In coordination with the Massachusetts Division of Marine Fisheries, the Town of Brewster has developed a
comprehensive plan to manage the vital fish-ways utilized by diadromous, and catadromous fish species. The
two periods of the year that management will occur are (October — mid-December) to identify and address early
blockages, and (February — early March) to conclude any work prior to the arrival of fish in the spring.
Management would include the removal of impediments to flow including seasonal debris, and fallen trees.
"Fish screens" may be used to control/limit the movement of fish when drops in pond height may make some
fish-ways impassable. Hand tools (pitchforks, rakes, loppers, etc.) are suitable for most conditions. Large
fallen trees may require a chain-saw. The cutting of riparian vegetation and stream canopy will be limited.

Stream Channel Maintenance for Diadromous Fish Passage
To: Brewster Conservation Commission

The Massachusetts Division of Marine Fisheries (MA DMF) regulates the passage of diadromous fish in
Massachusetts' coastal rivers and provides guidance to property owners and municipalities on the
maintenance of passageways. The relevant authorities include M.G.L Chapter 130 §19 on maintaining sea-
run fish passage, the Wetlands Protection Act (WPA), and Massachusetts regulations (principally CMR
310 10.35). The recommended actions are focused on manual vegetation cutting and debris removal and
designed to offer enough relief from channel obstructions to allow fish passage with no impedance of
natural resource functions or WPA performance standards. Further, we support the tradition of Towns using
the process and authority of M.G.L Chapter 130 §94 to enable Town-appointed Herring Wardens to
maintain passageways with technical support from MA DMF. The WPA provides Conservation
Commissions with authority to regulate activities within 100 ft . of wetlands and streams. In recent years,
the approach for local maintenance of river herring runs by Town officials has included Conservation
Commission approval through a Determination of Applicability or administrative processes.
Town officials charged with marine resource management and enforcement responsibilities can access
private property to reach the waterways and tidelands of the Commonwealth. Coordination is recommended
with private property owners to reach an agreeable consensus on stream access, especially if volunteers are
used. If access is contested, MA DMF is available to consult with the private property owner to describe
their responsibility to provide passage for sea -run fish in Massachusetts and the benefits of working
cooperatively with Town officials to achieve this goal. This memorandum was prepared for your
Commission's review and to assist mutual interests in natural resource management.
Stony Brook Stream Channel Maintenance Plan
Area of Work. The Stony Brook Watershed has several locations that needs annual attention to support
the migratory path of diadromous fish. The Brewster Natural Resources Department is the primary Town
Department to annual address stream maintenance in the following stream sections:
1.) Stream channel inspection north of the Stony Brook Mill to tidal zone.
2.) Channel inspection, periodic sediment removal from fishway pools, seasonal installation and
maintenance of electronic fish counter, and vegetation removal from stone retaining walls at Stony
Brook Mill.
3.) Hand digging of excess sediment accumulation, gabion repair, and vegetation removal in channel
between Lower and Upper Mill Ponds. Important to keep Phragmites in check with hand cutting and
to schedule fall inspections for juvenile herring emigration.
4.) Inspect narrows between Upper Mill Pond and Walkers Pond annually. Remove debris jams and
wetland shrubs that threaten to close narrows.
5.) Inspect channel from Walkers Pond to Slough Pond to remove debris jams from culvert and channel.
Consideration should be made in low flow years to screen off entrance to channel to prevent adult
herring from spawning in Slough Pond with subsequent poor juvenile herring survival. If temporary
screen is installed is will require weekly inspection during spring and removal by July 15th.
5.) Inspect channel from Walkers Pond to Elbow Pond. Consider if fish passage is possible, and as
needed, remove debris from channel and inspect for road stormwater issues.
6.) Inspect channel from Slough Pond to Pine Pond. Consider if fish passage is possible, and as needed,
remove debris from channel and inspect for road stormwater issues.
7.) Inspect channel from Long Pond to Greenland Pond. Remove debris and jams from channel and
culvert pipe. Coordinate with Town of Harwich Department of Natural Resources on water surface
elevation management at Long Pond outlet and develop targets based on staff gauge data.
8.) Coordinate with Town of Harwich DNR on fish passage from Long Pond into Blacks Pond.
Remove debris from fishway and hand dig sand accumulation as needed.
9.) Coordinate with Town of Harwich DNR annually on fish passage from Long Pond into Mill Pond
(Girl Scout Pond). Remove debris from fishway and hand dig sand accumulation as needed.
Participants. Approval of this plan by the Brewster Conservation Commission allows Town of Brewster
staff, led by the Natural Resources Department, and appointed volunteers to conduct stream channel
maintenance in the Stony Brook watershed.
Season. Two periods should be targeted for annual work in stream channels to remove passage
impediments to migratory fish: the fall (October to mid-December) to identify obstructions and conduct
maintenance, and winter (February to early March) to continue work before the spring fish runs. This
approach allows for a second round of work if dense growth or large fallen trees are found at early visits.
Monthly inspections are recommended during the migratory period of March 1st to June 30th for river
herring and American eel; however, in-water work should be minimized to essential actions. The summer
can be a third option given the availability of seasonal labor and the value of low-flow maintenance for
juvenile fish emigration; however, this is not always optimal given the summer heat and high plant
growth.
Methods. In-channel maintenance should be limited to removal of trash and debris that can directly
impinge and block fish, and mid-channel rooted vegetation that threatens to reduce water flow, snag
debris, or impede fish passage. Hand tools, saws, and clippers are suitable for most conditions. Chainsaws
can be used occasionally for large tree falls. The cutting of riparian vegetation and stream canopy should
be limited. The riparian buffer provides value for a wide range of aquatic life and the canopy is important
to provide wildlife habitat, shade the stream and reduce access for predators of diadromous fish.
Live Vegetation Removal. Enthusiasm can often lead to more live vegetation removal than necessary.
Care should be taken to remove only live vegetation that can limit fish passage or has that potential with
higher growth and debris accumulation. Root masses in the stream channel can be considered for
removal if their continued growth could threaten fish passage or encourage channel braiding. Stream
bank growth, including large caliper trees, has ecological value and should not be removed unless their
presence in the channel could directly impede fish passage or cause significant bank erosion.
Dead Vegetation Removal. As described above, vegetation debris that can impede or impinge fish or
encourages additional accumulation can be removed. Stream bank logs and stumps can provide valuable
habitat for other aquatic resources and should be altered only as necessary to provide fish passage.
Sediment Management. Road crossings should be inspected with each winter visit and accumulated
sediment and bank erosion should be noted. If sand accumulation threatens passage by reducing water
depth, the excess sand should be removed by hand using shovels. Observations of sedimentation and
erosion should be noted and reported to the Conservation Commission to assist future management
efforts.
Brook Trout Presence. Native brook trout are not known to be present in the watershed.
Channel Improvements. The movement of large rocks and cobble occurring naturally in the stream is
allowed during stream maintenance. The purpose should be to reduce passage impediments, and to create
in-stream weirs when necessary to improve water velocity and depth to assist fish movements.
Documentation. A log of inspection and stream maintenance activities should be recorded and include
dates of inspections, summaries of activities, and observations of the presence of diadromous fish,
noteworthy flora and fauna, invasive plants, and observations of issues that may need future attention.
Safety Practices. Stream maintenance work should be conducted by coordinated teams and not with
individuals working alone. For deeper stream channels, waders with wader belts should be worn.
Plan Status. The plan was reviewed by the Brewster Conservation Commission on 1/26/21,
DMF Coordination. MA DMF fully supports the practice of annual stream maintenance to sustain
diadromous fish passage during their obligatory migrations. We published stream maintenance protocols
in 2016 to guide local efforts on this important resource management practice:

