HomeMy Public PortalAbout03-18-2002PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, MARCH 18, 2002 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m., Monday, March 18, 2002, in the Council Chambers in said City. President Bruce Wissel presided with the following Councilmembers present: Howard "Jack" Elstro, Etta J. Lundy, Karl Sharp, Bing Welch, Larry Parker, Paul Combs, Phil Dickman and Sarah "Sally" Hutton. The following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER PARKER ROLL CALL Nine present. APPROVAL OF MINUTES Minutes of the March 4, 2002 meeting were approved on a motion by Councilmember Welch, second by Councilmember Sharp and carried on voice vote. PRESENTATION OF REMONSTRANCES, PETITIONS, MEMORIALS, INTRODUCTIONS, MOTIONS AND PUBLIC COMMENTS Renee Oldham, representing the Urban Enterprise Association, gave Councilmembers an overview about what is being done and what plans are being made for the future. These included housing, economic development and communication. COMMUNICATION FROM THE MAYOR Mayor Shelley Miller stated that the Indiana Department of Commerce conducted a meeting at IU East last week to discuss programs available for ongoing projects within the community. She expressed her appreciation for the interest shown by the citizens of Richmond. Councilmember Sharp said he attended that meeting and commended Mayor Miller for her persistence in communicating the needs of the City. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY President Wissel said the minutes of the meeting of February 14, 21 and 28, 2002 were in their packets. REPORTS FROM DEPARTMENT HEADS REPORTS FROM STANDING COMMITTEES REPORTS FROM SPECIAL COMMITTEES Councilmember Sharp made a few comments about the Economic Development Corporation entertaining the delegation from Hellbron, Germany recently. REPORTS FROM ORGANIZATIONS MISCELLANEOUS BUSINESS Councilmember Combs had some comments about the City's dog ordinance and whether or not the dog has to be ' on a leash if it is on private property and also had a question about unlicensed vehicles. Councilmember Sharp also commented that Councilmembers had received an invitation for a press conference to kick off Child Abuse Prevention Month Wednesday, April 3 at 2 p.m. in the City Building. President Wissel said he had received a resignation from Mary Alexander from the Human Rights Commission. He added that an application had been received from Kathy Khamis to fill that vacancy which Councilmembers would discuss at the next meeting. ORDINANCES ON FIRST READING Councilmember Elstro moved to read Ordinances No. 21, 22, 23, and 25- 2002 by title only and Ordinance No. 20 — 2002 in its entirety, second by Councilmember Parker and the motion was carried on a voice vote. ORDINANCE NO.20 — 2002 The D eputy C lerk r ead Ordinance N o. 2 0 — 2 002 — A S PECIAL O RDINANCE AUTHORIZING T HE CITY OF RICHMOND TO RECEIVE A DONATION Common Council Minutes Cont'd March 18, 2002 Page 2 "WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and "WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. "NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond: "The donation of ten pediatric kits and training on the proper way to use the equipment contained in the kits to the Richmond Fire Department from the Eastern Gateway Kiwanis Club." Fire Chief Mike Allen stated that when the Eastern Gateway Club disbanded there were funds that were available for distribution and chose this project at a cost of $3,200. He said the purpose of the kits is to use in the care of infants and children. Councilmember Welch moved to suspend the rules and advance Ordinance No. 20 — 2002 to second reading and read by title only, second by Councilmember Dickman and the motion was carried on a voice vote. The Deputy Clerk read Ordinance No. 20 — 2002 on second reading. President Wissel declared Ordinance No. 20 — 2002 on public hearing. There being no comments either for or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Hutton and the motion was carried on a voice vote. Councilmember Lundy moved to suspend the rules and advance Ordinance No. 20 — 2002 to third and final reading and read by title only, second by Councilmember Elstro and the motion was carried on a voice vote. The Deputy Clerk read Ordinance No. 20 — 2002 on third reading. Ordinance No. 20 — 2002 was adopted on a unanimous roll call vote. ORDINANCE NO. 21— 2002 The Deputy Clerk read Ordinance No. 21 — 2002 — A SPECIAL ORDINANCE VACATING A PUBLIC PLACE President Wissel announced that this ordinance deals with a vacation of a public right of way