ARTICLE ll
Sec. 11-1: AN ORDINANCE PROVIDING FOR DEDICATION OF SCHOOL SITES
OR FOR PAYMENT OF THE FEE IN LIEU OF SCHOOL SITES BY LAND DEVELOP-
ERS. SUB-DIVIDERS OR BUILDERS:
WHEREAS, during the past few years the Village of Plainfield,
Will County, Illinois has experienced an increase in population due
principally to the subdividing of vacant land; and
WHEREAS, the planning studies have indicate3 that such popula-
tion growth will accelerate during the next ten years resulting
in the rapid disappearance of available land and the marked in-
crease in land values; and
WHEREAS, it is hereby found and determined that the public
interest conveniences, health, welfare and safety require the
establishment of school sites on land within the jurisdiction of
the Village in accordance with .the following criteria which is
consistent with the minimum site recommendations of the Office
of the State Superintendent of Public Instruction, and School
Districts of will County, Illinois:

WHEREAS, demographic studies of the residential portions of
a proposed subdivision or planned unit development or mobile home

park can be readily and scientifically conducted to determine the
number of elementary and secondary school age children and adults
to be generated therefrom and provide a method whereby the required
dedications of land directly attributable to the activity of the
subdivider, developer or builder and the proposed subdivision or
mobile home park or planned development may be calculated; and
WHEREAS, it has been found and determined that the locations
of school sites to serve the immediate and future needs of children
of each new subdivision or development is just as essential to pro-
per land development as are streets, water, sewers and sidewalks,
and to that end the County has determined that the dedication of
land for school sites or cash contributions in lieu of actual land
dedication (where the latter is deemed impractical) or combination
of both, shall be required of each subdivider, developer of a
planned unit development, mobile home park, or multiple family
unit development.
NOW, THEREFORE, BE IT ORDAINED BY TFiE BOARD OF TRUSTEES OF
THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS as follows:
Sec. 11-2: DEDICATION OF SCHOOL SITES OR FOR PAYMENTS OF FEES
IN LIEU THEREOF: As a condition of approval of final plat of sub-
division, or of a .final plat of a planned unit development, or
in application for permit for mobile home park, each subdivider
developer, or builder of a planned unit development or mobile
home park, will be required to dedicate land for school sites,
to serve the immediate and future needs of the residents of the
development, or make a cash contribution in lieu of actual land
dedication, or a combination of both, in accordance with the fol-
lowing criteria and ,formula:

bution is recxuired, the following formula shall
be used:

The Comprehensive School Plan and/or the standards adopted by
the Plainfield Community Consolidated School District No. 202, Will
County, Illinois (hereinafter referred to as School District) shall
be used as a guideline in locating sites.

Criteria for Re uirin a Contribution in Lieu of a School Site:
(1) Where the development is small and the resulting site is
too small to be practical or when the available land is inappropri-
ate for a school site, the Village, with the recommendation of the
Board of Education of the School District, affected, shall require
the subdivider, developer or u~ er, o pay a cash contribution in
lieu of land dedication required. The word small in this section is
defined as a total number of proposed dwelling units that will pro-
duce less than the maximum number of students for one school of each
school Classification as set forth in Section 1 A. (2) School
Classification and Size of School Site.
The determination that available land is inappropriate for a
school site shall be made by the Village after inspection of the
land by the Superintendent of the School District, and after hear-
ing the recommendation of the school armor tFie School District,
and any builder, subdivider or developer affected. Any ui er,
subdivider or developer affected may request a hearing before the
Village Board on the question of whether the proposed land is in-
appropriate as a school site. Any builder, subdivider or develop-
er affected as well as the school board of the School District
may present evidence at said hearing and in add~t~on, tie v37~~age
Board, in its discretion, may hear evidence from other interested
(2) The School District, if it is to be recipient of funds
under this Ordinance, shall prior to July 1st of each year es-
tablish an average valuation indicating current market value of
improved property within the School District. This valuation
shall be for a parcel of land meeting such standards of topogra-
phy, soil condition, access, and improvements as are determined
by the local school board, and shall be of such minimum size as
established by the recommendations of the State Superintendent
of Public Instruction.
C. Criteria for Requiring Dedication and a Fee
There will be situations in subdivision, planned unit develop-
ments or mobile home parks when a combination of land dedication an
a contribution in lieu of land are both necessary. These occasions
will arise when:
(1) Only a portion of the land to be developed is proposed
as the location for a school site. That portion of the land
within the subdivision, planned unit development or mobile
home park falling within the school location shall be dedi-
cated as a site as aforesaid, and a cash contribution in
lieu thereof shall be required for any additional land that
wnul~ have been recuired to be dedicated.

