HomeMy Public PortalAbout07-07-1997 376. PRoeF 1 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday, July 7 2 3 1997, in the Council Chambers in said City. President Bob Dickman presided with the following Councilmembers present: Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Sarah "Sally" Hutton, Geneva 4 "Gene"Allen, Alan Stamper, Bing Welch and Larry Parker. The following business was had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 PRAYER BY COUNCILMEMBER LUNDY 9 0 ROLL CALL 1 2 Nine present. 3 4 APPROVAL OF MINUTES OF JUNE 23, 1997 5 6 The minutes of the June 23, 1997 meeting were approved on a motion by Councilmember Hutton, second by 7 Councilmember Welch and was carried on a unanimous voice vote. 8 9 PRESENTATIONS OF REMONSTRANCES, PETITIONS, MEMORIALS OR PUBLIC COMMENTS '0 '1 A.Vacation Petition No. 7- 1997 '2 '3 Councilmember Wissel stated this petition was filed by Charles and Anita Pennington and was a '4 request for a vacation of a portion of North 14th Street located north of North J Street. He said '5 Clyde Williams repesented the petitioners at the Plan Commission stating that they would like to '6 use the area to build a new shop. He said the vote was 7 in favor with four absent and none '7 opposed to the recommendation for the vacation of the alley way. '8 '9 President Dickman announced that the vacation petition was on public hearing. Attorney Larry :0 Simkin, said Attorney Bob Delaney was on his way and would be here in five minutes. President :1 Dickman said Delaney can address this issue later in the meeting when it comes back as an :2 ordinance. :3 .4 B. Resolution No. 6- 1997 •5 .6 Councilmember Hutton moved for adoption of Resolution No. 6 - 1997, second by Councilmember :7 Allen and the motion was carried on a unanimous voice vote. :8 9 COMMUNICATIONS FROM THE MAYOR 10 1 City Controller Shelley Miller said she had distributed some information to Councilmembers which included 2 the ongoing project of Unified 9-I-I Dispatch between the City and the County and work is continuing on that, 3 looking at the legalities and the financial impact. 4 ^5 Also, Miller said she had included a budget calendar, noting that she and the Mayor, along with the Council 6 President and Vice President, had come up with a tentative calendar which included an early meeting with a 7 the Council's finance committee, hopefully the first week in August. She said budget books will be distributed <8 to Council August 15,the Committee of the Whole meetings will take place the last two weeks in August and 9 the adoption hearing has been set for September 22. '0 '1 Councilmember Parker brought up a point of order, stating that what Council had adopted earlier was the '2 revised version of Resolution No. 6- 1997, adding that the revised date was June 2, 1997. City Attorney Bob 3 Bever agreed,stating that they had voted on the revised version. '4 '5 Councilmember Stamper asked about having a strategic planning retreat which would be a different way of 6 handling the budget process, adding that he felt they could have more of an open dialogue as to where and '7 why things are being done. He said he would like to have that in addition to the meeting planned with the '8 Finance Committee. Bever said such a meeting may not be possible and President Dickman asked '9 Councilmember Stamper if he was a member of that Finance Committee. Learning that he is one of the :0 members, President Dickman said he felt that serving on that committee will allow him to ask some of those :1 questions he is thinking about. :2 s3 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY :5 Included in the Council packets were the minutes of the meetings held June 5, 12 and 19, 1997. She aid 13 the appointment has to be someone in the area of lodging and Patel is the owner and operator of the 14 Richmond Days Inn, the Best Western and the Villa Motel, overseeing 164 rooms. Councilmember Hu on 15 moved to approve the recommendation and appoint Patel, second by Councilmember Allen and the mo ion 16 was carried on a unanimous voice vote. 17 18 ORDINANCES 19 20 ORDINANCES ON FIRST READING 21 22 Councilmember Elstro moved to suspend the rules and read Ordinances No. 70, 74, 75, 76, 77, 78, 79, 80 23 and 81 - 1997 on first reading by title only, second by Councilmember Welch and the motion was carried on 24 a unanimous voice vote. 25 26 ORDINANCE NO.70-1997 27 28 The Clerk read Ordinance No. 70 - 1997 - AN APPROPRIATION ORDINANCE AUTHORIZING HE 29 RECEIPT AND DISTRIBUTION OF FUNDS FOR THE MAYOR'S OPEN 30 31 Miller said Councilmembers had been given registration forms for the Mayor's open, noting that the intent for 32 this event is to raise funds for the Business Education Liaison Program of the Richmond/Wayne Co my 33 Chamber of Commerce for work force development. She said the tee and greens signs would be paid fo by 34 sponsors and those proceeds would go to that, with the entry fees going for the greens fees. She said his 35 ordinance would allow the City to receive those funds and distribute them right back out to administer the 36 Mayor's Open. 37 38 • Councilmember Elstro moved to suspend the rules and advance Ordinance No. 70 - 1997 to second reading 39 and read by title only, second by Councilmember Lundy and the motion was carried on a unanimous voice 40 vote. 41 42 The Clerk read Ordinance No. 70 - 1997 on second reading. 