CALL TO ORDER: The meeting was called to order at 5:06 p.m. by Mayor Rosenfield. The following were present: Also Present: Mayor Jean Rosenfield Assistant Mayor Joni D. Blachar Councilwoman Patricia Cohen Councilman Martin Packer Councilman Jaime M. Sanz Jorge M. Gonzalez, Village Manager Eilisa L. Horvath, MMC, Village Clerk Richard Jay Weiss, Village Attorney PLEDGE OF ALLEGIANCE: The Pledge was led by Councilman Packer. REGULAR AGENDA: R7 - Resolutions/Public Hearings Mr. Gonzalez reviewed a Powerpoint presentation of the Proposed Operating Budget & Capital Budget for Fiscal Year 2014/2015. He discussed the Budget Committee's role during the budget process. He noted that the tentative budget was set at 2.2678 mills on July 15, 2014. He discussed the proposed enhancements to the FY 2014/2015 base budget. Mr. Gonzalez announced that the proposed millage rate is 2.2678 mills, the rolled -back rate is 1.7387 mills, and the proposed millage rate is 30.43%higher than the rolled -back rate. Mr. Gonzalez discussed another option to reduce the millage rate to 2.0611, which is 18.54% higher than the rolled -back rate. He noted that the 2.0611 millage rate was recommended by the Budget Committee. Mr. Gonzalez discussed his goals in developing the budget and thanked Village -staff -for their input in the budget. Seth Salver — Budget Committee Chair, reported that the Committee unanimously recommended a rate of 2.0611 mills, which included the proposed enhancements. Bal Harbour Village First Budget Hearing Minutes 09/11/2014 1 R7A: The following Resolution title was read by Mrs. Horvath: A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, ADOPTING THE PROPOSED MILLAGE RATE OF THE VILLAGE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2014 THROUGH SEPTEMBER 30, 2015, PURSUANT TO SECTION 200.065, FLORIDA STATUTES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Public Hearing A motion was offered by Assistant Mavor Blachar and seconded by Councilman Packer to approve the Resolution. Mayor Rosenfield opened the public hearing The following members of the public provided comments: Dr. Michael Krop (9601 Collins Avenue) Dina Cellini (211 Bal Cross Drive) Gabriel Groisman (191 Bal Bay Drive) Mr. Gonzalez discussed the idea behind the Collins Avenue Corridor Capital Project. There being no additional comments, Mayor Rosenfield closed the public hearing. The Council discussed the two options for the millage rate. A motion was offered by Assistant Mayor Blachar and seconded by Councilman Packer to fill in the blank portions of the Resolution, with 2.0611 mills, which is an 18.54% increase over the rolled -back rate. The following members of the public provided comments: Ree Kelly Stoppa (1075 — 93r Street, Bay Harbor Islands) Several members of the Council noted that the Budget Committee had recommended a 2.0611 millage rate. The motion passed (4-1), with the roll call vote as follows: Assistant Mayor Blachar yes; Councilwoman Cohen yes; Councilman Packer yes; Councilman Sang no; Mavor Rosenfield yes; thus becoming Resolution No. 2014-855. R7B: The following Resolution title was read by Mrs. Horvath: A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR, VILLAGE, FLORIDA, APPROVING AND ADOPTING THE TENTATIVE BUDGET FOR BAL HARBOUR VILLAGE FOR FISCAL YEAR 2014-2015, PROVIDING FOR EXPENDITURE OF FUNDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Public Hearing A motion was offered by Assistant Mavor Blachar and seconded by Councilman Packer to Bal Harbour Village First Budget Hearing Minutes 09/11/2014 2 approve the Resolution. The following members of the public provided comments: Beth Berkowitz (10160 Collins Avenue) Ree Kelly Stoppa (1075 — 9314 Street, Bay Harbor Islands) Dina Cellini (211 Bal Cross Drive) The Council agreed to provide a summary of Ms. Berkowitz's comments in the minutes. Ms. Berkowitz provided comments on the Utilities (FPL) line item under the Gated Residential Section. She noted that the electricity for the street lights in the Gated Residential Section, which was a private area, was paid for from the Village's General Fund. There being no additional comments, Mayor Rosenfield closed the public hearing: Several members of the Council spoke in favor of looking into the items regarding the Gated Residential Section and determine the correct party to pay the bills for the lights, etc. in that area. Mr. Weiss offered to meet with members of the Council to review his legal opinion, regarding the Gated Residential Section and those issues. It was noted that the Village Manager was working on addressing the issues with the Gated Residential Section, with the recommendation to dissolve the Gated Residential Section Advisory Committee, etc: Mr. Gonzalez noted that the Gated Residential Section