Vice President Bruce Wissel presided with the following Councilmembers present: Howard "Jack"Elstro, Sarah"Sally"Hutton, Geneva"Gene"Allen, Alan Stamper, Bing Welch and Larry Parker. President Bob Dickman and Councilmember Etta J. Lundy were absent.The following business was had to-wit: • PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER HUTTON 10 1, ROLL CALL 1 ' 1 t Seven present. 1 1t APPROVAL OF MINUTES 1 1 The minutes of the meeting of November 17, 1997 were approved on a motion by Councilmember Parker, 1 second by Councilmember Allen and was carried on a unanimous voice vote. 1 2i PRESENTATIONS OF REMONSTRANCES, PETITIONS, MEMORIALS OR PUBLIC COMMENTS 2 22 COMMUNICATIONS FROM THE MAYOR 2• 2, Mayor Andrews said he had given the Councilmembers copies of a letter he had written to the Indiana 2 Department of Transportation regarding the traffic signals at Main and Eighth and Main and Ninth Streets, 20 adding that there is a good chance the signals will be restored there. Regarding the parking uptown, the 2 Mayor said he hopes action on that can move forward rather quickly. Councilmember Hutton asked if a 2: regular meeting could be held after the Committee of the Whole meeting scheduled for December 3 to act on 2° Ordinance No. 116 - 1997. City Attorney Bob Bever said this could be a verbal notification starting the 48 30 hour notice and if there is a consensus of Council about the ordinance, it can be acted upon. 3 3: REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 3: 34- The minutes of the meeting of November 6, 1997 were in the Council packets. 35 31 REPORTS FROM CITY DEPARTMENTS 3 Bob Goodwin, director of planning, said the Board of Works had been looking at the requests approved by the Council Committee on street lights with the layout done by RP & L, noting that the two most immediate ones to be considered are in Oak Park Hills and Woodgate. In addition, he said, letters had been received for Backmeyer Trace Sections 2 and 3, Meadow Park Sections 6 and 7 and Wynfield has a petition at some 41 point. He said the total of those lights mentioned is 98 and somewhere in the neighborhood of 130 lights when it is all done. He explained the process which these requests go through, stating he had given each Councilmember a copy of it to refresh their memories. The reguest, he said, originates from the property owners, to a Council person,to RP& L, back to the Council street light committee, back to RP & L, back to the Council street light 4: committee for rejection or approval then to the Board of Works. If it is approved by that body the request 4° goes to the City Clerk to put into action the recommendations. 54 51 After a brief discussion about about street lights in new additions to getting the developer to put them in, 5 Goodwin said the street light issue is going to be pursued with the enforcement tools of the new 5 comprehensive plan in the form of a subdivision ordinance and the zoning ordinance itself. Mayor Andrews 5• said public safety would also be high on the priority list when looking at requests and added that there are 5' areas within the City which do not have street lights but none has been requested. He said he wanted to 5: clarify that there are areas in which the majority of the residents do not want street lights. He added that with 5 the rate reductions given by RP & L it looked like the City would be able to accommodate all the requests 5t which had been received. She said those wishing to make pledges would be able to call in from 7 to 1 5 p.m., adding that the evening's festivities will include a chili supper, entertainment and the last hour will be in 6 memory of the party's founder,the late Fran Eward. 7 8 ORDINANCES 9 10 ORDINANCES ON FIRST READING 11 12 Councilmember Elstro moved to add Ordinance No. 142 - 1997 to the agenda, second by Councilmember 13 Hutton and the motion was carried on a unanimous voice vote. Councilmember Elstro then moved ko 14 suspend the rules and read Ordinance No. 137, 138, 139, 140, 141, 142 and 143 - 1997 on first reading by 15 title only, second by Councilmember Welch and the motion was carried on a unanimous voice vote. 16 17 ORDINANCE NO. 137-1997 18 19 The Clerk read Ordinance No. 137 - 1997 - AN APPROPRIATION ORDINANCE AMENDING THE 19°7 20 BUDGET 21 22 Stan Lambert, superintendent of the Parks & Recreation Department, explained