HomeMy Public PortalAboutORD 153-01-11_International Mechanical Code_04192011M1 ORDINANCE NO. /53 ` c)/ -1 I AN ORDINANCE OF THE CITY OF IONA, IDAHO; REPEALING AND RE-ENACTING TITLE 7, CHAPTER 7 OF THE IONA CITY CODE REGARDING THE ADOPTION OF THE 2009 INTERNATIONAL MECHANICAL CODE; PROVIDING FOR SEVERABILITY; ESTABLISHING METHODOLOGY; PROVIDING FOR PRESERVATION OF PRIOR ORDINANCE AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Amendment of section 7-7-1, Iona City Code. Section 7-7-1 of the City Code of Iona, Idaho, is hereby repealed and re-enacted as follows: 7-7-1: INTERNATIONAL MECHANICAL CODE ADOPTED: (A) International Mechanical Code Adopted: The International Mechanical Code, 2009 Edition, published by the International Code Council, Inc., is hereby adopted as an official code of the City, except the portions deleted, modified or amended by the provisions of this chapter. (B) Code on File: One (1) copy of the International Mechanical Code, 2009 Edition, shall be retained by the City Clerk for use and examination by the public. Section 2. Amendment of section 7-7-2, Iona City Code. Section 7-7-2 of the City Code of Iona, Idaho, is hereby repealed and re-enacted as follows: 7-7-2: AMENDMENTS TO THE INTERNATIONAL MECHANICAL CODE: (A) Section 103.2 of the International Mechanical Code, 2009 Edition, shall be amended to read as follows: 103.2 Appointment. The code official shall be appointed by the chief appointing authority of the jurisdiction. (B) Section 109.1 of the International Mechanical Code, 2009 Edition, shall be amended to read as follows: -1- 109.1 Application for appeal. A person shall have the right to appeal a decision of the code official to the board of appeals. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted. The application shall be filed on a form obtained from the code official within 20 days after the notice was served. Section 3. Preservation of Prior Ordinance. The sections of the City Code repealed by this Ordinance shall be preserved to the extent necessary to allow the arrest, prosecution and punishment of any person who violates such provisions prior to the effective date hereof. Section 4. Severability. The sections and subsections of this Ordinance are severable. The invalidity of any section or subsection shall not affect the validity of the remaining sections or subsections. Section 5. Methodology. For the purpose of this Ordinance, text that is underlined means new text added to the former Ordinance or City Code Section, and text that is stricken through means text that is being deleted from the former Ordinance or Code Section. Text that is moved from one location in the former Ordinance to another is similarly shown as underlined text. Section 6. Effective Date. This Ordinance shall become effective upon its passage, execution and publication in the manner provided by law. Code on File: One (1) copy of the International Fuel Gas Code, 2009 Edition, shall be retained by the City Clerk for use and examination by the public. International Energy Conservation Code Adopted: The International Energy Conservation Code, 2009 Edition, published by the International Code Council, Inc., is hereby adopted as an official code of the City, except the portions deleted, modified or amended by the provisions of this chapter. Code on File: One (1) copy of the International Energy Conservation Code, 2009 Edition, duly certified by the Clerk, shall be retained by the City Clerk for use and examination by the public. ORDINANCE NO. 157-05-11An ordinance of the city of lona, Idaho; repealing and re-enacting title 7 chapter 10 of the lona City Code regarding the adoption of the 2009 international fire code; providing for severability; establishing methodology; providing for preservation of prior ordinance and establishing an effective date of May 2, 2011. Fire Code Adopted: The International Fire Code, 2009 Edition, as published by the International Code Council, Inc., including all Appendices, is hereby adopted as an official code of the City, save and except such portions as are hereinafter deleted, modified or amended by the provisions of this chapter or by State Code. Code on File: One (1) copy of the International Fire Code, 2009 Edition, duly certified by the Clerk shall be retained by the City Clerk for use and examination by the public. ORDINANCE NO. 158-06-11An ordinance of the city of lona, Idaho; repealing and re-enacting title 7, chapter 6 of the lona City Code regarding the adoption of the 2009 international residential code; providing for severability; establishing methodology; providing for preservation of prior ordinance and establishing an effective date of May 2, 2011. International Residential Code Adopted: The International Residential Code for One and Two Family Dwellings, 2009 Edition, published by the International Code Council, Inc., including Appendix M, is hereby adopted as an official code of the City, except the portions deleted, modified and amended by the provisions of this Chapter or deleted, modified or amended by Chapter 41, Title 39, Idaho Code. Code on File: One (1) copy of the International Residential Code for One and Two Family Dwellings, 2009 Edition, including Appendix M, shall be retained by the City Clerk for use and examination by the public. ORDINANCE NO.159-07-11 An ordinance of the city of lona, Idaho; repealing and re-enacting title 7, chapter 1 