AUTHORIZING ADMINISTRATIVE HEARING RI~
WH~I/EAS, the New Jersey Department of Environmental Protection ("NODEP")
has imposed upon the Borough of Carteret (the "Borough") certain fines
pursuant to an Administrative Order and Notice of Civil Administrative
Penalty Assessment dated march 29, 1999 in connection with certain sewer
system issues (the "Order"); and
Wlt~llEAS, the Borough has been diligently attempting to correct sewer
system deficiencies after years of neglect at great expense to the people
f Carteret; and
k11EREAS, the Borough believes that the action of the NJDEP is a baseless
attempt to cover its past failings in connection with the sewer deficiencies;
NOW, THI~J~FORE, BE IT RESOLVED by the Mayor and Council of the. Borough of
Carteret that the Borough Engineer and Borough Attorney are hereby directed
to request and prosecute an appeal of the Order.
BE IT FURIlqER~LVED that the Mayor and Municipal Clerk are hereby
authorized to execute on behalf of the Borough such documents as are
~ssary to accomplish the intended purpose of this resolution.

and certified as a true copy of the
original on April 9, 1999.
