SPECIAL COMMISSION MEETING
Friday,August 24, 2018
1:00 P.M.

1. CALL TO ORDER:
Mayor Myra L. Taylor called the meeting to order at 1:00 p.m. p.m. on Friday, August 24, 2018
in the Auditorium at Sherbondy Village, 215 President Barack Obama (Perviz) Avenue, Opa-
locka, Florida.
2. ROLL CALL:
The following members of the City Commission were present: Mayor Myra L. Taylor, Vice
Mayor Joseph L. Kelley, Commissioner Timothy Holmes, Commissioner John Riley and
Commissioner Matthew Pigatt. Also in attendance were: Acting City Manager Newall
Daughtrey, City Attorney Vincent Brown, and City Clerk Joanna Flores.
3. INVOCATION:
The invocation was delivered by Mayor Myra L. Taylor.
4. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was recited in unison.
5. PUBLIC INPUT:

Dorothy Johnson, 13724 NW 24th Place, Opa-locka, FL, said she will be filing a lawsuit with the
City, but declined to go into detail. She said the budget is the way it is because of all of the
lawsuits and she will see them in court.
Alvin Burke, 1240 Jann Avenue, Opa-locka, FL, said he cannot believe in the middle of the
budget and the five year plan, the commission is discussing getting rid of the manager; it has
only been four months. The commission allowed previous managers to come in and make a mess
of the City, but are now trying to get rid of the current one quickly. They should let the manager
do his job, especially when they only have two months left in office. He asked the commission to
leave Mr. Daughtrey there and let the new commission deal with him.
Brian Dennis, 821 NW 24th Street, Miami, FL said that's funny that he received a call on
yesterday from Bishop Taylor as though he does not know what is going on in the City.
Everyone has fallen off of the tree of Dante Starks. He went on to mention things that are

happening in the City and referred to Commissioner Holmes, Vice Mayor Kelley and
Commissioner Pigatt as the holy trinity who are going to continue cleaning up the City.
Natasha Ervin, 670 Dunad Avenue, Opa-locka, FL, said that Rome was not built in a day. She
does not understand why the commission is trying to get rid of the manager instead of allowing
him to do his job; it is not fair to the residents and the taxpayers.
6. RESOLUTIONS:
a) A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-
LOCKA, FLORIDA, TERMINATING ACTING CITY MANAGER NEWALL J. DAUGHTREY;
PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE
DATE.Sponsored by Commissioner Riley
The above resolution was read by Attorney Brown.
It was moved by Commissioner Riley, seconded by Commissioner Holmes for discussion.
Commissioner Riley said he brought the resolution because there are a number of things that concern him.
There are monies owed to the City and because the City is not doing what it is supposed to do, the funds
cannot be released. His first time hearing about 2015 — 2016 audit this was morning. There is one point
six million dollars ($1,600,000.00) owed to the City by the state and the funds are still pending a
completed audit. He also has not seen where anyone has reached out to JLAC requesting an extension so
the funds can be released. He questioned the departments having to now pay rent when the county has
moved in on the first floor and he has not seen a leasing agreement. The tipping fee has not been paid and
there is trash and garbage everywhere. There are just too many things not being address.
Vice Mayor Kelley said that everyone is playing games and it is sad. Anyone can run down a list on
anybody so that is neither here nor there. Nobody is perfect including Mr. Daughtrey, so he does not
understand why they are here today; this action is premature.
Commissioner Pigatt said that when he heard this special meeting was being called, he was in shock. Mr.
Daughtrey has helped with several projects in the short time he was hired. He is doing his job and he
should be allowed to continue doing so. They are currently in the process of completing the audits and his
colleague is making it seem as though it is something else going on.
Vice Mayor Kelley said that he would like for the manager to have an opportunity to speak if he so
chooses.
Acting City Manager Daughtrey said that he is here working on behalf of the City. He along with staff has
been diligently working to resolve the many issues plaguing the City. He has been calling out some of
these issues since the 70's and the breakdown has come to pass; the City confronted with it today. Had he
known the true condition of the City, he would not have applied. He stated that the budget was 100%
balanced and he had not fired any of the staff. He said that he hopes the commission will allow him to
continue to do his job, but if the commission decides differently, he will be back on Monday to explain
himself to the oversight board.
Commissioner Holmes told the manager that when he was hired, he did not support him at the time. He
thought because he had been here several times before, he will be able to get more things done. He will
hold off today, but if he does not see progress by the end of September, he might bring an item himself to
terminate the manager.
There being no further discussion, the motion on the resolution failed by a 3-2 vote.

LOCKA, FLORIDA, APPOINTING AN ACTING CITY MANAGER DUE TO THE
DEPARTURE OF NEWALL J. DAUGHTREY AS ACTING CITY MANAGER; PROVIDING
FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. Sponsored
by Commissioner Riley
This item was deemed to be moot from the failure of item 6(a).
c) A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-
LOCKA, FLORIDA, DELETING NEWLL J. DAUGHTREY AS SIGNATORY AND ADDING
(ACTING CITY MANAGER) AND BRYAN HAMILTON (FINANCE
DIRECTOR) AS SIGNATORIES FOR ALL CITY FINANCIAL INSTITUTION ACCOUNTS;
PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE
DATE.Sponsored by Commissioner Riley
This item was deemed to be moot from the failure of item 6(a).
d) A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-
LOCKA, FLORIDA, AUTHORIZING THE CITY ATTORONEY TO COMMENCE
LITIGATION TO DETERMINE WHETHER A CANDIDATE SEEKING RE-ELECTION IS
PERMANENTLY PROHIBITED FROM SERVING AS MAYOR OR COMMISSIONER AFTER
SERVING EIGHT (8) CONSECUTIVE YEARS ON THE COMMISSION OR IS ONLY
REQUIRED TO REFRAIN FROM SERVING AS EITHER MAYOR OR COMMISSIONER FOR
THE FOUR YEARS IMMEDIATELY FOLLOWING THE EIGHT (8) CONSECUTIVE YEARS;
PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE
DATE.Sponsored by City Attorney/City Clerk
The above resolution was read by Attorney Brown.
It was moved by Commissioner Pigatt, seconded by Vice Mayor Kelley for discussion.
Vice Mayor Kelley asked the attorney why this item was on the agenda and if the City has been sued or
forced into litigation.
City Attorney Brown said he provided litigation where a similar step was taken with the City of
Jacksonville who took a proactive step in resolving the issue.
Vice Mayor Kelley said that he never liked open ended litigation and offered to amend the item include a
cap on any litigation.
There being no further discussion, the motion on the resolution passed by a 3-2 vote.