of the lona City Code regarding the adoption of the 2009 international building code; providing for severability; establishing methodology; providing for preservation of prior ordinance and establishing an effective date of May 2, 2011. International Building Code Adopted: The International Building Code, 2009 Edition, published by the International Code Council, Inc., along with Appendix J, Section J104.3 is hereby adopted as an official code of the City, except the portions deleted, modified or amended by the provisions of this chapter. Code on File: One (1) copy of the International Building Code, 2009 Edition, including such Appendix, shall be retained by the City Clerk for use and examination by the public. ORDINANCE NO.160-08-11 An ordinance vacating a certain alley within the city of lona, Idaho; particularly describing the said alley; authorizing and directing the mayor and city clerk to execute and deliver on behalf of the city a quitclaim deed conveying a portion of the vacated alley to the owner of the adjacent land; Date effective May 2, 2011. Section 1. Vacation of Alley. A portion of a public alley located adjacent to Lot 3, Block 12, and Lot 2, Block 12, according to the original plat of the Village of lona, Bonneville County, Idaho, is not used or needed for public purposes. The Mayor and City would like to thank all of the sponsors: Idaho Truck Service, Bonneville Art Association, Business Phone Specialist, Ryan Precision Cabinets, Council member Case and his wife, Merodene, Westmark Credit Union, Bank ofCommerce, Blast-off, Chuck -A -Rama, Ammon Walmart, Northgate Mile Mc Donalds, Eastern Idaho International Association of Electrical Inspectors, and Arby's. City Council and Planning and Zoning members, Ron and Diana Nelson for taking care of our lunch, and for Robyn Keyes for coordinating our annual Easter Egg Hunt. The weather was beautiful, the food was great, and everyone had a good time. Spring Clean-up. We had our annual spring clean-up day on April 30th and we wanted to thank all of those who participated in that event. It was a great success and we appreciate all the service of our citizens in the community and for Councilmember Gubler for coordinating this effort. Historical Society. The Historical Society is selling tickets to see Rio at the Paramount Theater. The tickets are for the May 28th show at 10:00 a.m. only and are $3.00 each, all proceeds will go toward the new lona Historical Museum, so if you want to support a great cause and see a funny movie please purchase your tickets in advance at the City Clerk's office. Call 523-5600 for more information. The lona Historical Society is gathering items for a garage sale on June 3`d and 4th. Money earned will be used for renovation for the Museum. If you have items to donate to the sale please call ZoAnn Simmons 522-0707, Kathy McNamara 529-5004, Betty McKinlay 524-2932, or Kay and Sandra Covert 521-8850. The Historical Society will be presenting a dinner and melodrama during lona Days. They are looking for performers for the melodrama and helpers during the play. Please call Arlene McCabe if you are interested in participating in the event. More information will be in the June newsletter. The City just finalized our Emergency Operating Plan. It will be available on our home page at www.cityofiona.org. Trent and SueAnn Dabell, are the City's new Sports Director's. T-ball, pitching machine, and girl's soft ball will be starting the first of June. If you have any questions or want to help out, please call them at 542-2304 If you have been wondering what has been going on lona Road and 55th road; the City is extending the bike/pedestrian paths with a grant from the State of Idaho. Also, we will be installing flashing lights on the road by the school. By making these improvements it will make the streets safer for children and community. Silent Auction. The lona Police Department will hold a silent auction for unclaimed bicycles recovered in lona. The auction will be May 7 from 9:00 a.m. to 12:00 noon at the community center parking lot. Elections. Elections will be held May 17 at the Community Center. The candidates for lona Bonneville Sewer District seat 1: 6 year term are Jason Blundell and Keith H. Morse. Director seat 4: 2 year term are Allen Beazer and Kelly D. Howell. The candidates for Bonneville County Library District Trustee Zone 5:6 year term are Suzanne Ricks and Jeff Ring. Absentee voting is open now at the County Court House The sewer district and library district are important entities for lona residents. Please do your homework to learn what each candidate has for an agenda, then get out there and vote. Please do not forget your mothers and mothers of your children this Mother's Day (8th). Also, this Memorial Day please take your family to the cemetery (start atradition) and tell your children about your ancestors and those who gave their lives for our country so that we can have the freedoms we have today. You can see it in their smiles, through passing years and changing styles, a friendship that continually seems to grow. You can see it in their lives, the joy each one of them derives, in just knowing that the other one is there. To care and to understand, lend an ear or hold a hand, and to celebrate the memories they share. Once upon a memory someone wiped away a tear held me close and loved me, Thank you, Mother dear. P.S.
