THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. 678 AN ORDINANCE CHANGING THE ZONING CLASSIFICATION FROM AG AGRICULTURAL TO R-5 RESIDENTIAL AND.C-1 NEIGHBORHOOD COMMERCIAL ON CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS. WHEREAS, the legal description of the tract of land is as follows: Legal Description Zone.Change Description,from AG to R-5 The S1/2 of the 5E1/4 of Sec.17,T265,R2E of the 6th P.M.,Sedgwick County,Kansas,EXCEPT that part of the S1/2 of the SE1/4 of Sec.17, T26S,R2E of the 6th P.M.,Sedgwick County,Kansas,being more particularly described as beginning at the southeast corner of said 5E1/4; thence S89°08'11"W along the south line of said SE1/4,822.75 feet; thence N26°21'07"E,500.58 feet;thence N16'04'04"E,194.90 feet; thence N46°50'01"E,410.13 feet;thence N08°41'19"E,426.85 feet to the north line of said 51/2;thence N89'17'42"E along said north line,162.51 feet to the northeast corner of said S1/2;thence 500'52'48"E along the east line of said SE1/4,1328.14 feet to the place of beginning. Zone Change Area:81.09 Acres WHEREAS, Proper legal notices were sent and public hearing was convened on the matter of rezoning the afore described tract on November 8, 2021, by the Planning Commission for the City of Bel Aire, Kansas in conformance with the requirements set forth in Article Five of the Zoning Regulations of the City of Bel Aire, Kansas; E WHEREAS, Following the public hearing, the Planning Commission found that the evidence does support this requested zone change based upon the guidelines set forth in Article 5.02 of the Zoning Regulations of the City of Bel Aire, Kansas; WHEREAS, The Planning Commission for the City of Bel Aire, Kansas recommends approval of the application by the property owner to change the tract of land, as described above, from AG AGRICULTURAL TO R-5 RESIDENTIAL AND C-1 NEIGHBORHOOD COMMERCIAL WHEREAS, the Governing Body has considered the factors set forth in Article 5.01 and Article 5.02 of the Zoning Regulations of the City of Bel Aire, Kansas in relation to this tract; BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: SECTION 1. The Governing Body supports the recommendation of the Bel Aire Planning Commission, and approves the rezoning of the tract of land from AG AGRICULTURAL TO. R-5 RESIDENTIAL AND C-1 NEIGHBORHOOD COMMERCIAL; SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. This Ordinance shall take effect and be in force from and after its publication in the official City newspaper. Passed by the City Council this 7th day of December, 2021.
