ORDINANCE NO. -L~~_
AN ORDINANCE TO ACCEPT JURISDICTION, MAINTENANCE, RESPONSIBILITY AND
CONTROL OVER CERTAIN ROADS RELINQUISHED BY THE BOARD OF COUNTY COM-
MISSIONERS OF GRAND COUNTY, COLORADO.
WHEREAS, by Resolution No. 1986-2-4 on
the Board of County Commissioners of Grand County
Town of Fraser the jurisdiction, maintenance,
control over the following roads:
February 18,1986,
did transfer to the
responsibility and
(a) County Road 8 from U.S. Highway 40 to Wapiti Drive;
(b) County Road 72 from U.S. Highway 40 to the Railroad
right of way;
and
WHEREAS, the Town of Fraser wishes to accept such jurisdic-
tion, maintenance, responsibility and control.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE TOWN OF FRASER, COLORADO, AS FOLLOWS:

(I) That jurisdiction, maintenance, responsibility and control over
the following roads be accepted from the Board of County Commission-
ers of Grand County, with the condition that if the Town every va-
cates such road, ownership of the road shall revert to Grand County:
(a) County Road 8 from U.S. Highway 40 to Wapiti Drive;
(b) County Road 72 from U. S. Highway 40 to the Railroad right
of way.

(1) If any part, section, subsection, sentence, clause or phrase of
this Ordinance is for any reason held to be invalid, such decision
shall not affect the validity of the remaining portions of this Ordi-
nance and the Town Board hereby declares it would have passed this
Ordinance, and each part, section, subsection, sentence, clause or
phrase thereof, regardless of the fact that anyone or more parts,
sections, subsections, sentences, clauses or phrases be declared
invalid.

(I) The repeal or the repeal and reenactment of any provision of the
Code of the Town of Fraser, Colorado as provided in this ordinance
shall not affect any right which has accrued, any duty imposed, any
violation that occurred prior to the effective date hereof, any
prosecution commenced, nor any other action or proceeding as com-
menced under or by virtue of the provision repealed or repealed and
re-enacted. The repeal of any provision hereby shall not revive any
provision or any ordinance previously repealed or superseded unless
expressly stated herein.

(1) The Town Board hereby finds, determines and declares that this
ordinance is necessary and proper for the health, safety, and welfare
of the Town of Fraser and the inhabitants thereof.

Section 5.
Effective Date.
(I) Upon signing hereof by the Mayor and Town Clerk, this Ordinance
shall become effective thirty (30) days after the publication there-
of.
