HomeMy Public PortalAbout11-20-2000 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND,INDIANA,MONDAY,NOVEMBER 20,2000 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday, November 20, 2000, in the Council Chambers in said City. President Larry Parker presided with the following Councilmembers present: Howard "Jack"Elstro,Etta J. Lundy,Bruce Wissel, Karl Sharp,Bing Welch, Paul Combs and Sarah "Sally" Hutton. Phil Dickman was absent. The following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER ELSTRO ROLL CALL Eight present. APPROVAL OF MINUTES Councilmember Welch moved to approve the minutes of November 6,2000,second by Councilmember • Sharp and the motion was carried on a voice vote. PRESENTATION OF REMONSTRANCES, PETITIONS, MEMORIALS, INTRODUCTIONS, MOTIONS AND PUBLIC COMMENTS President Parker announced that Council had received a petition on behalf of the neighborhood affected by the rezoning petition mentioned in Ordinance No. 75 — 2000. Councilmember Welch said it is from the South 23rd neighborhood group. COMMUNICATION FROM THE MAYOR REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY President Parker said the minutes of the meetings of October 26 and November 2, 2000 were included in their packets. REPORTS FROM DEPARTMENT HEADS REPORTS FROM STANDING COMMITTEES REPORTS FROM SPECIAL COMMITTEES REPORTS FROM ORGANIZATIONS MISCELLANEOUS BUSINESS President Parker stated that Ordinance 82—2000 should be stricken and replaced by Ordinance No. 91 — 2000 which was included in their packets. Councilmember Elstro moved to strike Ordinance No. 82 — 2000,second by Councilmember Welch and the motion was carried on a voice vote. A letter from Police Chief Bill Shake was brought before Council by President Parker who explained that Harold Hanes's term on the Police Merit Commission is expiring at the end of November and the appointing authority reverts to Council.He said Hanes wishes to continue as a member of the Commission. Councilmember Wissel reminded Council that it was the policy to announce the appointment, then wait until the next meeting to act upon it. ORDINANCES ON FIRST READING Councilmember Elstro moved to suspend the rules and read by titles only Ordinance No. 83,85,86,87,88, 89,90,91,92 and 93-2000,second by Councilmember Lundy and the motion was carried on a voice vote. ORDINANCE NO.83—2000 The Clerk read Ordinance No. 83—2000—A GENERAL ORDINANCE AMENDING CHAPTER 154.43 OF THE CITY CODE REGARDING SIGNS Speaking to this ordinance was City Attorney Bob Bever who stated that he had sent'out a letter to all Councilmembers explaining that this ordinance is an attempt to revise the City code regarding signs. He said this comes from discussion over the past year within an informal committee made up of representatives of the Planning and Zoning Department, along with the Law Department, adding that it is an attempt to reach some sort of consensus on signs. Common Council Minutes Cont'd November 20,2000 Page 2 Councilmember Wissel stated that since this is a zoning issue,would it also incorporate the two-mile fringe area.Bever said that it would.Bever said it would also involve the Planning Commission and that would be another stage of review and public hearing because it would go in the Zoning Title of the City Code. President Parker said that due to the complexity of this ordinance he is certain Council needs to have a Committee of the Whole meeting,but invited Councilmembers to ask questions of Bever if they wished to do so at this time. Hearing none, he said he had one and asked about the area of nonconformity and asked if this ordinance would pass in its entirety that would mean that the owners of some of the signs out there now would be notified that they would be no longer in compliance.Bever said this means that the director of planning and zoning needs to go out and take a listing of all those signs that are not in compliance and those people would be notified of their nonconformity.He said if when they did put it up,it was a legal sign,and if they have a financial investment in it, there is still the grandfathering possibility, adding that that has not been eliminated. Bever said that in his letter(which is on file in its entirety in the Clerk's office) he pointed out some of the issues, seven in all, which need to be resolved as part of this ordinance. These deal with property rights, permits, restrictions, size, advertising signs, portable signs and wall signs. Bever ended his remarks with the'statement that he wished to stress that it is important that this ordinance creates a local code which is both reasonable and enforceable,so that the City can be consistent with the regulation of signage within the community. President Parker asked Councilmember Sharp to schedule a Committee of the Whole meeting and inform Councilmembers and the media of that date. ORDINANCE NO.85—2000 The Clerk read Ordinance No. 85 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET Director of Human Resources, Robin Henry, explained that this ordinance deals with a transfer of funds and is needed to purchase two new computers.She asked that$1,000 be deleted from the Other Contractual Services existing account and $2,000 be deleted from the Contractual Printing existing account and the total of$3,000 be added to the Computer Equipment existing account. Councilmember Wissel moved to suspend the rules and advance the ordinance to second reading and read by title only,second by Councilmember Welch and the motion was carried on a voice vote. The Clerk read Ordinance No. 85—2000 on second reading. President Parker declared the ordinance on public hearing. There being no comments either for or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Welch and the motion was carried on a voice vote. Councilmember Welch moved to suspend the rules and advance the ordinance to third and final reading and read by title only,second by Councilmember Combs and the motion was carried on a voice vote. The Clerk read Ordinance No. 85—2000 on third reading. Ordinance No. 85—2000 was adopted on a unanimous roll call vote. ORDINANCE NO.86—2000 The Clerk read Ordinance No. 86 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET City Engineer Bob Wiwi explained that this ordinance deals with transfers within the Richmond Municipal Airport budget, moving money from a 3000 account to two other accounts.He said one is to pay P.E.R.F. contributions and the other is to pay Social Security contributions as well as Medicare insurance contributions for two hourly employees at the airport.The other item,he said,is to add money to repair the fuel tank at the airport. Councilmember Welch moved to suspend the rules and advance the ordinance to second reading and read by title only,second by