HomeMy Public PortalAbout11-05-2001PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, NOVEMBER 5, 2001 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m., Monday, November 5, 2001, in the Council Chambers in said City. President Karl Sharp presided with the following Councilmembers present: Howard "Jack' Elstro, Etta J. Lundy, Bruce Wissel, Phil Dickman, Bing Welch, Larry Parker, Paul Combs and Sarah "Sally" Hutton.. The following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER LUNDY ROLL CALL Nine present. APPROVAL OF MINUTES The minutes of the special meeting of September 27, 2001 and the regular meeting of October 15, 2001 were approved on a motion by Councilmember Welch, second by Councilmember Hutton and carried on a voice vote. PRESENTATION OF REMONSTRANCES, PETITIONS, MEMORIALS, INTRODUCTIONS, MOTIONS AND PUBLIC COMMENTS Dr. Daryl C. Greene, 67 South 24`h Street, gave a review of his book, "Walking Free: The Nellie Zimmerman Story." COMMUNICATION FROM THE MAYOR Mayor Shelley Miller announced that a breakfast would be held Tuesday morning at Forest Hills Country Club as a kick-off for the Visioning Process, a project that has county -wide participation and will continue ■ throughout the next several months. She said the purpose is to put together a shared vision for a preferred future. Councilmember Elstro asked the Mayor if she had heard from either the railroad or the Recycling Center. She said they have already started improving the South L crossing but she can't guarantee the work will be completed in the fall but would be done in the early spring and come back with the overlay to complete the project. Councilmember Hutton asked about whether or not there was anyone designated to take care of the graffiti in the City. Stan Lambert, Superintendent of the Parks Department, said his department is getting information about how to remove the graffiti when it exists. Councilmember Combs explained that he missed the RP & L Board meeting because he was attending the Vaile Neighborhood Watch meeting, noting that he felt it was important that he attend that meeting. He said that he learned that last Monday there were 30 cars that had tires slashed in the area of South 3rd through South 8`h Street, from South A to South E Street. He said he felt it was important that he show support for that group which, he said, is determined to organize and do something positive to protect their neighborhood. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY President Sharp said the minutes of the meeting of October 18, 2001, were included in their packets. REPORTS FROM DEPARTMENT HEADS There were no reports. REPORTS FROM STANDING COMMITTEES REPORTS FROM SPECIAL COMMITTEES REPORTS FROM ORGANIZATIONS MISCELLANEOUS BUSINESS President Sharp said he had received a letter from Police Chief Bill Shake about Ann England's term on the Police Merit Commission expiring and that this is an appointment made by Council. He said England had expressed a desire to continue in that position. After a brief discussion Councilmembers postponed any action to give anyone else an opportunity to come forward to volunteer to serve on that Commission. President Sharp said that would be brought up again at the November 19 Council meeting. Common Council Minutes Cont'd November 5, 2001 Page 2 ORDINANCES ON FIRST READING Councilmember Elstro moved to suspend the rules and read Ordinances No. 74, 75, 76, 77, 78, 79, 80, 81, 82, 83, 84, 85, 88, 89 and 90 - 2001, on first reading by title only and Ordinances No. 86, 87, 91 and 92 - 2001 in their entirety, second by Councilmember Welch and the motion was carried on a voice vote. ORDINANCE NO. 74 — 2001 The Clerk read Ordinance No. 74 — 2001 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Explaining the ordinance was Councilmember Wissel who said that this is an abatement request made by Richmond Enterprises LLC for an estimated value of $275,000. He said the Tax Abatement Committee would review it and bring it back to Council on second reading at its November 19 meeting. ORDINANCE NO. 75 — 2001 The Clerk read Ordinance No. 75 — 2001 — AN APPROPRIATION ORDINANCE AMENDING THE 2001 BUDGET Terry Quinter, director of Roseview Transit, explained the transfers within the department saying it is a deletion of $15,000 from the Temporary Help account and $5,000 from the Overtime account, making the total of $20,000 to be transferred to the Gasoline account. Councilmember Elstro moved to suspend the rules and advance Ordinance No. 75 — 2001 to second reading and read by title only, second by Councilmember Hutton and the motion was carried on a voice vote. ORDINANCE NO. 76 — 2001 The Clerk read Ordinance No. 76 — 2001 — AN APPROPRIATION ORDINANCE AMENDING THE 2001 BUDGET Fire Chief Mike Allen explained that this transfer request is to delete $15,000 from the Repair Parts Vehicle account and add it to the Repair Vehicles account. Councilmember Lundy moved to suspend the rules and advance Ordinance No. 76 — 2001 to second reading and read by title only, second by Councilmember Welch and the motion was carried on a voice vote. Common Council Minutes Cont'd November 5, 2001 Page 3 ORDINANCE NO. 77 — 2001 The Clerk read Ordinance No. 77 — 2001 — AN APPROPRIATION ORDINANCE AMENDING THE 2001 BUDGET Explaining this transfer was Chief Allen again who said it is a deletion of $999 from the Building Materials account and $1,021 from the Physicals account which totals $2,020 and that is to be added to the Engineers account. Councilmember Welch moved to suspend the rules and advance Ordinance No. 77 — 2001 to second reading, second by Councilmember Parker and the motion was carried on a voice vote. ORDINANCE NO. 78 — 2001 The Clerk read Ordinance No. 78 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM INDIANA STATE BUDGET AGENCY Tony Foster, the City's Grants Administrator, explained that the City is requesting $25,000 to prepare a storm water