MINUTES
Planning Commission Agenda Meeting October 9, 2006 – 7:00 p.m.
Chair Lawanna Tsoulos called the October 9th Planning Commission Agenda Meeting to order. Other
Commissioners present were Charlie Brewer, Barry Brown, Sandy Chandler, Bill Garbett, Susan Hill, and
Chuck Powell. Absent were Honor Hutton and Gene Kindrick. City Staff present were Dee Anderson and
Dianne Otto.
Chair Lawanna Tsoulos explained that the purpose of the Agenda Meeting was for the Planning
Commissioners to look at the petitions to make sure they had everything that was needed. She said it was
not the Public Hearings and the Commissioners would not be asking real specific questions.
Chair Lawanna Tsoulos reminded the Commissioners to look over the Minutes that would be approved at the
Regular Meeting.
Hubert Ellzey represented a Zoning Variance request from Section 3-090 of the Land Development Code,
Schedule of Development Regulations, for 1 Shipwatch Circle, PIN 4-0021-17-017, Zone R-1-B. This was
an after the fact variance request. Chair Lawanna Tsoulos asked Ellzey if he had changed anything since he
had last been before the Planning Commission. Ellzey answered no. Discussion between Ellzey and the
Commissioners followed. Sandy Chandler said Ellzey did not build the landing and steps the way they were
drawn. Barry Brown said the drawing showed the deck to be 54-inches wide. Chuck Powell requested that
Ellzey bring the actual measurements of the stairs to the Regular Meeting. Tsoulos said the petition would be
on the Agenda.
Chair Lawanna Tsoulos said the Economic Development Committee was in the process of working on the
bicycle rack and the sandwich-board sign ordinances so those items would not be on the October 17th
Agenda. She said the Buffer Ordinance would also not be on the Agenda.
Bernie Goode represented a Zoning Variance petition for 503 Seventh Street, PIN 4-0005-15-015, Zone R-
2. The variance was from Section 5-010 (K), Prohibit Placing materials in Marshlands, of the Land
Development Code. Barry Brown asked if it was the same lot as the Planning Commission had considered
previously. Goode said yes, but this request was for a culvert. Chair Lawanna Tsoulos asked if the ditch was
a wetland. Goode said there is grass growing in it. Chuck Powell said they have already denied the house
being built. Dee Anderson said since the state ruled prior to Tybee’s Soil & Sedimentation Ordinance, Goode
could build the house but not access it. Tsoulos said the state is standing behind their permit to build.
Brewer asked who gave that permission. Anderson said the Environmental Protection Division. Goode said
they reaffirmed it. Tsoulos said the permit for building was not the issue. Barry Brown asked if it should be a
City Attorney question. Anderson said Goode has to have permission through this process. Tsoulos said the
item would be on the October 17th Planning Commission Agenda.
No one was present to represent a Zoning Variance for Jack Hogan at Lot 7 Chatham Avenue, PIN 4-
0010-04-013, Zone R-2. The variance was from Section 3-090, Schedule of Development Regulations, of the
Land Development Code. Chuck Powell asked about access to the property. Anderson said there is a 10-foot
wide driveway. The group discussed the setbacks which were 5 feet off each side and 5 feet off the rear
property line. Barry Brown asked if the private drive was considered part of the setback. Anderson said it
was. Tsoulos said the petition would be on the Agenda.
Thomas Fall represented a Zoning Variance for 9 Eighteenth Street, PIN 4-0009-06-006, Zone R-2. The
variance was from Section 3-090, Schedule of Development Regulations, of the Land Development Code.
Chair Lawanna Tsoulos asked if Fall was taking it from a duplex to a single-family. Fall said yes and they are
asking to raise the building to the current FEMA level. He said the building is a 1930s cottage that was
originally on the other side of the street. Fall said there are some significant structural issues and this project
would make that better. He said they would like to add wraparound porches. Tsoulos asked about the
porches. Fall explained there would be an encroachment at the front but not the sides. Cullen Chambers said
he would like to speak to the project. Tsoulos recommended he do so at the Public Hearing. Tsoulos told Fall
the item would be on the Agenda.

Harold Yellin represented a Site Plan Approval at 1126 Highway 80, PIN 4-0026-11-023, Zone C-2, for
Chris Chandler. The variance was from Section 3-090, Schedule of Development Regulations, of the Land
Development Code. Yellin said Chandler purchased the property because it is zoned C-2 and Chandler got a
business license for special events. Dee Anderson said it is a single-family home and now Chandler wants to
use it as a commercial site. Anderson said Chandler has a business license for short-term rental. Barry Brown
asked that the parking spaces be plotted by a surveyor rather than hand drawn. Yellin agreed to have that
done. Chuck Powell asked about a 20-foot buffer. Brown said it was marshland. Bill Garbett asked for the
square footage of the residence. Yellin said it was between 2,150 and 2,180 square feet. Yellin was told to
provide accurate parking on the survey and the square footage of the residence. Charlie Brewer asked about
alcohol on the premises. It was determined that would be a separate process. Chair Lawanna Tsoulos said
the item would be on the October 17th Planning Commission Agenda.
Chair Lawanna Tsoulos said the final item was a proposed ordinance that would require a valid
survey to obtain a building permit. Barry Brown asked whether partial surveys could be done in
situations where work was only going to be performed on one side of the property. Dee Anderson said the
whole survey was needed to make sure it is not a nonconforming structure. Tsoulos said the item would be
on the Agenda.