Councilmember Lundy and the motion was carried on a voice vote. There being no comments either for or against the ordinance, Councilmember Wissel moved for engrossment, second by Councilmember Hutton and the motion was carried on a voice vote. The Clerk read Ordinance No. 86—2000 on third reading. Ordinance No. 86—2000 was adopted on a unanimous roll call vote. ORDINANCE NO.87—2000 The Clerk read Ordinance No. 87 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET City Engineer Bob Wiwi explained that this ordinance deals with transfers within the Engineering Department and requested transfers from two accounts in the amount of $12,474.80 to the Computer Equipment account.He said his department is in need of upgrading their computers. Councilmember Welch moved to suspend the rules and advance Ordinance No. 87 — 2000 to second reading and read by title only, second by Councilmember Sharp and the motion was carried on a voice vote. The Clerk read Ordinance No. 87—2000 on second reading. President Parker declared the ordinance on public hearing. There being no comments either for or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Welch and the motion was carried on a voice vote. Councilmember Wissel moved to suspend the rules and advance Ordinance No. 87—2000 to third and final reading and read by title only, second by Councilmember Sharp and the motion was carried on a voice vote. The Clerk read Ordinance No. 87—2000 on third reading. Ordinance No. 87—2000 was adopted on a unanimous roll call vote. ORDINANCE NO.88—2000 The Clerk read Ordinance No. 88 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET Wiwi said this ordinance also deals with the Richmond Municipal Airport, explaining that the transfer of funds is necessary to pay for the two salaries of two employees at the airport to compensate them for the actual hours worked and for their holiday pay. Councilmember Lundy moved to suspend the rules and advance the ordinance to second reading and read by title only,second by Councilmember Welch and the motion was carried on a voice vote. The Clerk read Ordinance No. 88—2000 on second reading. President Parker declared the ordinance on public hearing. There being no comments either for or against the ordinance, Councilmember Combs moved for engrossment, second by Councilmember Hutton and the motion was carried on a voice vote. ORDINANCE NO.89—2000 The Clerk read Ordinance No. 89 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET Fire Chief Mike Allen explained that this ordinance deals with the transfer of funds from the accounts which include Technical Services, Travel, Contractual Printing, Repair and Maintenance of Vehicles and Uniform Maintenance in the amount of$15,984 to the Uniform&Accessories account. He explained that this would enable the Department to continue a plan that was started three years ago which was buying and replacing turnout gear for the Firefighters. He said this would buy 16 sets and his hope is to continue the plan until they have a second set of turnout gear for all the Firefighters. ORDINANCE NO.90—2000 The Clerk read Ordinance No. 90 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET Ron Chappell, director of Human Rights Commission, explained that this request is to transfer money within the department to add $800 to the Office Supplies account. He said this would also allow for the purchase of three palm-computing devices that would be used by the investigators while out in the field. Councilmember Welch moved to suspend the rules and advance the ordinance to second reading and read by title only,second by Councilmember Combs and the motion was carried on a voice vote. The Clerk read Ordinance No.90—2000 on second reading. President Parker declared the ordinance on public hearing. There being no comments either for or against the ordinance, Councilmember Combs moved for engrossment, second by Councilmember Welch and the motion was carried on a voice vote. Councilmember Lundy moved to suspend the rules and advance the ordinance to third and final reading and read by title only,second by Councilmember Elstro and the motion was carried on a voice vote. ORDINANCE NO.91—2000 The Clerk read Ordinance No. 91 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET Since there was no one in the audience to speak to the ordinance, President Parker said it would be held until the next meeting. ORDINANCE NO.92—2000 The Clerk read Ordinance No. 92 — 2000 — AN APPROPRIATION ORDINANCE AMENDING THE 2000 BUDGET This ordinance,also,said President Parker would be held until the next meeting. ORDINANCE NO.93—2000 The Clerk read Ordinance No. 93 — 2000 — AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT FOR SERVICES FROM THE RICHMOND SANITARY DISTRICT,RICHMOND POWER & LIGHT, THE MOTOR VEHICLE HIGHWAY, THE PARKS AND RECREATION DEPARTMENT AND OFF-STREET PARKING TO THE GENERAL FUND IN 2001 Explaining this ordinance was Bob Bever who referred to it as an annual ordinance dealing with payment for services from the departments mentioned in the title. Councilmember Wissel moved to suspend the rules and advance the ordinance to second reading and read by title only,second by Councilmember Sharp and the motion was carried on a voice vote. ORDINANCES ON SECOND READING AND ENGROSSMENT ORDINANCE NO.77—2000 The Clerk read Ordinance No. 77 — 2000 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.6-1.1-12.1 Councilmember Wissel asked that this ordinance be held on second reading. ORDINANCE NO.81—2000 The Clerk read Ordinance No. 81 — 2000 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.6-1.1-12.1 Councilmember Sharp said he had talked with Michael Hoover and Bill Davis of Imperial Products, which makes doorsills and door frame components. He said their business has grown within the past five years and they are now in their fourth or fifth additions and they have not asked for any tax abatements on those. However, he said, their employment has grown from 90 to 140 within the past two years and they feel an additional 6 to 8 people could be added within the next year. He said this equipment addition is to increase their productivity. President Parker declared the ordinance on public hearing. There being no comments either for or against the ordinance, Councilmember Combs moved for engrossment, second by Councilmember Hutton and the motion was carried on a voice vote. Councilmember Wissel moved to suspend the rules and advance Ordinance No. 81—2000 to third and final • reading and read by title only, second by Councilmember Lundy and the motion was carried on a voice vote. The Clerk read Ordinance No. 81 —2000 on third reading. Ordinance No. 81—2000 was adopted on a unanimous roll call vote. ORDINANCES ON THIRD READING There were none.