43 44 President Dickman declared Ordinance No. 70 - 1997 on public hearing. She said this ordinance allows for the application for two 3 grants. The one from the Gannett Foundation, she said, is for approximately $4,000 which is to cover the 4 cost of the monthly newsletter sent to 1,500 residents in Wayne and Union counties as well as a few in 5 Preble County, Ohio. She said this newsletter is a vital part of this program and keeps people in touch with 6 the program which provides peer counseling for recently bereaved men and women. '8 ORDINANCE NO.78-1997 00 The Clerk read Ordinance No. 78 - 1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. .3 6-1.1-12.1 1,4 n5 Councilmember Stamper said this ordinance deals with a tax abatement for Pittsburg Tube Co. for new manufacturing equipment and real estate, creating 13 new jobs and retaining 51. .218 Common Council Minutes Cont'd July 7, 1997 Rage-4 1 ORDINANCE NO.79 - 1997 2 3 The Clerk read Ordinance No. 79 - 1997 - AN APPROPRIATION ORDINANCE AMENDING THE 1 97 4 BUDGET 5 6 Fire Chief Mike Allen explained this ordinance is a request for a transfer of funds which will enable the ire 7 Department to make a capital purchase in its training division. He said the request is for a transfer of$5, 00 8 from the present training budget into the 4000 accounts for a capital purchase. He explained that this a 9 project started at the first of the year in answer to a request by the Mayor and it is to purchase a p mp 10 simulator for the training division. He added that this is a valuable piece of equipment which will enhance he 11 department's capabilities. He said a goal was set and they were successful to a point, getting to$13,650, but 12 the simulator cost is approximately$18,000, making the need for additional funds. 13 14 Councilmember Hutton moved to suspend the rules and advance Ordinance No. 79 - 1997 to sec nd 15 reading and read by title only, second by Councilmember Allen and the motion was carried on a unanim us 16 voice vote. 17 18 The Deputy Clerk read Ordinance No.79- 1997 on second reading. 19 20 President Dickman declared Ordinance No. 79- 1997 on public hearing.There being no comments either for 21 or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Huton 22 and the motion was carried on a unanimous voice vote. 23 24 Councilmember Elstro moved to suspend the rules and advance Ordinance No. 79 - 1997 to third and f nal 25 reading and read by title only, second by Councilmember Lundy and the motion was carried on a unanimous 26 voice vote. 27 28 The Clerk read Ordinance No.53 -1997 on third reading. 29 30 Ordinance No. 79- 1997 was adopted on the following call of the roll: 31 32 Ayes: Elstro, Lundy,Wissel, Hutton,Allen, Stamper,Welch, Parker and Dickman (9) 33 Nays: None 34 35 ORDINANCE NO.80-1997 36 37 The Clerk read Ordinance No. 80 - 1997 - A GENERAL ORDINANCE AMENDING CHAPTER 76 OF T E 38 CITY OF RICHMOND CIDE REGARDING ONE WAY STREETS 39 40 Bever said, as he pointed out in his letter to Councilmembers, this ordinance may not be necessary ba ed 41 on the resolution and ordinance passed last year, however the Mayor wanted Council to field part of this .nd 42 be able to consider it. He explained that this is the official designation of Sixth and Seventh Streets from t eir 43 current one way status to their two way status as set forth in the redevelopment plan for the uptown area. He 44 reminded Councilmembers that Cole & Associates and the local engineer's office had made he 45 determination that it was in the best interest of the project to make the streets two way again. 46 47 Bever pointed out that Sixth Street is one way from Fort Wayne Avenue to South H Street and this ordina ce 48 has been shown to include the two way to South H Street, but whether or not South E to South H should be 49 made two way is up to Council. He said there is no hurry on this, so it is possible to hold it and invite pu lic 50 comments. He said this will not be implemented until the completion of Main Street but he wanted to get it on 51 the books. Councilmember Hutton and Elstro commented that the street is too narrow to be made two ay 52 unless parking would be banned and that would inconvenience the homeowners in that block. 53 54 City Engineer Bob Wiwi said he understands that that needs to be considered and pointed out that in he 55 master plan Cole & Associates only considered making the street two way from North E to South E. e 56 added that he realized that if it is made two way, parking would be restricted and he knows that is n a 57 good idea. Councilmember Hutton moved to amend the ordinance eliminating the two way designation fr m 58 South E to South H on Sixth Street, second by Councilmember Elstro and the motion was carried o a 59 unanimous voice vote. 60 61 President Dickman said this ordinance will come back on second reading July 21. 