for the construction of the new Wayne County jail would go to Planning to be heard at its March 28 meeting. ORDINANCE NO.22 — 2002 The Deputy Clerk read Ordinance No. 21 — 2002 — A SPECIAL ORDINANCE VACATING'A PUBLIC WAY President Wissel announced that this ordinance amends the zoning map for vacating North 6`h Street from Bridge Avenue to the North right of way line of the Norfolk & Western Railroad for the Richmond Baking Co. for the construction of the new facility and added that this would also go to Planning to be heard March 28. ORDINANCE NO.23 —'2002 The Deputy Clerk read Ordinance No. 23 — 2002 - A GENERAL ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 154 OF THE CITY OF RICHMOND CODE REGARDING ZONING MAPS President Wissel announced that this ordinance would go to Planning also to be heard March 28. ORDINANCE NO.25 — 2002 The D eputy C lerk r ead Ordinance N o. 2 5 — 2 002 — A S PECIAL O RDINANCE AUTHORIZING T HE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Councilmember Sharp stated that this ordinance deals with a request by Vandor Corp. and Focus One, LLC for a 10-year tax abatement for real estate estimated at $3,500,000. He said this ordinance would go to the Tax Abatement Committee for review and return to Council at its next meeting. D eputy C lerk r ead Ordinance N o. 9 3— 2 001— A S PECIAL O RDINANCE AUTHORIZING T HE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Councilmember Lundy moved to accept the amended ordinance as offered, second by Councilmember Elstro and the motion was carried on a voice vote. President Wissel declared Amended Ordinance No. 93 — 2002 on public hearing. There being no comments either for or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Sharp and the motion was carried on a voice vote. Councilmember Elstro moved to suspend the rules and advance Amended Ordinance No. 93 — 2002 to third and final reading and read by title only, second by Councilmember Welch and the motion was carried on a voice vote. The Deputy Clerk read Amended Ordinance No. 93 — 2002 on third reading. Amended Ordinance No. 93 — 2002 was adopted on a unanimous roll call vote. ORDINANCE NO. 12 — 2002 The Deputy Clerk read Ordinance No. 12 — 2002 — A SPECIAL ORDINANCE AMENDING THE REZONING AT 1900 EAST MAIN STREET, 15-19 NORTH 19TH STREET AND 16 NORTH 19TH STREET President Wissel stated that the Richmond Advisory Planning Commission conducted a public hearing February 28, 2002. He explained that that this petition requests a special use at 1900 East Main which is the location of the offices of Drs. Reising and Burkhart. He said the original special use for this site is requested to be amended to allow additional office space and a parking lot located on a lot across the street at North 19a' Street at the location of an abandoned house. He said the Planning Commission voted unanimously to recommend passage of this request. Attorney George Sowers stated that the two optometrists desire to approximately double the size of their office building, which has been an optometrist building since 1974 when Dr. Reising's father-in-law, Henry began his practice there. He added that it had been a former filling station. President Wissel declared Ordinance No. 12 — 2002 on public hearing. There being no comments either for or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Hutton and the motion was carried on a voice vote. Councilmember Welch moved to suspend the rules and advance Ordinance No. 12 — 2002 to third and final reading and read by title only, second by Councilmember Dickman and the motion was carried on a voice vote. The Deputy Clerk read Ordinance No. 12 — 2002 on third reading. Ordinance No. 12 — 2002 was adopted on a unanimous roll call vote. ORDINANCE NO. 19 — 2002 The Deputy Clerk read Ordinance No. 19 — 2002 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Councilmember -Sharp reported that the Tax Abatement Committee had met with Kenneth Maurer of Spartech which had requested a 10-year tax abatement on new manufacturing equipment with an estimated new value of $881,285.00. He said the committee recommended approval of the ordinance. President Wissel declared Ordinance No. 19 — 2002 on public hearing. There being no comments either for or against the ordinance, Councilmember Welch moved for engrossment, second by Councilmember Dickman and the motion was carried on a voice vote. Councilmember Welch moved to suspend the rules and advance Ordinance No. 19 — 2002 to third and final reading and read by title only, second by Councilmember Dickman and the motion was carried on a voice vote.
