PROCEEDINGS OF THE COMMON COUNCIL OF
THE CITY OF RICHMOND, INDIANA, MONDAY, OCTOBER 21, 2002
The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m., Monday,
October 21, 2002, in the Council Chambers in said City. President Bruce Wissel presided with the
following Councilmembers present: Howard "Jack" Elstro, Etta J. Lundy, Karl Sharp, Bing Welch, Larry
Parker, Paul Combs, Phil Dickman and Sarah "Sally" Hutton. The following business was conducted:

President Wissel asked the students in the audience to come forward and introduce themselves.
APPROVAL OF MINUTES
Minutes of the October 7, 2002 meeting were approved on a motion by Councilmember Parker, second by
Councilmember Welch and the motion was carried on a voice vote

Mayor Shelley Miller had no comments.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
President Wissel said the minutes of the meetings of September 18 and 26 b and October 3, 2002 were in
their packets.
REPORTS FROM DEPARTMENT HEADS
City Controller John Kenny explained that his responsibilities include managing and supervising the
Finance Department. He said he is also responsible for the supervision of the Purchasing Department, the
Information T echnology D epartment and the G eographical Information S ystems area. He o utlined three
areas, separating them into categories of immediate past, current and vision for the future.
Councilmember Parker asked if the phone system falls under Kenny's responsibilities and Kenny said it
does not, but he would check with the Mayor and the Purchasing Director. Councilmember Parker's
question was whether or not more lines need to be added to make the offices in the City Building more
accessible by phone. The Mayor said that is something that can be looked into.
Stanton Lambert, superintendent of Parks and Recreation, spelled out the responsibilities of his department
which included taking care of the City Building grounds as well as the inside of the building, snow removal
in many areas and boarding up unsafe houses, just to name a few. Currently, he said, one of the goals is the
updating of the Master Plan, continuing to develop the Gorge Park and determining the status of the Gas
and Starr buildings. Among the goals, Lambert said, are the creation of a Park Foundation, continuing to
implement the partnership program for the kids, the renovation of the Freeman Park Soccer Field and
putting in a new water line system in Glen Miller Park.

ORDINANCE NO. 83 — 2002
The Clerk read Ordinance No. 83 — 2002 — A GENERAL ORDINANCE ADDING CHAPTER 32.80 TO
THE CITY OF RICHOND CODE REGARDING THE CREATION OF A CITY EMPLOYEE
GRIEVANCE COMMISSION
City Attorney Bob Bever asked that this ordinance be held on first reading, explaining that the arbitration
panel referred to in this ordinance will be limited just to this contract and will not apply to all other city
employees who are not part of the AFSCME contract. Therefore, he said, this will no longer need to be part
of the City Code and as soon as the contract is formally adopted by the City and AFSCME he anticipates
striking this ordinance. However, he said, just as a safe measure he would rather not strike it until this
coming Thursday when the contract is expected to be signed.
ORDINANCE NO. 85 — 2002
The Clerk read Ordinance No. 85 — 2002 — AN APPROPRIATION ORDINANCE AMENDING THE
2002 BUDGET
Explaining this ordinance was Greg Stiens, Assistant City Engineer, who asked for a transfer of funds
within the Off Street Parking Fund. It includes the deletion of $5,325 from Other Contractual Service and
adding $5,000 to Part Time Temporary Salaries, $240 to Social Security, $60 to Medicare and $25 to
P.E.R.F. He said that earlier in the year it was decided that the services of the two attendants who worked at
the 7 h Street Parking Lot were no longer needed, and this transfer is to be used to cover the salaries of the
two remaining part time attendants.
Councilmember Welch moved to suspend the rules and advance Ordinance No. 85 — 2002 to second
reading and read by title only, second by Councilmember Sharp and the motion was carried on a voice
vote.

or against the ordinance, Councilmember Hutton moved for engrossment, second by Councilmember

reading and read by title only, second by Councilmember Elstro and the motion was carried on a voice
vote.

