(S- 7 - I i AN ORDINANCE OF THE CITY OF IONA, IDAHO; REPEALING AND RE-ENACTING TITLE 7 CHAPTER 10 OF THE IONA CITY CODE REGARDING THE ADOPTION OF THE 2009 INTERNATIONAL FIRE CODE; PROVIDING FOR SEVERABILITY; ESTABLISHING METHODOLOGY; PROVIDING FOR PRESERVATION OF PRIOR ORDINANCE AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Repeal and Re -Enactment of section 7-10-1, Iona City Code. Section 7-10-1 of the City Code of Iona, Idaho, is hereby repealed and re-enacted as follows: 7-10-1: INTERNATIONAL FIRE CODE ADOPTED. (A) Fire Code Adopted: The International Fire Code, 2009 Edition, as published by the International Code Council, Inc., including all Appendices, is hereby adopted as an official code of the City, save and except such portions as are hereinafter deleted, modified or amended by the provisions of this chapter or by State Code. (B) Code on File: One (1) copy of the International Fire Code, 2009 Edition, duly certified by the Clerk shall be retained by the City Clerk for use and examination by the public. Section 2. Repeal of sections 7-10-4 through 7-10-12, Iona City Code. Sections 7-10-4 through 7-10-12 of the City Code of Iona, Idaho, are hereby repealed. Section 3. Enactment of section 7-10-4, Iona City Code. Section 7-10-4 of the City Code of Iona, Idaho, is hereby enacted as follows: 7-10-4: AMENDMENTS AND ADDITIONS TO THE INTERNATIONAL FIRE CODE: The International Fire Code, 2009 Edition, is amended and changed in the following respects. (A) A new Section, 105.1.4. shall be amended to add the following new paragraph: -1- 105.1.4 Failure to Obtain Permit. Failure to obtain a permit, prior to engaging in activities, operations, practices or functions, as set forth in the International Fire Code, shall constitute a violation of the Code. The activity, operation or practice will be issued a stop work order until a permit has been obtained and a double permit fee collected. (B) Section 105.7.1 shall be amended as follows: 105.7.1 Automatic Fire -Extinguishing Systems. A construction permit and "Life Safety License" issued by the Code Official is required for the installation of or modification to an automatic fire extinguishing system. Maintenance performed in accordance with this code is not considered a modification and does not require a permit. (1) Contractors performing maintenance on automatic fire -extinguishing systems shall obtain a "Life Safety License" from the Code Official prior to commencing work and shall provide a copy of the maintenance report to the Code Official at the completion of the work performed. (2) The Code Official is authorized to waive the permit fee for modifications to automatic fire -extinguishing systems where ten (10) or fewer sprinkler heads are affected in the scope of work. A Life Safety License and permit are required to be submitted to the Code Official for review prior to the start of the project and a record of completion shall be submitted to the Code Official at the completion of the project. (C) Section 105.7.5 shall be amended as follows: 105.7.5 Fire alarm and detection systems and related equipment. A construction permit and "Life Safety License" issued by the Code Official is required for installation of or modification to fire alarm and detection systems and related equipment. Maintenance performed in accordance with this code is not considered a modification and does not require a permit. (1) Contractors performing maintenance on fire alarm and detection systems shall obtain a "Life Safety License" from the Code Official prior to commencing work and shall provide a copy of the maintenance report to the Code Official at the completion of the work performed. (D) Section 105.7.6 shall be amended as follows: 105.7.6 Fire pumps and related equipment. A construction permit and "Life Safety License" issued by the Code Official is required for installation of or modification to fire pumps and related fuel tanks, jockey pumps, controllers, and generators. -2- Maintenance performed in accordance with this code is not considered a modification and does not require a permit. (1) Contractors performing maintenance on fire pumps and related equipment shall obtain a "Life Safety License" from the Code Official prior to commencing work and shall provide a copy of the maintenance report to the Code Official at the completion of the work performed. (E) Section 109.3 shall be amended as follows: 109.3 Violation Penalties. Persons who violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the Fire Code Official, or of a permit or certificate used under the provisions of this code, shall be guilty of a misdemeanor offense, punishable by a fine of not more than one thousand ($1,000) dollars or by imprisonment not exceeding 180 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense. (F) Section 111.4 shall be amended as follows: 111.4 Failure to Comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than three hundred ($300) dollars or more than one -thousand ($1,000) dollars. (G) A new Section, Section 113.6, shall be added as follows: 113.6 Permit Fees. (1) Each operational permit fee shall be fifty dollars ($50.00) (2) Each construction permit fee shall be fifty dollars ($50.00) (3) The Fire Code Official is authorized to waive a permit fee for 501.3 (C) non-profit organizations who do not charge an admission fee for permit required events. (H) A new Section, Section 114, shall be added as follows: 114 Additional Licenses and Fees. (I) A new Section, Section 114.1, shall be added