HomeMy Public PortalAbout2013.029 (02-19-13)RESOLUTION NO. 2013.029 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING AD HOC COMMITTEES TO ADVISE ON THE CURRENT SOLID WASTE SERVICES AGREEMENT AND NEXT STEPS IN CONSIDERING A NEW OR EXTENDED AGREEMENT WHEREAS, the City of Lynwood entered into an Agreement with Consolidated Disposal Service, ' LLC (" CDS ") for Collection of Municipal Solid Waste ( "Waste Agreement ") on September 2, 2003, which expires on October 31, 2013 for the collection of all solid waste in the City; and WHEREAS, there is an option to extend the Waste Agreement for consecutive 5 year terms, based upon mutual agreement of the parties; and WHEREAS, the services of CDS are being evaluated at this time to ascertain CDS's compliance with the terms of the Waste Agreement; and WHEREAS, the evaluation of CDS's services and options for either extending the Waste Agreement or seeking other providers' proposals requires focused attention and pre - planning to present appropriate recommendations to the Council; and WHEREAS, establishing ad hoc committees of less than a quorum of the Council and no other members to evaluate these options and make appropriate recommendations to the Council on these issues is a reasonable approach. NOW, THEREFORE, THE LYNWOOD CITY COUNCIL DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: Section 1. The City Council hereby establishes an Ad Hoc Waste Services Audit Committee comprised of the two Council Members listed below to evaluate CDS's compliance with the Waste'Agreement: 1. Mayor Salvador Alatorre 2. Council Member Aide Castro Section 2. The City Council hereby establishes an Ad Hoc Waste Services Contract Committee comprised of the two Council Members listed below to evaluate options for either extending the Waste Agreement or seeking other providers' proposals in anticipation of the October, 31, 2013 termination of the current Waste Agreement: 1. Mayor Salvador Alatorre, with Mayor Pro Tern Ramon Rodriguez as an alternate should the Mayor be unable to serve. 2. Council Member Jim Morton Section 3. The above Ad Hoc Waste Services Audit and Ad Hoc Waste Services Contract Committees shall be temporary in nature and automatically terminate following the resolution of the Waste Agreement audit and City Council's approval of a new solid waste services agreement, respectively. Section 4. This Resolution is to be given effect upon its adoption by the City Council of the City of Lynwood and execution of the same by the appropriate parties. Section 5. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED and ADOPTED this 19 day of February, 2013.
