Councilmember Wissel stated that since this is a zoning issue, would it also incorporate the two-mile fringe
area.Bever said that it would.Bever said it would also involve the Planning Commission and that would be
another stage of review and public hearing because it would go in the Zoning Title of the City Code.
President Parker said that due to the complexity of this ordinance he is certain Council needs to have a
Committee of the Whole meeting, but invited Councilmembers to ask questions of Bever if they wished to
do so at this time.
Hearing none, he said he had one and asked about the area of nonconformity and asked if this ordinance
would pass in its entirety that would mean that the owners of some of the signs out there now would be
notified that they would be no longer in compliance.Bever said this means that the director of planning and
zoning needs to go out and take a listing of all those signs that are not in compliance and those people
would be notified of their nonconformity. He said if when they did put it up,it was a legal sign, and if they
have a financial investment in it, there is still the grandfathering possibility, adding that that has not been
eliminated.
Bever said that in his letter(which is on file in its entirety in the Clerk's office) he pointed out some of the
issues, seven in all, which need to be resolved as part of this ordinance. These deal with property rights,
permits, restrictions, size, advertising signs, portable signs and wall signs. Bever ended his remarks with
the'statement that he wished to stress that it is important that this ordinance creates a local code which is
both reasonable and enforceable,so that the City can be consistent with the regulation of signage within the
community.