that this ordinance is a 23 request for transfer of funding from different accounts to be able to fund some unanticipated needs at the 24 beginning of the year. He said these included the upgrading of the computer system, a leak in the municipal 25 pool, redrawing the locker room drawings at McBride Stadium, and a water leak at Clear Creek Palk. 26 Councilmember Stamper questioned the $3,200 water bill stemming from a leak that was undiscover d 27 because of estimated water bills. Lambert said it is something they are still looking into. Chief Shake noted that there is a Hid 63 process for patrol officers to be assigned to particular shifts and that is done through seniority. He said sore 64 officers were able to move from one shift to another and there is an agreement with all officers with under 65 three years of seniority that they rotate among the three shifts to provide training for them so all of thelm become familiar with each of the shifts. ,4 7 Common Council Minutes Cont'd Dee beF-1, 1997 Page-3 1 He said that is a practice that has been followed the past several years and it is felt that is in the best interest 2 of the officers to do that. Chief Shake said he did transfer some supervisory personnel from one shift to 3 another and some specialized divisions out to patrol division which is one of his prerogatives that he chose to 4 exercise. He added that he, personally, had not received any comments from anyone about this but if anyone 5 had any questions about it he would be glad to talk with them. 6 7 In answer to a question by Councilmember Allen about the grant matching fund from which a portion of the 8 money was transferred, Chief Shake said they had one traffic grant request approved and one for portable g radios, leaving the remaining amount unused in that account 10 11 Councilmember Elstro moved to suspend the rules and advance Ordinance No. 138 - 1997 to second 12 reading and read by title only, second by Councilmember Allen and the motion was carried on a unanimous 13 voice vote. 14 15 The Clerk read Ordinance No. 138- 1997 on second reading. 16 17 Vice President Wissel declared Ordinance No. 138 - 1997 on public hearing. The request, he said, is for$927,000 for new manufacturing 3p equipment and$908,000 for real estate. 4b 4 Vice President Wissel announced Ordinance No. 139- 1997 would come back on second reading. 4' 4c ORDINANCE NO.140-1997 4• 4. The Clerk read Ordinance No. 140 - 1997-AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT 4. FOR SERVICES FROM THE RICHMOND SANITARY DISTRICT, RICHMOND POWER & LIGHT, THE 4r MOTOR VEHICLE HIGHWAY, THE PARKS AND RECREATION DEPARTMENT AND OFF STREET 4: PARKING TO THE GENERAL FUND IN 1998 4: 5, City Controller Shelley Miller explained this ordinance is a result of condensing five different ordinances, 5 submitted in the past, into one. She said this is done each year for the services provided in the general fund 5• to each one of the funds and this authorizes the payment for each of the services.The payments are$38,369 5: for RP & L; $279,409 for Richmond Sanitary District; $83,693.52 for Motor Vehicle Highway; $89,435.17 for 5, the Parks and Recreation Department;and$23,356.26 for the Off-Street Parking. 5. 5• In answer to a question by Councilmember Parker, Miller said this is basically a 3.1 percent increase which is 15 the increase in the salaries, except for the Off-Street Parking which, in 1997, did not have the funds to make 5 that payment. She said it is not possible, by Indiana code,to do a temporary loan because that must be paid back by 55 the end of the year, adding that this ordinance will do a cash transfer from the general fund with the curr nt 56 appropriations into the off-street parking fund. She said that some time in the future, when that fund is o ce 57 again recognizing the revenues to support it, a cash transfer can be done from the off-street parking b ck 58 into the general fund. 59 60 In answer to a question by Councilmember Welch as to what the off-street parking fund is actu Ily 61 supporting, Miller said there are still ongoing expenses, personnel services,supplies,other contract servi es 62 such as the elevator, security and maintenance. 