Sec. 8-41: Ordinance Authorizing Sale of Municipally Owned
Real Property (Old Sewer Plant)
WHEREAS, the Village of Plainfield owns the following
described real property:
That part of Lot 18 of Fairbank's Addition to
Plainfield according to the Plat thereof recorded
December 20, 1856, as Document No. 25675, and part of
Lot 1 of 5chreffler's Addition to Plainfield according
to the Plat thereof recorded February 15, 1$81, as
Document No. 118536, described as follows: Beginning
at a point in the North line of said Lot 18, said
paint being 150.00 feet West of the Northeast corner
of said Lot 18 as measured along the North lane
thereof; thence West along the said North line a
distance of 159,00 feet; thence South parallel with
the most Easterly line of said Lot ~.$ and its
Southerly extension thereof a distance of 285.95 feet
to the South line of said Lot 1; thence East along
the South line of said Lot 1 a distance of 239.92
feet to the Easterly line of said Lot 1; thence
Northeast along the Easterly line of said Lot 1
a distance of 141.65 feet to the Northeast corner.
of said Lot 1; thence West along the North line of
said Lot 1 said line also being the South line of
said Lot 18 a distance of 143.73 feet said point
falling 150.00 feet West of the East line of said
Lot 18 as measured along the North Line thereof;
thence North a distance of 159.07 feet to the place
of beginning, all situated in part of the Northeast
quarter of Section 16, Township 36 North, Range 9
East of the Third Principal Meridian, Plainfield
Township, Will County, Illinois, containing 1.37
acres mare or less, which property is generally
located at 306 James Street, Plainfield, Illinois,
and is currently devoted to use as vacant land..
WHEREAS, the President and Board of Trustees of the village
of Plainfield have determined that it is no longer
necessary, appropriate, or in the best interest of the
Village of Plainfield that it retain title to said real
estate, and that said real estate is not required for the
use af, ar profitable to the Municipality; and

WHEREAS, pursuant. to Section 11-76-2 of the Illinois
Municipal Code, I11. Rev. Stat., c. 24, Section 11-76--2,
notice has been given of the proposal to sell such real
estate and bids have been invited for the purchase of such
real estate, said notice having first been published on
1975, and having been published for
three successive weeks in The Enterprise, a newspaper
published in the municipality;
WHEREAS, pursuant to said notice, bids were opened
at the regular meeting of the corporate. authorities held on
December 15, 1975; and
WHEREAS, the following bids for the purchase of such
property have been received:'

Board of Trustees of the Village of Plainfield, Will County,

Sec. 8-41-1: Preamble Recited: The President and
Board of Trustees find as facts the recitals hereinabove set
forth.

'Sec. 841-2: Ralph L3ada Bid Accepted: The bid of
Ralph Bada in the amount of Thirty-Seven Thousand Five
• Hundred .and No/100 Dollars ($37,500.00) is hereby
accepted by the President and Board. of Trustees df the
Village of Plainfield for the sale of the following
described real estate:

line thereof; thence West along the said North line
a distance of 159.00 feet; thence South parallel with
the most Easterly line of said Lot 18 and its Southerly
extension thereof a distance of 286.95 feet to the
South line of said Lot 1`; thence East along the South
line of said Lot 1 a distance of 239.91 feet to the
Easterly line of said Lot 1; thence Northeast along
the Easterly line of said Lot l a distance of 141.65
feet to the Northeast corner of said Lot 1; thence
West along the North line of said Lot 1 said line also
being the South line of said Lot 18 a distance of 143.73

place of beginning, all situated in part of the Northeast

Sec. 8-41-3: Officers to Execute Contract far Sale:
The President is hereby authorized and directed to sign
and the Village Clerk is hereby authorized and directed to
attest a contract for the sale and purchase of the aforesaid
real estate, which contract shall be in the form attached
hereto as Exhibit A.

Sec . 8--41-4 : Dela.very of Deed c Upon satisfaction
. of the terms of the aforesaid contract and upon the payment
or securing of the aforesaid bid price in the manner provided
in said contract, the President is hereby authorized and
directed to convey and transfer the aforesaid real estate to
Ralph Bada by a proper deed of conveyance, stating therein
the aforesaid consideration, and the Village Clerk is hereby
authorized to acknowledge and attest such deed and to affix
thereto the seal of the Village.
Sec. 8~-41-5: Officers Authorized: The President and
the Clerk are hereby authorized, respectively, to execute and
attest such other documents as may be necessary to the convey-
ance herein authorized.
Sec. 8-41-6: This ordinance shall be in full force and
effect from and after its passage, by a vote of at least three-
fourths of the corporate authorities now holding office, and
approval in the manner provided by law, and shall be known as

If evidence of title furnished disclUSes any defect in title except matters to which this sale is subject by the terms hereof seller
shall have forty days, computed from delivery of objections in case of an abstract, and from delivery of evidence of title in any
other case, in which to cure all defects, to which this sale is not subject. Seller, at his election, may cure all objections to title by
delivery pf guarantee policy covcriitg such objections such as he [night }rave furnished in the First instance. If such defects in title
be not cured within such forty days buyer may terminate this contract or may at his election, take the title as it then is (with right
to deduct from purchase price liens of deTinite or ascertainable amount) on giving seller notice of such election a'nd tendering per-
formance.. If no such notice be given or tender made within ten days after notice to buyer of. seller's inability to cure such defects,
this contract then shall he null and void. If this contract he terminated except for buyer's default earnest money shall be returned.
`' Lf buyer defaults hereunder, then, at the option of seller, earnest money shall be forfeited as liquidated damages and this
contract then shall be null and void.
