HomeMy Public PortalAbout037-2012 - General - uniform credit card proceCOMMON COUNCIL CITY OF RICHMOND, INDIANA ORDINANCE 37-2012 A GENERAL ORDINANCE AUTHORIZING ACCEPTANCE OF CREDIT CARD OR BANK CARD PAYMENTS PURSUANT TO INDIANA CODE 36-1-8 WHEREAS, Indiana Code (IC) 36-1-8-11 generally allows the fiscal body of a political subdivision to authorize the municipal unit to accept payments by cash, check, bank draft, money order, bank card or credit card, electronic funds transfer, or any other financial instrument authorized by the fiscal body; and WHEREAS, IC 36-1-8-11(e) specifically allows a fiscal body to authorize the acceptance of payments with bank cards and credit cards under the procedures set forth in Section 11 of that Code, provided that the procedures authorized by the fiscal body for a particular type of payment must be uniformly applied to all payments of the same type; and WHEREAS, In accordance with IC 36-1-8-11(g), if there is a service charge for the use of bank card or a credit card, the City may be authorized by the fiscal body to pay that applicable service charge; and WHEREAS, It is in the best interest of the City of Richmond and its citizens that the Common Council of the City of Richmond as the fiscal body of the City authorize the acceptance of payments under Section 11 of IC 36-1-8 and authorize the City to pay any bank card or credit card service charges applied necessary to implement the uniform credit card procedures for the City of Richmond. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, that the Common Council, as the fiscal body of the City of Richmond, authorizes the City executive administration to accept bank card or credit card payments by the methods set forth in IC 36-1-8-11. NOW, THEREFORE, BE IT FURTHER ORDAINED by the Common Council of the City of Richmond, Indiana, that the Common Council as the fiscal body of the City of Richmond authorizes the City executive administration to pay any applicable bank card or credit card service charges in accordance with IC 36-1-8-1l(g). NOW, THEREFORE, BE IT FURTHER ORDAINED by the Common Council of the City of Richmond, Indiana, that the payment of any applicable bank card or credit card service charges by the City executive administration as authorized above must be uniformly applied to all payments of the same type as set forth in IC 36-1-8-11(e). NOW, THEREFORE, BE IT FURTHER ORDAINED by the Common Council of the City of Richmond, Indiana, that applicable service charges for online bank card or credit card transactions must be uniform and that any contracts for online merchant processors that are entered into by the City, its departments, or districts must be approved by the Board of Works, Parks Board, Sanitary District and/or Stormwater Board, or Airport Board, as applicable. NOW, THEREFORE, BE IT FURTHER ORDAINED by the Common Council of the City of Richmond, Indiana, that this Ordinance will not apply to contracts that are already in effect on the passage date of this Ordinance, but all future contracts containing transaction fee provisions must be in accordance with this Ordinance so that the City can transition into the proper application of uniform transaction fees.
