Opa-locka Municipal Complex 780 Fisherman Street, 3rd Floor Opa-locka, FL 33054 1. CALL TO ORDER: Mayor Myra L. Taylor called the meeting to order at 5:01 p.m. on Wednesday, September 26, 2018 in the Auditorium at Sherbondy Village, 215 President Barack Obama (Perviz) Avenue, Opa-locka, Florida. 2. ROLL CALL: The following members of the City Commission were present: Mayor Myra L. Taylor, Vice Mayor Joseph L. Kelley, Commissioner Timothy Holmes and Commissioner Matthew Pigatt. Also in attendance were: Acting City Manager Newall Daughtrey, City Attorney Vince Brown, and City Clerk Joanna Flores. Commissioner John Riley arrived at 5:23 p.m. 3. INVOCATION: The invocation was delivered by Mayor Myra L. Taylor. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was recited in unison. 5. PUBLIC INPUT: Agenda Items Only This portion of the hearing was read in verbatim as follows: Finance Director Bryan Hamilton: The City Commission of the City of Opa-locka hereby adopts and establishes the millage rate of the City of Opa-locka for the fiscal year 2018 — 2019, commencing October 1, 2018 through September 30, 2019 at 9.800 mills which is nine dollars and eighty cents ($9.80) per thousand ($1,000.00) of assessed property values within the City of Opa-locka. This represents a twelve point nine percent (12.9%) increase of the rollback rate which is 8.6755 mills which is eight dollars and sixty eight cent ($8.68) per thousand dollars ($1,000.00) of assessed property value within the City of Opa-locka. 6. SECOND READING ORDINANCES/PUBLIC HEARINGS: a) AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, ADOPTING A FINAL MILLAGE RATE PURSUANT TO SECTION 200.065, FLORIDA STATUTES, FOR FISCAL YEAR 2018-2019, COMMENCING OCTOBER 1, 2018 THROUGH SEPTEMBER 30, 2019; SETTING FORTH PUBLIC HEARING DATES; Second Budget Hearing Minutes—9/26/2018 1 PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR REPEAL OF ALL PRIOR ODINANCES IN CONFLICT; PROVIDING FOR AN EFFECTIVE DATE. Sponsored by City Manager The above ordinance was read by Attorney Brown. Mayor Taylor opened the floor for a public hearing. Dorothy Johnson, 13724 NW 24th Place, Opa-locka, FL, said she did not receive a copy of the budget and wants to know what the actual millage rate is. Acting City Manager Daughtrey said the millage rate is set at 9.8. Ms. Johnson said she was told that there would be decreases with the police department and asked where the reductions came from. Acting City Manager Daughtrey said that the police budget actually increased by forty thousand dollars since the City received funding for two resources officers to patrol the schools. There being no further persons to speak on the public hearing, the public hearing was closed. It was moved by Vice Mayor Kelley, seconded by Mayor Taylor for discussion. Commissioner Pigatt said that lowering the millage rate has caused the budget to be lowered and there are things that need to be done around the City. He supported the 10.00 mills that the manager had suggested and cannot support the 9.8 at this time. Mayor Taylor asked the attorney what will happen if the millage rate is not adopted. City Attorney Brown said that every fifteen days the City will have to adopt a resolution to operate under the previous budget year and millage rate of 8.9 and this will be done until an official budget and millage rate is adopted. City Attorney Brown said the staff told him that the 9.8 represents more than 110% of the rollback rate and therefore needs a unanimous vote. There being no further discussion, the motion on the resolution failed by a 3-2 vote. City Attorney Brown said he is now being told by staff that the item needs a four fifths vote. Vice Mayor Kelley asked for a five minute recess to allow the attorney to ensure the information is correct. Second Budget Hearing Minutes—9/26/2018 2 City Attorney Brown said if the motion to reconsider is voted on by four persons on the dais, then they need not recess. A motion was made for reconsideration of the item. It was moved by Commissioner Pigatt, seconded by Commissioner Riley to reconsider the item. There being no further discussion, the motion passed by a 5-0 vote. Vice Mayor Kelley Yes Commissioner Pigatt Yes Commissioner Riley No Commissioner Holmes Yes Mayor Taylor Yes b) AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, APPROVING AND ADOPTING THE CITY'S GENERAL FUND BUDGET FOR THE FISCAL YEAR 2018-2019, COMMENCING OCTOBER 1, 2018 THROUGH SEPTEMBER 30, 2019; PROVIDING FOR THE EXPENDITURE OF FUNDS ESTABLISHED BY THE BUDGET; AUTHORIZING THE CITY MANAGER TO TAKE CERTAIN ACTIONS; PROVIDING FOR APPROPRIATION OF ALL BUDGET EXPENDITURES; PROVIDING FOR FEES CONSISTENT WITH APPROPRIATION AND AMENDMENT; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. Sponsored by City Manager The above ordinance was read by Attorney Brown. Mayor Taylor opened the floor for a public hearing. Dorothy Johnson, 13724 NW 22"d Place, Opa-locka, FL, said that this is all confusing and asked that the commission be clear on what they are saying. There being no further persons to speak on the public hearing, the public hearing was closed. It was moved by Vice Mayor Kelley, seconded by Commissioner Holmes for discussion. Finance Director Bryan Hamilton said that a schedule was provided that addresses all of the budget adjustments. Commissioner Pigatt said he is confused. Friday he received a six page budget and today he received over one hundred pages of a budget document with changes and he has not had sufficient time to review anything in this short time. This is a multi-million dollar decision and the information needs to be correct. Second Budget Hearing Minutes—9/26/2018 3 Commissioner Riley said the audit needs to be done so that the funds that are being held can be released to the City. Commissioner Pigatt said the commission just received this information a few hours ago and he is uncomfortable voting on it at this time; he does not support it unless it can be deferred. Commissioner Holmes asked the manager if the commission pulls things out of the budget tonight then will it be passed tonight. Acting City Manager Daughtrey said, "No." City Attorney Brown asked the manager if the budget is balanced because the red light camera program is still included in it. Acting City Manager Daughtrey said the motion can be amended to delete the revenue and the expenses. Mayor Taylor asked the manager why this was not done prior and the adjustments made before bringing it tonight. She does not understand why the red light camera is still in the budget. Vice Mayor Kelley said he said this from the start. He asked the attorney if it can be taken out today. City Attorney Brown said, "Yes." A motion was made to amend the budget by removing the red camera light revenue and expenses. It was moved by Vice Mayor Kelley, seconded by Commissioner Holmes to pass the motion. There being no further discussion, the motion on the amendment passed by a 5-0 vote. Mayor Taylor opened the floor for a public hearing. Dorothy Johnson, 13724 NW 22nd Place, Opa-locka, FL, said she has never seen anything like this before and the commission knows better; this is wrong. The commission needs to be held accountable to the taxpayers. There being no further persons to speak on the public hearing, the public hearing was closed. It was moved by Vice Mayor Kelley, seconded by Commissioner Holmes for discussion. Commissioner Pigatt restated that the information was recently received and he does not believe everyone has gone through it with a fine tooth comb. He is uncomfortable with it and does not support it at this time. There being no further discussion, the motion on the ordinance passed by a 3-2 vote. Acting City Manager Daughtrey apologized to the commission and stated that one of the commissioners requested the budget be put in the old format at the first budget hearing and that is why it was presented late. 7.