63 64 Councilmember Elstro moved to suspend the rules and advance Ordinance No. 142 - 1997 to sec nd 65 reading and read by title only, second by Councilmember Allen and the motion failed on a 6 - 1 vote, ith Councilmember Stamper casting a nay vote. 9 i"6 Common Council Minutes Cont'd December 1, 1997 Page-5 1 Vice President Wissel announced Ordinance No. 142-1997 would come back on second. • 3 In an attempt to explain his nay vote, Councilmember Stamper said he felt it was not right to transfer the 4 $30,000 without a plan as to how the parking is going to be done. Councilmember Allen said the fund is in a 5 deficit situation and needs to be funded before the end of the year, adding that she did see it having anything 6 to do with the parking decisions which have to be made. Councilmember Stamper responded that he sees 7 them as being the same,which is funding this year's deficit and anticipating next year's. 8 9 Mayor Andrews suggested the ordinance be placed in the Committee of the Whole meeting, explaining that '0 most of the deficit could be contributed to a retailer discontinuing payment for customer parking which ' 1 amounts to over $12,000 per year and the remainder of the lesser revenues could be as a result of the '2 construction itself. He added that when the parking committee looked at revenues and expenditures he felt '3 they have accommodated and addressed this deficit using their best judgment. Vice President Wissel stated '4 that Ordinance No. 142 - 1997 would be discussed in the Committee of the Whole meeting along with the '5 other ordinances already placed there. He added that it is a part of about a little over$1 million which was 0 distributed to communities within Wayne County, noting that$500,000 of that went to the City of Richmond in -1 this budget year. PARRY'S ADDITION TO GREENWOOD, NOW A PART OF THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA 1 q2 Vice President Wissel explained the Planning Commission had met November 20 on this petition to vacate a 3 public place located at the northwest corner of South M and 11th Street directly across from an area of equal 4 distance that was vacated about six months ago. He said this is a request for a special se 29 district classification in the A-1 agricultural district to include the land application of digested municipal slu e 30 located at the Sanitary landfill at 5242 New Paris Pike. He said the vote was 8 in favor with 1 abstaining, to 31 recommend approval. He said none were opposed and two were absent. 32 33 Vice President Wissel declared Ordinance No. 114 - 1997 on public hearing. Stepping forward was Jac ie 34 Makela, assistant director of the Sanitary District, addressing her comments to both ordinances.She said t e 35 difference between the two ordinances is that at the Richmond Sanitary District landfill the biosolids will e 36 used as a soil amendment to assist in the establishment of vegetation and disturbed soil permitting e 37 establishing of vegetation to prevent erosion. She said the other area.is located on Abington Pike where t e 38 biosolids will be used as a fertilizer in a production of crops, adding that this is a common practice in India a 39 as well as across the nation. 40 41 She said she is petitioning for special ordinance chapter 154 of the zoning code, stating that even the lo''al 42 zoning has a very extensive technical document in that it addresses specific concerns such as when to apaly 43 and at what location. She said the Sanitary District has been using sludge in crop production since 19:6. 44 She explained that you do not want to put biosolids in the landfill as you would trash, but would want to us- it 45 as a soil amendment not to take up landfill space. She said the rules are governed by two different bodies in 46 that the office of solid hazardous waste governs what is actually put in the landfill and the division of la d 47 application of that same governing body issues the permits for land application. 48 49 Makela said sludge has been going to Union and Wayne Counties where it is injected into the top six inch-s 50 of soil, adding that if this ordinance is approved it would make approximately 4300 acres approved by t e 51 state for land application within the two counties. 52 53 Ted Merrill of Kokomo explained he is a representative of the contract applicators who actually perform t e 54 application for the Sanitary District and is here to answer questions. He said the only difference is the slude would be distributed at 3 the Abington Pike location.
