Sec. 8-26: ANNEXATION
WHEREA5, the real estate hereinafter described is
contiguous to the Village of Plainfield, a Munici-
°, pal Corporation, in the .County of Will, and Mate
of Illinois, 'and
WHEREAS, the territory is uninhabited .and unincor-
porated territory, and is owned by the Village of
Plainfield, and
WHEREAS, no electors reside on the territory here-
in described, and
WHEREAS, proper notices have been given and proper
hearings held, and
WHEREAS, it is for the best interest of said Village
that said territory be annexed to the Village of
Plainfield.
NOW, THEREFORE, BE IT ORDAINED HY THE PF-EfiSDENT
AND BOARD OF TRUSTEES OF T~3E VILLAGE OF PLAINFIELD,
ILLINOIS:

width of any and all adjacent highways and streets,
be and the same is hereby annexed to and declared
a part of the Village of Plainfield, a Municipal
Corporation.

I, HELEN B. LEIDIG, the duly elected, qualified,
and acting Village Clerk of said Village of Plainfield, Will
County, Illinois, do hereby certify that the above and foregoing
is a true and correct copy of Chapter 7 Article, 8 Section 8-26-1
through 8-26TS, Ordinance No. 7$7, entitled "ANNEXATION", which
was duly passed by the President and Board of Trustees of said
Village and approved by the President of the Board of Trustees
of said Village on the 9th day of September, 1974, and the original
of said Ordinance is now on file in my office, and that the map
attached is a true and accurate map of the territory annexed.
IN WITNESS WHEREOF, I have hereunto set my hand as
Village Clerk and attached the seal of said Village this 9th day
day of September, 1974.

This cause coming on to be heard upon the petition to
condemn of the Village of Plainfield, Wi11 County, Illinois, for
the. ascertainment of the just .compensation to be made for the
taking by said petitioner for the uses and purposes stated and
set forth in said petition to condemn, of the fee simple title
to the real property described in said petition to condemn;
And the petitioner appearing by McKeown, Fitzgerald,
Zollner, Suck, Sangmeister, & Hutchison, by Douglas P. Hutchison,
its attorney, and Defendants King J. Tuttle, a/k/a Kingston J.
Tuttle, and Eunice June Harney, appearing by Saxon, Niznik and
Peterson, by Gilbert Niznik, their attorney; and all parties not
appearing herein are defaulted;
And it appearing to the court that all other parties de-
fendant herein have been served with process in the manner and
form as provided for by statute or have duly entered their appear-
ances;
And the court having jurisdiction of all the parties to
this suit and the subject matter thereof, and all parties' inter-
ested being before the court and having waived a jury, and the
court having heard evidence, both oral and documentary, and argu-
ments pertaining to the subject matter and having considered the

following stipulation entered into between petitioner and the
owners of the real property described in said petition, namely:
1. THAT all matters pertaining to the jurisdiction of
the court over the persons and real estate involved
herein are proved.
2. THAT the Village of Plainfield, by Ordinance duly
passed by its President and Soard of Trustees has
stated that it is necessary, convenient, and desir-~
able for the Village to acquire the fee title to and
possession of the real property described a,n the pe-
tition for the purposes of a street, and authorizing
agents. of the Village to attempt to agree with the
parties of interest as to compensation, and if said
agreement is not reached under the eminent domaa.n
laws of the State of Illinois, to acquire said pro--
perty for said purposes.
3. THAT agents of the Village of Plainfield and the par-
ties of interest have been unable to .agree as to the
compensation to be paid.
And now being fully advised in the premises, finds that
the amount to be paid by the petitioner as just compensation to
the owners or owner of and party or parties interested in the pro-
perty hereinafter described, which said petitioner seeks to acquire
as stated in its petition to condemn filed in this cause, is as
follows:
To King J. Tuttle, a/k/a Kingston J, Tuttle, and Eunice
June Harney, owners of the fee simple title, as tenants in common
to the following described property:
That part of the Southeast quarter of Sec-
tion l~ in Township 36 North and in Range
9 East of the Third Principal. Meridian,
described as follows: The North 33 feet
of said southeast quarter from the westerly
right-of-way line of Division Street to the
easterly right--of--way line of James Street,
in Will County, Illinois

as full compensation to the owner or owners of and party or par-
ties interested in the aforesaid real property, and for all pri-
vats interest in the public roads,~/hand sit/reents which abut the said

The payment of said amount should be paid to the owners
of and party or parties interested in said real property will ful-
ly compensate said owners of and parties interested, for the taking
by the petitioner of the fee simple title to the aforesaid real
property.
And the court being fully advised in the premises, ~ ~.i'.
That defendants Unknown Owners are in default,
Orders, Adjudges and Decrees that the sums of money here-
in awarded by the court to the owner or owners of and party or
parties interested in said real property described herein and in
the petition to condemn filed herein, is just compensation to the
owner or owners thereof and party or parties interested therein
for the taking of the fee simple title to said property and for
damage to the remainder of the tract, of which it is a part, and
judgment herein entered accordingly.
It is therefore Ordered, Adjudged and Decreed by the
court that the Village of Plainfield, Wi11 County, Illinois, pe-
titioner herein, within sixty days from the entry of this Order

pay in accordance with the .provisions of the statute in such
ease made .and provided the sum heretofore set forth as full
compensation for the taking and damaging of said real property.
It is further Drdered, Adjudged and Decreed that upon
proof being made to the court that payment has been made to the
owner or owners of or persons interested in the parcels of land
aforesaid or upon deposit of payment with the County Treasurer
of will County, Illinois, for their use and benefit as aforesaid,
the petitioner herein, the Village of Plainfield, will County,
Illinois, shall be thereby vested with the fee simple title to
said parcels of land paid for by petitioner as aforesaid, and
thereupon said petitioner, Village o£ Plainfield, Will County,
Illinois, shah. be authorized and empowered~to enter upon and
take immediate possessa.on of said parcel of land so paid for.