quality management plan. He added that there is no local match required and it will be at least 30 to 45 days before the City will be notified. Mayor Miller said there are actually three different studies being performed and the long term control is one that the City doesn't anticipate having findings for probably another year. She said these funds would supplement the ongoing effort for that study but on a timely basis not to hold up the project. Councilmember Wissel moved to suspend the rules and advance Ordinance No. 78 — 2001 to second reading and read by title only, second by Councilmember Welch and the motion was carried on a voice vote. ORDINANCE NO. 79 — 2001 The Clerk read Ordinance No. 79 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF NATURAL RESOURCES URBAN CONSERVATION GRANT PROGRAM Foster explained that the City is requesting $3,500 to do two projects selected by the Street Tree Commission. The first, he said, is to create a homeowners' guide to tree selection which would outline the species of trees and to give sites where trees should be planted. The second, he said, would be to purchase an update of Treekeeper Software to keep track of the tree inventory, when they need pruning and the condition of the trees. He said there is a 100 percent match required and that would come from the 2002 Street Tree Commission budget and/or Street Department budget. Councilmember Lundy moved to suspend the rules and read Ordinance No. 79 — 2001 on second reading, second by Councilmember Elstro and the motion was carried on a voice vote. ORDINANCE NO. 80 — 2001 The Clerk read Ordinance No. 80 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM UNITED WAY Foster also explained this ordinance, saying that this grant is being submitted on behalf of Widowed Persons Service (WPS) and is for $4,500 and the funds will be used to help supplement the operating expenses of the organization. He added that this is a grant that is requested annually. Councilmember Wissel moved to suspend the rules and advance Ordinance No. 80 — 2001 to second reading and read by title only, second by Councilmember Parker and the motion was carried on a voice vote. ORDINANCE NO. 81— 2001 The Clerk read Ordinance No. 81 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY Councilmember Lundy asked Foster why this ordinance and the following four were not all put together and he responded by saying that he had thought of looking at doing that in the future but he did not do it this time. Councilmember Parker then asked City Attorney Bob Bever if all five could be addressed at one time tonight. Bever responded that it would be proper to do that and Councilmember Parker moved to look at Ordinances No. 81, 82, 83, 84, and 85 — 2001 as one group, second by Councilmember Combs and the motion was carried on a voice vote. Foster explained that Ordinance No. 81 — 2001 deals with a request made by the Richmond Police Department to accept grant funding for $9,750 for assistance with the costs associated for operating the D.A.R.E. Program. ORDINANCE NO. 82 — 2001 The Clerk read Ordinance No. 82 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY Foster said that Ordinance No. 82 — 2001 is also for the D.A.R.E. Program but is for $5,000 and is specifically for the Summer Camp which targets middle school students and about 3,500 from Wayne County participate in that program. Common Council Minutes Cont'd November 5, 2001 Page 5 ORDINANCE NO. 83 — 2001 The Clerk read Ordinance No. 83 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY Foster said the Ordinance No. 83 — 2001 deals with a request by the Richmond Police Department for an amount up to $11,000 for assistance with the costs of purchasing equipment for the Richmond SWAT Team. He said that equipment includes 13 45-caliber pistols with tactical lights and other accessories including holsters and carrying pouches. ORDINANCE NO. 84 — 2001 The Clerk read Ordinance No. 84 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY Foster said Ordinance No. 84 — 2001 also deals with a request by the Richmond Police Department and is for $1,564 for purchasing materials for the Adult Citizens Police Academy, Youth Citizens Police Academy and Selective Enforcement Operations. ORDINANCE NO. 85 —.2001 The Clerk read Ordinance No. 85 — 2001 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY Foster said Ordinance No. 85 — 2001 deals with a request by the Richmond Police Department's Traffic Division for $2,175 for purchasing additional hand-held radar units. Councilmember Welch moved to suspend the rules and read Ordinance No. 81, 82, 83, 84 and 85 — 2001 on second reading, second by Councilmember Dickman and the motion was carried on a voice vote. ORDINANCE NO. 86 — 2001 The Clerk read Ordinance No. 86 — 2001 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION "WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and "WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. "NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond: "The donation of fourteen carbon monoxide detectors to the Richmond Fire Department by Richmond Independent Insurance Agents." Commenting on this ordinance was Chief Allen who urged the support of Council for this ordinance. ORDINANCE NO. 87 — 2001 The Clerk read Ordinance No. 87 — 2001 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION "WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and "WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. "NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond: "The donation of Four Thousand Five Hundred Dollars ($4,500) from Johns Manville and Employees to the Richmond Fire Department Confined Space Rescue/Hazardous Material fund." Chief Allen explained that this ordinance is a result of the September 11, 2001 tragedy because Johns Manville and the employees felt the need to do something to help with the original intent to send the funds to some agency