62 63 ORDINANCE NO.81 -1997 64 65 The Clerk read Ordinance No. 81 - 1997 -AN ORDINANCE AUTHORIZING THE CITY OF RICHMOND 0 ISSUE ITS "VARIABLE RATE DEMAND ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 1'97 (FRIENDS FELLOWSHIP COMMUNITY, INC. PROJECT)" AND APPROVING OTHER ACTIONS IN RESPECT THERETO • 79 .. Common Council Minutes Cont'd July 7. 1 q97 Page b 1 Bever explained that at Council's last meeting Councilmembers had passed an inducement resolution which 2 was a preliminary step to this ordinance. He said the Economic Development Corporation has met this 3 afternoon for its public hearing and had passed this unanimously and individuals representing this project are 4 here tonight with the ordinance. 5 6 Councilmember Elstro moved to suspend the rules and advance Ordinance No. 81 - 1997 to second reading 7 and read by title only, second by Councilmember Welch and the motion was carried on a unanimous voice 8 vote. 9 0 The Clerk read Ordinance No. 81 - 1997 on second reading. 1 2 President Dickman declared Ordinance No. 81 - 1997 on public hearing. Speaking in favor of the ordinance 3 was Ron Cross, attorney for Friends Fellowship, who said there is no change in the project since it was 4 presented to Council June 23. He re-stated the reason for the ordinance, noting that it proposes a new 5 addition of approximately 75,000 square feet which will be a total new construction used primarly to house a 6 48-bed extended care facility for those with Alzheimers and other forms of senile dimentia. 7 8 Cross said the financing consists of an E.D.C. revenue bond and bonding of $8.35 million will be 9 underwritten by Bank One and by Bank One capital corporation which is now its national organization. He '0 said this is in no way impacting the tax rate of the City of Richmond, adding that the taxing power of the City '1 is not standing behind this in any way. He said bonds will be marketed on the secondary market available '2 through Bank One. '3 '4 Councilmember Hutton asked Jeff Baxter, administrator of Friend Fellowship, if he had made further contact '5 with the state about a stop light on U.S. 27 North. Baxter said he has had meetings with neighboring '6 businesses and now have a consensus on what they would like to approach the state with as well as seeking '7 a consultation with the City Engineer and they are about to approach the state again with a request for a 8 traffic signal very close to the entrance of Friends Fellowship. 9 .0 Bever mentioned that a slight amendment should be made to the ordinance, stating that Section 9 as it is .1 written is inapplicable to the City of Richmond. He said Section 9 should be deleted and Section 10 be :2 renumbered as Section 9. '8 '9 Ron Cross addressed the two issues that came out of the Plan Commission hearing, stating that they are :0 working with the state on the traffic count and he feels it is going to continue to be an issue. He said there a1 has also been discussion dealing with the concern of some of the neighbors in the Crestdale area about the 2 maintenance and surface water drainage in general but particularly the maintenance of a stream that runs t3 toward the south. He said a representative from the architectural firm and an independent engineer who has :4 worked on the surface drainage plan both testified at the Plan Commission and are in the audience tonight. 05 He said after they explained what has been done,the Plan Commission recommended approval. ,880 Common Council Minutes Cont'd July 7, 1007 Page 6 1 Councilmember Welch asked Cross to relate his position on noise and light intrusion and setbacks from the 2 property line. Cross said they are looking at a minimum of a 40-foot setback at the nearest point which 3 increases gradually to 100 feet from the property line. He said as far as the noise intrusion is concerred, 4 parking will be away from the residential area and the entrance is focused to the north. He added that t ere 5 will be some direct lighting but they do not anticipate any light or noise impact in the neighborhood. 6 7 There being no further comments for and none against the ordinance, Councilmember Allen moved for 8 engrossment, second by Councilmember Hutton and the motion was carried on a unanimous voice vote. 9 10 Councilmember Welch moved to suspend the rules and advance Oridnance No. 51 - 1997 to third and f nal 11 reading and read by title only, second by Councilmember Allen and the motion was carried on a unanimous 12 voice vote. 13 14 The Clerk read Ordinance No.51 -1997 on third reading. 15 16 Ordinance No.51 - 1997 was adopted on the following call of the roll: 17 18 Ayes: Elstro, Lundy, Wissel, Hutton, Allen, Stamper, Welch, Parker and Dickman (9) 19 Nays: None 20 21 ORDINANCE NO. 52-1997 22 23 The Clerk read Ordinance No. 52 - 1997 - A SPECIAL ORDINANCE VACATING THAT PORTION OF 24 NORTH 14TH STREET LOCATED NORTH OF NORTH "J"STREET 25 26 President Dickman declared Ordinance No.52- 1997 on public hearing. 