AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 42
RELATING TO BUILDINGS AND BUILDING REGULATIONS AT ARTICLE II
CONSTRUCTION STANDARDS BY RESCINDING SECTION 42 -29 APPROVAL
OF SUPPLIER OF WATER PRIOR TO PERMIT ISSUANCE AND RENUMBERING
SECTIONS 42 -30 AND 42 -31; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Delray Beach supplies water to the Town of Gulf Stream;
and,
WHEREAS, the City of Delray Beach no longer requires that building plans be
approved by them prior to issuance of a building permit if a water connection is a part of
the construction;
NOW, THEREFORE BE IT ORDAINED BY THE TOWN COMMISSION OF
THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS
FOLLOWS:
Section 1. Section 42 -29 of the Town Code of Ordinances entitled "Approval of
supplier of water prior to permit issuance" is hereby rescinded.
Section 2. Section 42 -30 of the Town Code of Ordinances entitled "Constriction
abandonment" is hereby renumbered as Section 42 -29.
Section 3. Section 42 -31 of the Town Code of Ordinances entitled "Driveway
permits" is hereby renumbered as Section 42 -30.
Section 4. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications and to this end the
provisions of this Ordinance are hereby declared severable.
Section 5. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which
Conflict with this or any part of this Ordinance are hereby repealed.
Section 6. Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Gulf Stream.
Section 7. Effective Date.
This Ordinance shall take effect immediately upon its passage on second reading
and adoption.
PASSED AND ADOPTED in a regular, adjourned session on first reading
