Nc~ person, firm or corporation shall dig, excavate or in any manner break up a street, parkway, highway or alley unless such person, firm or corporation shall have first obtained a permit therefor. Section ~ : Fe®ovin„~„ Material From Struts: No person, firm or corporation shall remove any material from any street or alley in the Village of Plainfield and use the same for any purpose other than the grading or improvement of said street without the permission, of the Chairman of the Street and A11ey Committee of the Village of Plainfield. When any portiox~caf any ~tt'eet, highway or alley within the limits of the Village oP Plainfield is ordered, paved .with brick, asphalt, macadam,, black-top or other material by the Ppesident and Board of ~'rustees, it shall be the duly of every person, firm or corporation tv take npticse of such order, and forthwith, and before any portion of such street, high- way or alley is pe.ved, as aforesaid, tv make all excavations necessary tv laying gas, sewer, crater or other mains or pipes or connections therewith; provided that, every such person, firm or corporation shall before, and in the making of any such excavations, comply strictly with all ordinances governing excavations in streets, highways and alleys then existing. Section 4: Excavations For Connection. With Wat~x~ Mains Qr Far The Purpose of Such Connection. No person, firm or corporation shall make any excavation: in any street or a11ey in said Village for the pur- pose of making connection with any water main or surer or for the pur- pose of repairing any such connections, without a permit issued by the proper departments. All exea.vations for such purposes, and replacing of the material excavated shall be done under the supervision of the depart®ent isa~uing such permit, and at the expense of the person hiring such work to be done. Section ~,: Permit--How Obtained-~-Bond. Any Person, firm or h U ~ ~ - corporation desiring to obtain the permit required by any section of this Qrdinan~e, shall ®ake written applicaation for the same to the Village Clerk of said Vi7.lage, stating spec ifiaally the place, extent and purpose of such excavation with full specifications for the same; an estivate of the cast thereof; and an estimate of the cost of refilling and back- filling said excavation, repairing all damage to the pavement in a good and workman-like manner and restoring such street, highway or alley at said lpcati4n tc~ its condition immediately preceding the beginning of said excavation; when the work of excavating will be commenced; the estimated time of completion.. Se.id application shall be accompanied by a bond with corporate surety in double the amount of the estimated Bost of refilling and back-filling s~ueh excavation, repairing all damage to the pavement in e. good and workman-like manner and restoring sucah street. ar alley at said location to its condition immediately preceding the beginning of said excavation. Any con.trector customarily doing work in the Village of Plainfield may, in lieu of said bond., file with the Village C1~rk a brand in the principal sum of at least Five Thousand Dollars (#,x,000.00), with cvr- poste surety covering excavations in any street, highway, alley or ptablic placa in the Village of Plainfield. In case such bond is filed with the Village Clerk, the Village Clerk is hereby authori~~d to issue permits to such contractor under the provisionr~ of this Ordinance until the aggregate band requirements of such pesrmits '' `equal the principal sum of said bond. Section d: Clerk To Issue Permit. The Village Clerk may grant a permit which shall be approved and counter-sign®d by the President of said Village, to any person, firm or corporation snaking application as aforesaid to dig or excavate in eny street, highway or alley in said Village, provided such application is acoompanied with a bond with corporate surety as provided for in Section ~ of this Ordinance. Sec.~.;.,tican 2: Street. Department To Tnspevt. TJpon the issuance of such permit the Clerk shall immediately notify the Chairman of the Street and Alley Committee of said Pillage, and it is hereby made the duty of the Street Tepartment of said Village to inspect said wcark and •the refilling and back-filling of such excavation and the restoring of CJ ., -3-- such street. or alley to its former c®ndition. It shall be the duty of the Village Clerk to keep a record of all permits granted by him under the provisions of Section 6 of this ordinance, which record shall show the name of the person,, firm or carporation to wham the permit was granted, the place, nature, extent, character and purpose Qf the excavation, when the same is to be made, the estimated cost of refilling, back-filling and repavement,'the time required tc~ complete the same, and the name af- the company issuing such bond and the amount of the bend. '~h.e Glens shall supply himself with the necessary forms for such permits arid. a book for the keeping of such record. Sec~tic~n ~: Dut of Police ~e artment. Tt is hereby made the duty of all Police Cffiaers of the Vil~.age of Plainfield, to take notice of any excavation being made in any of the streets, highways or alleys pf the Village, and tea arrest a,ny person or persons engaged in making, erect-- ing er;superintending such excavation, unless he, she ©r they shall, on d.e~nand, exhibit a written permit for the making of the .same, duly issued in accordance with the provisions of this ordinance. No permit or bond under the provisions of this Ordinance shall be required of any public utility operating under a franchise granted it by said Village. Such utility, however, shall notify the Village Clerk before making any excavation in any street, hl.ghway, a11~y yr public place in said Village. Such notification shall include the location. of said excavation, the nature th~recb~`, the time when the work is tea be commenced and an estivate of the time of completion. Upon ~ea~ipt of such notice, the Vill~.ge Clerk shall imme- diately notify the Superintendent of the C©mbined Sewer and Water De- partment of said Village, who shall then take the necessary action to protest the sewer and water mains of said Village. Section ~: Penalty. Ariy perspn, firm or corporation violating any of the provisions of this Ordinance, shall, upon ccanvictican thereof, be fined not less than Twenty-Five Dollars (~25. q0) nor more than `I't~ro ~Iundred Dollars (~2n0.4p } fear eacah offense, and each day an which. a violatican occurs shall be deemed a separate offense.