residents had hired their own attorney, to help bring the issue to a resolution. He discussed the goal to remove the Village's involvement in that area: The motion passed t5-01. with the roll call vote as follows: Assistant Mayor Blachar yest, Councilwoman Cohen yes; Councilman Packer yes; Councilman Sanzyes; Mayor Rosenfield yes; thus becoming Resolution No. 2014-856. Mr. Weiss discussed the possible necessity of a majority plus one vote, at the second budget hearing. R7C: The following Resolution title was read by Mrs. Horvath: A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE AND RECYCLABLE MATERIALS IN BAL HARBOUR VILLAGE, FLORIDA; ESTABLISHING THE RATE OF ASSESSMENT; IMPOSING SOLID WASTE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY LOCATED WITHIN BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE ASSESSMENT ROLL; CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. Public Hearing Bal Harbour Village First Budget Hearing Minutes 09/11/2014 A motion was offered by Assistant Mayor Blachar and seconded by Councilman Packer to approve the Resolution. Mayor Rosenfield opened the public hearing. There being no comments, Mayor Rosenfield closed the public hearing. Mr. Gonzalez explained the Resolution, which provided for the same solid waste/recycling rates as the current year. R7D: The following Resolution title was read by Mrs. Horvath: A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE PROVISION OF SECURITY AND LANDSCAPE SERVICES, FACILITIES AND PROGRAMS IN THE GATED RESIDENTIAL SECTION OF BALHARBOUR VILLAGE, FLORIDA; ESTABLISHING THE RATE OF ASSESSMENT; IMPOSING SECURITY AND LANDSCAPE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY LOCATED WITHIN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE ASSESSMENT ROLL; CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. Public Hearing A motion was offered by Assistant Mavor Blachar and seconded by Councilwoman Cohen to approve the Resolution. Mr. Gonzalez explained the Resolution, which provided a reduced security/landscape assessment, based on the Gated Residential Section Advisory Committee's recommendation. Mayor Rosenfield opened the public hearing. There being no comments, Mayor Rosenfield closed the public hearing. The motion passed (5-0), with the roll call vote as follows: Assistant Mayor Blachar yes; Councilwoman Cohen yes; Councilman Packeryes; Councilman Sanz yes; Mayor Rosenfield yes; thus becoming Resolution No. 2014-858. R7E: The following Resolution title was read by Mrs. Horvath: A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, ESTABLISHING SANITARY SEWER AND WATER RATES FOR THE 2014/2015 FISCAL YEAR; ESTABLISHING AN EFFECTIVE DATE. Public Hearing Mr. Gonzalez explained the Resolution, which provided for increased sanitary sewer and water rates, based on the cost of the service from the County, as well as moving utility function expenses from the General Fund to the Utility Fund, Bal Harbour Village First Budget Hearing Minutes 09/11/2014 4 A motion was offered by Assistant Mayor Blachar and seconded by Councilman Packer to approve the Resolution. Mayor Rosenfield opened the public hearing. There being no comments, Mayor Rosenfield closed the public hearing: The motion passed (5-0), with the roll call vote as follows: Assistant Mayor Blachar yes; Councilwoman Cohen yes; Councilman Packerves; Councilman Sanz yes; Mayor Rosenfield yes; thus becoming Resolution No. 2014-859. R7F: The following Resolution title was read by Mrs. Horvath: A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, ADOPTING A CONSOLIDATED SCHEDULE OF FEES IMPOSED BY THE VILLAGE FOR THE PROVISION OF SERVICES; PROVIDING FOR CONFLICT; PROVIDING FOR. IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. Public Hearing A motion was offered by Assistant Mayor Blachar and seconded by Councilman Packer to approve the Resolution. Mr. Gonzalez explained the Resolution, which didn't provide for any new fees, but solely grouped the fees together in one place. Mayor Rosenfield opened the public hearing. There being no comments, Mayor Rosenfield closed the public hearing. R5 — Ordinances/Public Hearings R5A:`The following Ordinance title was read by Mrs. Horvath: AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDAAMENDINGARTICLE II "LOCAL BUSINESS TAX" OF CHAPTER 9 "BUSINESS REGULATIONS AND BUSINESS TAX" OF THE BAL HARBOUR VILLAGE CODE OF ORDINANCES, PROVIDING FOR AN INCREASE IN CERTAIN BUSINESS TAXES; PROVIDING FOR SEVERABILITY PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. First Reading/Public Hearing A motion was offered by Assistant Mayor Blachar and seconded by Councilman Packer to approve the Ordinance. Mr. Gonzalez explained the Ordinance, which provided for a five percent increase in business tax receipt fees.