ORDINANCE NO. 86 — 2002
The Clerk read Ordinance No. 86 — 2002 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF
RICHMOND TO RECEIVE CONTRIBUTIONS
Stiens also explained this ordinance, saying that at the September meeting of the Board of Aviation
Commissioners they approved the second annual Fun in the Sun Hot Air Balloon Festival to be held at the
Richmond Municipal Airport from August 22 through the 20' in 2003. He said he is requesting approval
from Council to receive contributions to help fund the event, adding that the first balloon festival held this
past August was extremely successful and they have nearly $16,000 already to go toward the 2003 event.
Councilmember Welch moved to suspend the rules and advance Ordinance No. 86 — 2002 to second
reading and read by title only, second by Councilmember Dickman and the motion was carried on a voice
vote.

ORDINANCE NO. 87 — 2002
The Clerk read Ordinance No. 87 — 2002 — AN APPROPRIATION ORDINANCE AMENDING THE
2002 BUDGET
Mayor Miller explained that this ordinance also deals with a transfer of funds which includes deleting $700
from Travel, and adding $500 to Copier Charges and $200 to Office Supplies.
Councilmember Welch moved to suspend the rules and advance Ordinance No. 87— 2002 to second reading
and read by title only, second by Councilmember Sharp and the motion was carried on a voice vote.

ORDINANCES ON SECOND READING AND ENGROSSMENT
ORDINANCE NO. 78 — 2002
The Clerk read Ordinance No. 78 — 2002 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF
RICHMOND TO RECEIVE A DONATION
Speaking in favor of the ordinance was Major Randy Kolentus of the Richmond Police Department who is
also Commander of the Swat Team. He said First Bank Richmond is donating $500 to assist with expenses
for the Swat Team.
President Wissel declared Ordinance No. 78 — 2002 on public hearing. There being no comments either for
or against the ordinance, Councilmember Hutton moved for engrossment, second by Councilmember
Dickman and the motion was carried on a voice vote.
Councihnember Lundy moved to suspend the rules and advance Ordinance No. 78 — 2002 to third and final
reading and read by title only, second by Councilmember Elstro and the motion was carried on a voice
vote.

ORDINANCE NO.79 — 2002
The Clerk read Ordinance No. 79 — 2002 — A SPECIAL ORDINANCE AUTHORIZING THE
APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR
DEDUCTIONS UNDER IC. 6-1.1-12.1
President Wissel explained that this is a request by Holland Colors for new manufacturing equipment. He
added that after a discussion with the company's production manager, he learned that the computers will be
used for both office and production. He said he asked that they be separated because only those used for the
production machines can be abated and he is waiting on that list. He asked that this ordinance be held on
second reading.
ORDINANCE NO. 81— 2002

RICHMOND CODE REGARDING OPEN ALCOHOLIC BEVERAGE CONTAINERS
Councilmember Hutton reported that at last week's Neighborhood Services Clearinghouse Board meeting,
Police Chief Greg Pipes answered questions concerning this ordinance and as a result of that discussion it
was agreed that this ordinance could be stricken. Councilmember Hutton so moved, second by
Councilmember Welch and the motion was carried on a voice vote.

ORDINANCE NO. 82 — 2002
The Clerk read Ordinance No. 82 — 2002 - A SPECIAL ORDINANCE AUTHORIZING THE
APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR
DEDUCTIONS UNDER IC. 6-1.1-12.1
Councilmember Elstro explained that this is a request by Hoosier Container Inc. and he had talked with
Eric Barnes, a company representative, and learned the estimated value of the 7,000-square foot addition to
the facility located at 1001 Indiana Avenue would be $500,000. He recommended that the request be
approved.
President Wissel declared Ordinance No. 82 — 2002 on public hearing. There being no comments either for
or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember
Dickman and the motion was carried on a voice vote.
Councilmember Lundy moved to suspend the rules and advance Ordinance No. 82 — 2002 to third and final
reading and read by title only, second by Councilmember Welch and the motion was carried on a voice
vote.
