HomeMy Public PortalAbout22-9954 - Terminating City Manager John PateSponsored by: Vice Mayor John Taylor RESOLUTION NO. 22-9954 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, TERMINATING CITY MANAGER JOHN E. PATE; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on or about August 23, 2019, the City Commission appointed John E. Pate as the City Manager; and WHEREAS, the City finds that it is in the best interest of the City to terminate the City Manager without cause; and WHEREAS, the City desires to provide reasonable notice to the City Manager of the termination of not less than ten (10) days, as provided in the September 25, 2019 contract between John E. Pate and the City of Opa-Locka; and WHEREAS, the City Commission desires to terminate employment of the City Manager effective 12:00 AM on February 1, 2022; and WHEREAS, the City Commission desires to place the City Manager on administrative leave from the date of passage of this resolution up until 12:00 AM on February 1, 2022; and WHEREAS, for purposes of this resolution, "administrative leave" shall be defined as leave with pay where the City Manager does not have any obligation to exercise any duty or responsibilities on behalf of the City of Opa-Locka; and WHEREAS, the City Commission finds that this resolution shall serve as written notice to the City Manager of termination. The City Clerk is hereby authorized to send any additional notices as may be required. Resolution No. 22-9954 NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. Recitals. The recitals to the preamble herein are incorporated by reference. Section 2. Termination of City Manager. The City Commission hereby terminates City Manager, John E. Pate, without cause, and with an effective date of 12:00 AM February 1, 2022. Section 3. Scrivener's Errors. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Attorney or designee, without need of public hearing by filing a corrected copy of the same with the City Clerk. Section 4. Effective Date. This Resolution shall take effect immediately.
