HomeMy Public PortalAbout12-17-2001PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, DECEMBER 17, 2001 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m., Monday, December 3, 2001, in the Council Chambers in said City. President Karl Sharp presided with the following Councilmembers present: Howard "Jack" Elstro, Etta J. Lundy, Bruce Wissel, Phil Dickman, Bing Welch, Larry Parker, Paul Combs and Sarah "Sally" Hutton. The following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER WELCH ROLL CALL Nine present. APPROVAL OF MINUTES The minutes of the meeting of December 3, 2001 were approved on a motion by Councilmember Hutton, second by Councilmember Welch and carried on a voice vote. PRESENTATION OF REMONSTRANCES, PETITIONS, MEMORIALS, INTRODUCTIONS MOTIONS AND PUBLIC COMMENTS Karen Maurer, director of Birth to Five, explained the activities in which that department is involved. She brought the Council's attention to a proclamation by Governor Frank O'Bannon to recognize the Healthy Families program, noting that Indiana is the only state that has a statewide program of this kind. Her report also included a thank you to the City of Richmond for its help in the ongoing effort to help families within this community. COMMUNICATION FROM THE MAYOR Mayor Shelley Miller asked Councilmembers to mark January 3, 2002 on their calendars to plan to attend a reception from 4:30 to 6 p.m. in the City Building to show appreciation for all those volunteers who serve on the various committees within the City government. She added that Congressman Mike Pence will also be attending that event. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY President Sharp said the minutes of the meetings of November 21 and 29, 2001 were in their packets. REPORTS FROM DEPARTMENT HEADS City Engineer Bob Wiwi reported on the activities within his department detailing the various projects that are currently being worked on, those that have been finished and goals for the coming year. REPORTS FROM STANDING COMMITTEES REPORTS FROM SPECIAL COMMITTEES REPORTS FROM ORGANIZATIONS MISCELLANEOUS BUSINESS ORDINANCES ON FIRST READING Councilmember Elstro moved to suspend the rules and read Ordinance No. 98 — 2001 by title only and Ordinance No. 102 — 2001 in its entirety, second by Councilmember Welch and the motion was carried on a voice vote. ORDINANCE NO. 98 — 2001 The Clerk read Ordinance No. 98 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF TRANSPORTATION Explaining this ordinance was Tony Foster of the Community Development office who said the City is requesting $488,027.00 to be used to assist with infrastructure improvements along N.W. 5`h Street extending from U.S. 40 past L Street where the street splits off into Union Pike and Williamsburg Pike. 1 Common Council Minutes Cont'd December 17, 2001 Page 2 Councilmember Lundy moved to suspend the rules and advance Ordinance No. 98 — 2001 to second reading and read by title only, second by Councilmember Welch and the motion was carried on a voice vote. The Clerk read Ordinance No. 98 — 2001 on second reading. President Sharp declared Ordinance No. 98 — 2001 on public hearing. There being no comments either for or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Parker and the motion was carried on a voice vote. Councilmember Welch moved to suspend the rules and advance Ordinance No. 98 - 2001 to third and final reading and read by title only, second by Councilmember Elstro and the motion was carried on a voice vote. The Clerk read Ordinance No. 98 — 2001 on third reading. Ordinance No. 98 — 2001 was adopted on a unanimous roll call vote. ORDINANCE NO. 102 — 2001 The Clerk read Ordinance No. 102 — 2001 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION . "WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose constitutes the appropriation of such property for the intended purpose. "WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. "NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond: 1. The donation of Eight Hundred Dollars ($800.00) to the Richmond Fire Department Confined Space Rescue Project by First Bank Richmond, N.A. 2. The donation of Five Hundred Dollars ($500.00) to the Richmond Police Department Confined Space Rescue Project by First Bank Richmond, N.A. " Fire Chief Mike Allen expressed his appreciation for the donation and encouraged Council to approve the ordinance. However, he pointed out that the second donation to the Police Department as stated in the ordinance was possibly incorrect. City Attorney Bob Bever said the correction would be made with a motion that the ordinance be amended. Councilmember Elstro so moved, second by Councilmember Hutton and the motion was carried on a voice vote. Councilmember Elstro moved to suspend the rules and read Amended Ordinance No. 102 — 2001 on second reading and read by title only, second by Councilmember Dickman and the motion was carried on a voice vote. The Clerk read Amended Ordinance No. 102 — 2001 on second reading. President Sharp declared Amended Ordinance No. 102 — 2001 on public hearing. There being no comments either for or against the ordinance, Councilmember Welch moved for engrossment, second by Councilmember Parker and the motion was carried on a voice vote. Councilmember Elstro moved to suspend the rules and advance Ordinance No. 102 — 2001 to third and final reading and read by title only, second by Councilmember Lundy and the motion was carried on a voice vote. The Clerk read Ordinance No. 102 — 2001 on third reading. Ordinance No. 102 — 2001 was adopted on a unanimous roll call vote. Common Council Minutes Cont'd December 17, 2001 Page 3 ORDINANCES ON SECOND READING AND ENGROSSMENT ORDINANCE NO. 93 — 2001 The Clerk read Ordinance No. 93 — 2001 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Councilmember Wissel asked that this ordinance be held on second reading. ORDINANCES ON THIl2D READING There were none. UNFINISHED BUSINESS CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned at 8:15 P.M.