in New York but after they collected the money they chose to donate the funds locally to the Richmond Fire Department. He encouraged Council to accept the donation, adding that the department could use the funds. ORDINANCE NO. 88 — 2001 The Clerk read Ordinance No. 88 — 2001 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Councilmember Wissel explained that this ordinance deals with a 10-year tax abatement request made by Enviro Finishing of Indiana, Inc. for real estate. He said they estimate no new jobs but the retention of 15 new jobs and the estimated value is $180,000. He said the Tax Abatement Committee would review the request and bring it back to Council at its November 19 meeting. Common Council Minutes Cont'd November 5, 2001 Page 7 ORDINANCE NO. 89 — 2001 The Clerk read Ordinance No. 89 — 2001 — AN APPROPRIATION ORDINANCE AMENDING THE 2001 BUDGET Stan Lambert, Superintendent of Richmond Parks Department, explained that this ordinance deals with the deletion of $8,200 from the Salary and Wages account and adding $5,000 to the Electric Services account, $1,000 to the Water Services account, $1,200 to the Professional Services account and $1,000 to the Training and Education account. Councilmember Welch moved to suspend the rules and advance Ordinance No. 89 — 2001 to second reading and read by title only, second by Councilmember Dickman and the motion was carried on a voice vote. ORDINANCE NO. 90 — 2001 The Clerk read Ordinance No. 90 — 2001 — AN APPROPRIATION ORDINANCE AMENDING THE 2001 BUDGET Lambert also explained this ordinance saying that it is a request to delete $30,217 from the Salary & Wages account and $20,037 from the Temporary Salaries account and add $10,000 to the Computer Equipment account, $13,000 to the Other Equipment account and $27,254 to the Capital Improvement account. Councilmember Hutton asked what positions were not filled resulting in having so much money left and Lambert answered that these included a bookkeeper position, a community recreation coordinator and an outdoor recreation coordinator position and there is a senior citizen building superintendent which is open now. He said the temporary account has extra money because of the summer help situation. Councilmember Parker asked Lambert to elaborate on the addition to the Computer Equipment account. He said this is as a result of the recommendation of Ryan VanMiddlesworth, the City's M.I.S. coordinator. He said it would allow them to track their expenses on various pieces of equipment and enable them to monitor the cost of the operation of that equipment. He said most of their computers are three and four years old and he still has a couple of Macintosh computers. Lambert said they will also be purchasing a new snow plow for one of their pickups and will begin replacing some of the mechanics tools. He said the main, item of expense in the Capital Improvement account will be getting a fence for the skate park purchased and installed. He added that they will also be investigating some other projects at the Cordell Pool which includes additional fencing. Common Council Minutes Cont'd November 5, 2001 Page 8 ORDINANCE NO. 91— 2001 The Clerk read Ordinance No. 91 — 2001 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION "WHEREAS , the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and "WHEREAS, acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose; and "WHEREAS, nineteen (19) donated trees were recently planted on the medians of South 20'' Street between Reeveston and South `B" Street. "NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that a donation of nineteen (19) trees to the Richmond Street Department by Ann Parliament and Residents of South 20t' Street shall be accepted and gratefully acknowledged by the citizens of Richmond." Assistant City Attorney Steve Rabe explained that this ordinance acknowledges street trees that have been donated and already been planted along South 20'' Street between Reeveston Road and South B Street. Councilmember Welch moved to suspend the rules and advance Ordinance No. 91 — 2001 to second reading and read by title only, second by Councilmember Dickman and the motion was carried on a voice vote. Councilmember Wissel commented that both Ann Parliament and her husband, Jim, have served as members of the Street Tree Commission and this is just one of several projects that they have participated in. "NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the City is authorized to receive contributions to be used to pay the costs of a Visioning Breakfast to be held on November 6, 2001, and that said contributions will be used to cover the costs thereof." ORDINANCES ON SECOND READING AND ENGROSSMENT AMENDED ORDINANCE NO. 70 — 2001 The Clerk read Amended Ordinance No. 70 — 2001 — A GENERAL ORDINANCE AMENDING AND RESTATING CHAPTER 91 OF THE CITY OF RICHMOND CODE President Sharp announced that the ordinance was on second reading and still on public hearing. Stepping forward to speak in favor of the ordinance was Jay Kitchel, Richmond's Postmaster, who encouraged the enforcement of this ordinance. He said there are approximately 45 City carriers and 35 or 36 of them have been bitten several times and he called for the enforcement of the leash law instead of giving it "lip service." Also speaking was Jody Snyder of 224 North West 16t' Street who was attacked on May 9 and she said, her only problem with the ordinance is that it should be enforced. She gave an account of a recent incident during which she was walking her two dogs and was followed by a large black dog on the loose but wearing a collar. President Sharp commented that the reason this ordinance was looked at by so many of the City departments was to make it more enforceable. There being no further comments either for or against the ordinance, Councilmember Wissel moved for engrossment, second by Councilmember Welch and the motion was carried on a voice vote.