-D. Densit Formula:

The table of population density contained in attached Exhibit
"A" is generally indicative of current and short range projected
trends in family size for new construction as determined by the
Illinois School Consulting Service, and shall be used in calculat-
ing the amount of required dedication of acres of land or the cash
contributions in lieu thereof unless a written objection is filed
thereto by the subdivider or developer or builder with the Village
Board.
In the event a subdivider, developer or builder files a written
objection to the Table of Estimated Student Population, listed here-
in in Exhibit "A" he shall submit his own demographic study showing
the estimated additional population to be generated from the sub-
division or planned unit development or mobile home park. Tn that
event, final determination of the density formula to be used in
such calculation, shall be made by the Village Hoard after a hear-
ing. At such hearing, the builder, subdivider or developer, the
school district, and other interested persons, in the discretion
of the Village Board, may present demographic information. The
population density formula and the specific formula for the dedi-
cation of land or payment of fees in lieu thereof, will be based
on the latest available data of the .Illinois School Consulting
Service and the Office of the Superintendent of Public Instruction.
Tt shall be presumed that the subdivider, developer, or builder in-
tends to construct units with the maximum school age population
density permitted by the ordinances of the Village. This presump-
tion may be overcome by the subdivider, developer or builder species

E. Reservation of Additional Land:
Where the comprehensive plan or the standards of the Village
and/or the County of tn'ill shall call for a larger amount for school
sites in a particular subdivision or planned unit development or
mobile home park than the developer is required to dedicate, the
land needed beyond the developer's contribution shall be reserved
for subsequent purchase by the Village or other public body desig-
nated by the Village provided that such acquisition is made within
one year from the date of approval of the final plat or the issuance
of such permit.

Where the subdivision, planned unit development or builder or
mobile home park is less than 40 acres, a school site which is
to be dedicated, should, where possible, be combined with dedi-
cations for adjoining developments in order to produce usable
school sites without a hardship on a particular developer.
G. To ogra h and Grading
The slope, topography and geology of the dedicated site as well
as its surroundings must be suitable for its intended purposes.
H. Improved Sites:
7111 sites shall be improved in accordance with requirements of
the ordinances of the Village or the requirements imposed there-
under by the Village Soard with the recommendation of the Plan
Commission.
I. Time of Conve ance or 1'a~rment:
Sudivider or developer shall convey to the respective school dis-
trios the land required under this agreement within thirty days
after any subdivision plat or final plat of a planned unit develop-
ment is recorded in the Recorder's Office of Will County, Illi-
nois, All improvements shall be completed within such time as
required by the Village. A subdivider, developer or builder shall
make any cash contributions required under this ordinance upon
the issuance of any Building Permit by the Village.
Payments shall be made directly to the School District or dis-
trios wherein the development, subdivision or buildinq is locat-
ed and evidence of said payment shall be made at the time of
application for the building permit.

~~ -- The amount of each payment of cash shall be determined. by the
Village and subdivider, and/or developer at the time of the
approval of the final subdivision plat or final plat of a
planned unit development or conditional permitted use for a
mobile home park. The schedule of payments shall be filed in
the Recorder's office, will County, Illinois, and in the office
of the Village Clerk.
J. Collection of Monies:
The Village shall have the right to delegate the responsibility
for collecting monies due under this ordinance to other public
bodies designated by the Village.
Sec. 11-3: RIGHT OF THE VILLAGE TO ELECT TO USE SITE FOR OTHER
PURPOSES:
The Village shall have the right to elect to use for Public Recrea-
tional purrposes without charge on any land dedicated to the school
district affected, provided, and during such period of time, said
lands are not then used for school purposes. fichool district rtay
terminate the Village's right to use any parcel of land for park
purposes by giving the Village six months written notice of the
school district's intent to use said land for school purposes at
that time. Upon electing to use said land, Village shall furnish
evidence of Public liability insurance covering the Village and
school district in an amount equal to that carried by the School
District.
Nothing herein shall prevent the Village from assigning privi-
leges and duties stated herein to the Plainfield Township Park
District, subject however to the terms hereof.

Sec. 11--4: SEVERABILITY:

If any provisions of the Ordinance,
or the application thereof to any person or circumstanc~ss is
declared invalid by a court or competent jurisdiction, such par-
tial. invalidity shall not affect without the invalid provision or
application thereof, and to this extent the provisions of this
Ordinance are declared to be severable.
Sec. ll-5: HOLD HARMLESS: Any public body designated by the Va. ~.--
lage to receive the cash contribution required hereunder or to be
the grantee of any conveyance required hereunder shall agree to
indemnify and hold the Village harmless from any casts, fees, cash
payments or ].and conveyances required by any court of competent
jurisdiction if any part of this Ordinance is held invalid.
Sec. 1.1-fi: EFFECTIVE DATE: This Ordinance shall be in full force
and effect from and after its passage, approval and publication as
provided by law and shall be known as Ordinance # 7~$.