as follows: -3- 114.1 Life Safety License Required. All installations, modifications, maintenance or servicing of life -safety systems are to be performed by an approved licensed business or person(s). A business or person(s) shall obtain a "Life Safety License" from the Fire Code Official, to perform work on life safety systems in the City of lona. Licenses shall expire one year from the date of issuance unless otherwise noted on the license. (J) A new Section, Section 114.2, shall be added as follows: 114.2 Life Safety License Fee. The fee for a life safety license fee shall be one hundred twenty five dollars ($125.00) annually. The license is non -transferable. (K) A new Section, Section 114.2.1, shall be added as follows: 114.2.1 Life Safety "Tags". Tags for inspection of fire suppression systems, fire extinguishers and fire alarm systems are required to be purchased from the Office of the Fire Marshal for use in the City of lona. Tags shall be affixed to fire extinguisher service tags from the contractor, commercial cooking suppression systems, fire alarm panels and/or fire sprinkler systems contractor service tags indicating date of service and Life Safety License number issued by the Code Official. (L) A new Section, Section 114.3, shall be added as follows: 114.3 Penalties for Violation of License Requirement. Any person who violates any rules or regulations, as written on the license application, shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than three hundred dollars ($300.00) for each day of violation. (M) A new Section, Section 114.4, shall be added as follows: 114.4 Payment of Permits, Licenses and Fees. Business owners and/ or individuals requesting a permit or license under the Fire Code and upon approval of the Code Official shall make payment to the City of lona. The City Clerk shall receive payment for approved permits and licenses. (N) A new Section, Section 114.5, shall be added as follows: 114.5 Plan Review Fees. (0) A new Section, Section 114.5.1, shall be added as follows: 114.5.1 Structural Plan Review Fees. Structural plan review fees will be charged at a rate of $50 per 5000 square feet, or portion thereof, up to a maximum of $700. The City upon request from the Code Official reserves the right to charge additional plan review fees for structural plan review for large or complex structural plan submissions. -4- (P) A new Section, Section 114.5.2, shall be added as follows: 114.5.2 Fire Alarm Plan Review Fees. Fire Alarm plan review fees will be charged at a rate of $50 per 100 devices, or portion thereof, up to a maximum of $150. This fee includes plan review and response and four (4) acceptance test field inspections by fire prevention personnel. An additional fee of $40.00 per inspection will be charged for inspection of fire alarm systems exceeding this amount. (Q) A new Section, Section 114.5.3, shall be added as follows: 114.53. Fire Sprinkler System Review Fees. Fire Sprinkler System fees will be charged at a flat rate of $100. This fee includes plan review and response for local or Authority Having Jurisdiction (AHJ) requirements, and four (4) acceptance filed inspections. Field inspections are to include fire service underground, rough -in inspection and hydro -test, hydro -test with all heads in place and final acceptance test of system. An additional fee of $40.00 per inspection will be charged for inspection of fire sprinkler systems exceeding this amount. (R) A new Section, Section 114.5.4, shall be added as follows: 114.5.4 Fire Pump Review Fees. Fire Pump fees will be charged at a flat rate of $100. This fee includes plan review and response and acceptance testing of the fire pump. (S) A new Section, Section 114.5.5, shall be added as follows: 114.5.5 Alarm Response Fee. The Code Official is authorized to charge a maximum fee of $150 per occurrence for fire apparatus response to Life Safety System activation where the service contractor fails to contact the Code Official and/or fire Dispatch Center when servicing such systems or excessive responses to the same location. The fee does not apply to a false alarm which is defined as the willful and knowing initiation or transmission of a signal, message or other notification of an event of fire when no such danger exists. The fee, subject to review by the Code Official will apply to nuisance alarms exceeding four (4) responses to the same location within a 30 day period. Nuisance alarms are defined as any alarm caused by mechanical failure, malfunction, improper installation, or lack of proper maintenance, or any alarm activated by a cause that cannot be determined. The fee will be charged to the business owner and/or service contractor after review by the Code Official. (T) A new Section, Section 114.5.6, shall be added as follows: 114.5.6 Mitigation Reimbursement Fees. Reimbursement fees that are actual and necessary expenses incurred in carrying out the mitigation of specialized emergencies or potential fire hazards including, but not limited to, hazardous materials, specialized rescue, and crime scenes (including arson), and securing abandoned -5- buildings shall be invoiced to the responsible person, firm or corporation. An available Fee Schedule shall be reviewed and posted annually by the Fire Administration Office. Fees may include, but not be limited to, personnel compensation, apparatus use, equipment use, and specialized contract labor associated with the mitigation of the specialized emergency. (U) Section 907.2 shall be