Request for Determination
376 Run Hill Road
Map 36 Parcel 56
Request is to replace existing railroad tie steps to pond with same
configuration and material and add a rope railing. Request is also to
add a seasonal aluminum retractable dock no larger than 4' X 16'.
The current railroad tie steps are rotting and dangerous. The site will
be used by the Brewster Ponds Coalition volunteers for seasonal
aerosol testing which will begin in May 2021. Safe steps with a rope
railing are needed to access the aerosol equipment assembled on the
dock. All work will remain within the existing footprint and existing
vegetation will not be disturbed. The minimal excavation (if needed)
will be done by hand. All construction debris will be removed from
the lot.

Cape Codder Newspaper no less than five (5) days prior to the hearing. If you have
questions, please call the Brewster Conservation Department at 508 896-4546, extension
4243, between the hours of 8:30 AM and 4:00 PM.

On behalf of the Village of OE II and the Corcoran Jennison Management Co, we hereby request a minor
modification to the existing Order of Conditions SE 9 – 1805 to allow for annual pruning of vegetation at
the perimeter of the auxiliary parking area immediately adjacent to the retaining wall that is the subject
of the OOC under DEP file SE 9 - 1861. This modest pruning will be done only to maintain the existing
footprint of the gravel parking area as currently defined and displayed on the attached site plan.
