. Upon individual roll call Councilmembers Bellino, Diaz, DiMascio, Krum, and Sitarz voted in the affirmative. Councilmember Naples was noted absent. Reports — 1. Clerk's Office — March 2015 2. Construction Office — March 2015 Upon MMS &C by Councilmembers Diaz and Bellino and unanimous affirmative vote of the five (5) Councilmembers present, all Reports were ordered to be received and placed on file. Business to be Added — Mayor Reiman spoke about Proclamation "Sexual Assault Awareness Month ". This Proclamation will be filed in the Clerk's Office to be distributed. The complaints that are coming in are phenomenal. They are making a racket in the Jackson corridor section. Hopefully, we'll get this straightened out. The Mayor said it looks like it'll be Monday or Tuesday. Attorney Sica said the meeting will be Monday with the Attorrp-y Sica said residents. Chief Hruska was out and spoke to Conrail and the meeting is Morday identified someone in corporate that we can call, as well as the new rail Supervisor in Woodbridge. They were successful 5.