amended as follows: 907.2 New Buildings and Structures. An approved addressable fire alarm system in accordance with the provisions of this code, and NFPA 72 (2010 Edition), shall be provided in new buildings and structures in accordance with Sections 907.2.1 through 907.2.23 inclusive, and provide occupant notification in accordance with Section 907.6, unless other requirements are provided by another section of this code. Where automatic sprinkler protection is installed in accordance with Sections 903.3.1.1 through 903.3.1.3 is provided and connected to the building fire alarm system, automatic heat detection required by this section shall not be required. The automatic fire detectors shall be smoke detectors. Where ambient conditions prohibit installation automatic smoke detection, other automatic fire detection shall be allowed. Addressable fire alarm systems shall be monitored by a UL listed monitoring station. (V) Section 907.3 shall be amended as follows: 907.3 Existing Buildings and Structures. An approved addressable fire alarm system in accordance with the provisions of this code, and NFPA 72 (2010 Edition), shall be provided in existing buildings and structures in accordance with Sections 907.3.1 through 907.3.1.8. Where automatic sprinkler protection is installed in accordance with Section 903.3.1.1 or 903.3.1.2 is provided and connected to the building fire alarm system, automatic heat detection required by this section shall not be required. An approved automatic fire detection system shall be installed in accordance with the provisions of this code and NFPA 72 (2010 Edition). Devices, combinations of devices, appliances and equipment shall be approved. The automatic fire detection shall be smoke detectors, except an approved alternate type of detector shall be installed in spaces such as boiler rooms where during normal operation; products of combustion are present in sufficient quantity to actuate a smoke detector. Addressable fire alarm systems shall be monitored by a UL listed monitoring station. Exceptions: -6- (1) Buildings with eight or less initiating devices may be zoned systems provided only one device is used per zone. Each device shall have a plain English LCD (liquid crystal display). (2) A zone map shall be provided by the alarm contractor and the map shall be located on the exterior of the Fire Alarm Control Panel (FACP) (W) Section 3301.3 shall be amended to add the following sentence: The storage of explosives and blasting agents is restricted or prohibited within the Corporate Limits of the City of Iona. -7- (X) Section 3301.1.5 shall be amended as follows: 3301.1.5 Establishment of Limits of Districts in Which Storage of Explosives and Blasting Agents Is to Be Prohibited. The limits referred to in Section 3301.1.5 of the International Fire Code, in which storage of explosives and blasting agents is restricted or prohibited, are hereby established as follows: The Corporate Limits of the City. (Y) Section 3404.2.9.6 shall be amended as follows: 3404.2.9.6 Locations Where Above -Ground Tanks Are Prohibited. The storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited within the Corporate Limits of the City of Iona. Exceptions: (1) The Code Official, with approval of the Fire Chief, may allow protected above ground tanks at motor vehicle fuel dispensing stations where underground rock formations or water levels make it extremely difficult or impossible to install underground tanks. These tanks must meet the UL 2085 listing and comply with Sections 1106.2 and 2206.2.3, 2206.8 and 3404.2.9.6 of the International Fire Code. Each approved tank shall not exceed twelve thousand (12,000) gallons in individual capacity and no more than forty-eight (48,000) gallons in aggregate capacity may be stored in this manner on any one property within the City. (2) The Code Official, with approval of the Fire Chief, may allow the use of temporary aboveground storage tanks at construction sites, earth moving projects or gravel pits. Such tanks shall comply with Section 3406.2 thru 3406.2.8.1, of the International Fire Code. a. The storage of flammable or combustible liquids in above -ground tanks, and the dispensing of flammable or combustible liquids into vehicles from above -ground tanks, shall not be permitted in the following zones as defined by the City Zoning Ordinance and located by the current Official Zone Map: RP, RP -A, R-1, R-2, R- 2A, R-3, R-3A, P-B and RMH. (Z) Section 3406.2.4.4 shall be amended as follows: 3406.2.4.4 Locations Where Above -Ground Tanks Are Prohibited. The limits in which new bulk plants in accordance with Section 3406.4, where flammable or combustible liquids are received by tank vessels, pipelines, tank cars, or tank vehicles, and are stored or blended in bulk for the purpose of distributing such liquids by tank -8- vessels, pipelines, tank cars, tank vehicles or containers are prohibited within the Corporate Limits of the City of Iona. (AA) I FC Section 3804.2 shall be amended as follows: 3804.2 Maximum Capacity within Established Limits of the International Fire Code. Section 3804.2, in which the storage of liquefied petroleum gas is restricted, are hereby established as follows: all zones except I&M-1 and I&M-2, Industrial and Manufacturing Zones as defined and designated in the current City Zoning Ordinance. Exception: (1) In particular installations, this capacity limit shall be determined by the Fire Code Official, after consideration of special features such as topographical