27 28 Attorney Bob Delaney, representing the Penningtons, supplied Councilmembers with maps of the s all 29 piece of property measuring 66 feet by approximately 158 feet which is adjacent to the Pennington's 30 property. He said it is their hope and plan to expand their auto upholstery business in that area. He .Iso 31 noted that this piece of property has a little drainage ditch going through it so the vacation would need to be 32 subject to that sanitary ditch, which is fine with the Penningtons. He said the neighbors had been conta. ed 33 and had no opposition. In answer to a question about zoning by Councilmember Hutton, Delaney said is 34 zoned 0-1 which is Greenbelt. He said the Penningtons have their current business on North 18th Street out 35 North 15th Street is where they want to build their expansion. Delaney said the 0-1 zoning there is included 36 in a variance petition coming up Thursday night before the Plan Commission. He asked Larry C.sh, 37 assistant director of planning, permits and inspections,to come forward to substantiate that. 38 39 There being no comments either for or against Ordinance No. 52 - 1997, Councilmember Elstro moved for 40 engrossment, second by Councilmember Hutton and the motion was carried on a unanimous voice vote. 41 42 Councilmember Elstro moved to advance Ordinance No.52 - 1997 to third and final reading and read by itle 43 only, second by Councilmember Welch and the motion was carried on unanimous voice vote. 44 45 The Clerk read Ordinance No.52 - 1997 on third reading. 46 47 Ordinance No. 52- 1997 was adopted on the following call of the roll: 48 49 Ayes: Elstro, Lundy, Wissel, Hutton,Allen, Stamper, Welch, Parker and Dickman (9) 50 Nays: None 51 52 ORDINANCE NO.58-1997 53 54 The Clerk read Ordinance No. 58 - 1997 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 55 3209 UNION PIKE 56 57 President Dickman declared Ordinance No.58- 1997 on public hearing. 58 59 Attorney Bob Burton, speaking on behalf of petitioners Michael and Anna Lea Burns, said the propert, is 60 located about a quarter of a mile north of 1-70 on Union Plke and is approximately an acre and a half. He 61 said the property is zoned R-1, but has been used for commerchial uses for at least 60 years. He said he 62 Burns'are asking for the rezoning to be consistent with the actual use and they have no changes planned for 63 the property. Mike Burns explained he had purchased the property in the late 1980s and in talking ith 64 neighbors in the area determined that it has been the location of a fertilizer plant, a chicken hatch-ry, 65 Lincoln-Kaler candy company, and a Service Master franchise. She said four of those had called with some questions which she was able to answer. She said 54 they were invited to attend the meeting tonight, but none of them are in the audience. She said she had also 55 provided Councilmembers with a summary of what was required by the Environmental Protective Association 56 and the Indiana Department of Environmental Management and other changes which were made by staff , 57 request. He said now he has learned that the 15 state still owns South 37th Street and the City's hands are tied until the state turns it over to the City. He said 16 speeding still poses a big problem on South 37th Street and he would like to see Council put pressure on the 17 state or pass an ordinance so they would be able to control more of the City's destiny from a sa ety 18 standpoint. 19 20 Bever responded to the statement, explaining that the issue had come up at the July 3 Board of W rks 21 meeting, and on any state highway project, until it is completely finished and they turn the road over to he 22 City,the Board of Works cannot authorize any signage. He said because of what Councilmember Stamp r is 23 pointing out he is going to encourage the City Engineer and the Board of Works to try to get the stat to 24 speed up that process. He added that he thinks the Board of Works is prepared to authorize the place ent 25 of the stop sign but until the City has control, it cannot legally be done. Councilmember Parker stated tha he 26 understands all that, but asked what the state would do it we put a sign there, then answered his wn 27 question, saying that he felt the state probably would not even know it had been done. Bever said he c uld 28 not advise the City to do something illegal. 29 30 City Engineer Bob Wiwi stepped forward and commented that there is a scheduled pre-fnal on that pro ect 31 on July 16 and he anticipated that shortly thereafter the project will legally become a City street which w uld 32 correct this situation. 33 34 In answer to a question by Councilmember Allen about what surveying is taking place, Wiwi said that as 35 required of projects of this size and nature, the City prepares an as-built plan showing the actual featu es 36 that were constructed and that survey was completed Thursday and a set of as-built drawings are b 'ng 37 prepared for the state. 38 39 Councilmember Wissel announced the dates for the Committee of the Whole meetings to discuss the bud et 40 will be Wednesday, August 20, Thursday, August 21, Monday, August 25 and Tuesday, August 26.