conditions, nature of occupancy, and proximity to buildings, capacity of proposed containers, degree of fire protection to be provided, and the capabilities of the fire department. Section 4. Preservation of Prior Ordinance. The sections of the City Code repealed by this Ordinance shall be preserved to the extent necessary to allow the arrest, prosecution and punishment of any person who violates such provisions prior to the effective date hereof. Section 5. Severability. The sections and subsections of this Ordinance are severable. The invalidity of any section or subsection shall not affect the validity of the remaining sections or subsections. Section 6. Methodology. For the purpose of this Ordinance, text that is underlined means new text added to the former Ordinance or City Code Section, and text that is stricken through means text that is being deleted from the former Ordinance or Code Section. Text that is moved from one location in the former Ordinance to another is similarly shown as underlined text. -9- Section 7. Effective Date. This Ordinance shall become effective upon its passage, execution and publication in the manner provided by law. ORDINANCE NO.159-07-11 An ordinance of the city of Iona, Idaho; repealing and re-enacting title 7, chapter 1 of the Iona City Code regarding the adoption of the 2009 international building code; providing for severability; establishing methodology; providing for preservation of prior ordinance and establishing an effective date of May 2, 2011. International Building Code Adopted: The International Building Code, 2009 Edition, published by the International Code Council, Inc., along with Appendix J, Section J104.3 is hereby adopted as an official code of the City, except the portions deleted, modified or amended by the provisions of this chapter. ORDINANCE NO.160-08-11 An ordinance vacating a certain alley within the city of Iona, Idaho; particularly describing the said alley; authorizing and directing the mayor and city clerk to execute and deliver on behalf of the city a quitclaim deed conveying a portion of the vacated alley to the owner of the adjacent land; Date effective May 2, 2011. Section 1. Vacation of Alley. A portion of a public alley located adjacent to Lot 3, Block 12, and Lot 2, Block 12, according to the original plat of the Village of Iona, Bonneville County, Idaho, is not used or needed for public purposes. City Council and Planning and Zoning members, Ron and Diana Nelson for taking care of our lunch, and for Robyn Keyes for coordinating our annual Easter Egg Hunt. The weather was beautiful, the food was great, and everyone had a good time. Spring Clean-up. We had our annual spring clean-up day on April 30th and we wanted to thank all of those who participated in that event. It was a great success and we appreciate all the service of our citizens in the community and for Councilmember Gubler for coordinating this effort. Historical Society. The Historical Society is selling tickets to see Rio at the Paramount Theater. The tickets are for the May 28th show at 10:00 a.m. only and are $3.00 each, all proceeds will go toward the new Iona Historical Museum, so if you want to support a great cause and see a funny movie please purchase your tickets in advance at the City Clerk's office. Call 523-5600 for more information. The Iona Historical Society is gathering items for a garage sale on June 3`d and 4th. Money earned will be used for renovation for the Museum. The Historical Society will be presenting a dinner and melodrama during Iona Days. They are looking for performers for the melodrama and helpers during the play. Please call Arlene McCabe if you are interested in participating in the event. More information will be in the June newsletter. The City just finalized our Emergency Operating Plan. It will be available on our home page at www.cityofiona.org. Trent and SueAnn Dabell, are the City's new Sports Director's. T-ball, pitching machine, and girl's soft ball will be starting the first of June. If you have any questions or want to help out, please call them at 542-2304 If you have been wondering what has been going on Iona Road and 55th road; the City is extending the bike/pedestrian paths with a grant from the State of Idaho. Also, we will be installing flashing lights on the road by the school. By making these improvements it will make the streets safer for children and community. Silent Auction. The Iona Police Department will hold a silent auction for unclaimed bicycles recovered in Iona. The auction will be May 7 from 9:00 a.m. to 12:00 noon at the community center parking lot. Elections. Elections will be held May 17 at the Community Center. The candidates for Iona Bonneville Sewer District seat 1: 6 year term are Jason Blundell and Keith H. Morse. Director seat 4: 2 year term are Allen Beazer and Kelly D. Howell. The candidates for Bonneville County Library District Trustee Zone 5:6 year term are Suzanne Ricks and Jeff Ring. Absentee voting is open now at the County Court House The sewer district and library district are important entities for Iona residents. Please do your homework to learn what each candidate has for an agenda, then get out there and vote. Please do not forget your mothers and mothers of your children this Mother's Day (8th). Also, this Memorial Day please take your family to the cemetery (start atradition) and tell your children about your ancestors and those who gave their lives for our country so that we can have the freedoms we have today.
