President Bob Dickman presided with the following Councilmembers present: Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Sarah "Sally" Hutton, Geneva 4 "Gene"Allen, Alan Stamper, Bing Welch and Larry Parker. The following business was had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 PRAYER BY COUNCILMEMBER PARKER 9 10 ROLL CALL 11 12 Nine present. 13 14 APPROVAL OF MINUTES OF MAY 5,1997 15 1 The minutes of the May 5, 1997 meeting were approved on a motion by Councilmember Hutton, second by 17 Councilmember Parker and was carried on a unanimous voice vote. 18 19 COMMUNICATIONS FROM THE MAYOR 20 21 City Controller Shelley Miller said she had distributed some information to Councilmembers which included 22 an update from the administrative team and communication from the Department of Transportation. 23 24 PRESENTATIONS OF REMONSTRANCES, PETITIONS, MEMORIALS OR PUBLIC COMMENTS 25 26 Councilmember Wissel introduced Jim Hiser, director of the Economic Development Corp., who announced 27 his game plan for the next three weeks, which is to meet as many elected officials as possible. He said he 28 will be contacting Councilmembers to schedule meetings with them three at a time because he is interested 29 in their thoughts and ideas of what EDC should be doing. 30 31 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 32 33 Included in the Council packets were the minutes of the meetings held April 24 and May 1, 1997. 34 35 REPORTS FROM CITY DEPARTMENTS 36 37 City Engineer Bob Wiwi reported that he had distributed to Councilmembers an update on the uptown 38 redevelopment project, commenting that he wanted to give them a brief overview of what is going on. He 39 said four major items are included in the project. The parking lot improvement, Phase 1, deals with the lot by 40 the Clarion-Leland Hotel, improvement of the North 6th Street parking lot and the lot south of 41 Elder--Beerman. He said work should begin this week on this phase. Going onto Phase 2, Wiwi said these 42 will be the improvements of the lots south of Bullerdick's, east of Kessler's Sport Shop and landscaping work 43 for all four lots. He said that work is out for bids and these are expected to be accepted June 5. Phase 3, 44 Wiwi said, is the major work in the project which is between 5th and 11th Streets, will be 90 percent 45 completed Friday and Cole & Associates will provide a plan for review:He said that bid will be made around 46 July 10. The other item, which is Phase 4, is the changing of 6th and 7th Streets to two-way. He said the 47 design is complete and it needs to get the approval of INDOT for the signal head changes and when that 48 happens the project can be put out for bids and awarded. He said also included in the outline he presented 49 to Councilmembers tonight are members of the current committees which have been appointed for this 50 project, noting they are made up of citizens and City employees. 51 52 REPORTS FROM SPECIAL COMMITTEES 53 54 REPORTS FROM STANDING COMMITTEES 55 56 REPORTS FROM ORGANIZATIONS 57 58 MISCELLANEOUS BUSINESS 59 60 ORDINANCES 61 62 ORDINANCES ON FIRST READING 63 64 Councilmember Elstro moved to suspend the rules and read Ordinances No. 48, 49, 50, 53, 54, 55 and 56- 65 1997 on first reading by title only, second by Councilmember Welch and the motion was carried on a unanimous voice vote. 5.2 Common Council Minutes Cont'd May 19, 1997 Page 2 1 ORDINANCE NO.48-1997 2 3 The Deputy Clerk read Ordinance No. 48 - 1997 - A SPECIAL ORDINANCE AMENDING THE ZONING 4 MAP AT 400 NORTH 10TH STREET AND 90 ELM PLACE 5 6 President Dickman announced Ordinance No. 48- 1997 would go to the Planning Commission. 7 8 ORDINANCE NO. 49-1997 9 10 The Deputy Clerk read Ordinance No. 49 - 1997 - A SPECIAL ORDINANCE AMENDING THE ZONING 11 MAP AT 2203 EAST MAIN STREET 12 13 President Dickman announced Ordinance No. 49- 1997 woud go to the Planning Commission. 14 15 ORDINANCE NO.50-1997 16 17 The Deputy Clerk read Ordinance No. 50 - 1997 - A SPECIAL ORDINANCE AMENDING THE ZONIN 18 MAP AT NORTH J STREET AT MAPLE ROAD AND ELM ROAD 19 20 In answer to a question by Councilmember Lundy, Bob Goodwin, director of planning and redevelopment 21 said that property belongs to B & M Properties, owned by Floyd A. Potter and Michael Eugene Potter, an 22 they are requesting a C-4 zoning classification. He said the master plan shows the area to be industrial an 23 has for years been a heavy commerical contractor area and that is their continued intent. He added that the 24 are getting ready to subdivide that entire area and change the roadways. 25 26 President Goodwin announced Ordinance No.50- 1997 would go to the Planning Commission. 27 28 ORDINANCE NO. 53-1997 29 30 The Deputy Clerk read Ordinance No. 53 - 1997-A GENERAL ORDINANCE ADDING A SECTION 150.0 31 (g)TO THE CITY OF RICHMOND CODE 32 33 Assistant City Attorney Steve Rabe explained this ordinance will amend the current City Code whic 34 requires permits for various construction and allowing activities within the City, noting this would amend the 35 Code so that other units of government would not have to pay a permit fee. He added that it would waive 36 permit fees,for instance, if the County was doing work on the County building or another unit of government 37 38 Councilmember Parker asked what brought about the need for this ordinance. Rabe said it was a reques 39 from the Planning Department and the thought behind it was that it did not make sense for one unit o 40 government to be taxing another unit of government with all the money coming from the taxpayers 41 Councilmember Welch asked if they would still have to get a permit and be inspected. Rabe answered thi- 42 only speaks to the waiving of the fees and they will still have to get the permit and be inspected. Bo• 43 Goodwin stated that this ordinance merely puts in writing that has been a fairly common practice for man 44 years. He said this ordinance will make it proper. 45 46 Councilmember Allen moved to suspend the rules and advance Ordinance No. 53 - 1997 to second readin• 47 and read by title only, second by Councilmember Stamper and the motion was carried on a unanimous voice 48 vote. 49 50 The Deputy Clerk read Ordinance No. 53- 1997 on second reading. 51 52 President Dickman declared Ordinance No. 53 - 1997 on public hearing. There being no comments eithe 53 for or against the ordinance, Councilmember Allen moved for engrossment, second by Councilmembe 54 Stamper and the motion was carried on a unanimous voice vote. 55 56 Councilmember Lundy moved to suspend the rules and advance Ordinance No. 53 - 1997 to third and fin.' 57 reading and read by title only, second by Councilmember Elstro and the motion was carried on a unanimou• 58 voice vote. 59 60 The Deputy Clerk read Ordinance No.53- 1997 on third reading. 61 62 Ordinance No. 53- 1997 was adopted on the following call of the roll: 63 64 Ayes: Elstro, Lundy, Wissel, Hutton,Allen, Stamper, Welch, Parker and Dickman (9) 65 Nays: None 353 Common Council Minutes Cont'd ORDINANCE NO.54-1997 The Deputy Clerk read Ordinance No. 54 - 1997 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Councilmember Stamper said this ordinance deals with a tax abatement for Cinram Corp. and is for a total of ., $2.5 million. President Dickman said this will come back on second reading. 1 n ORDINANCE NO.55-1997 1 1. The Deputy Clerk read Ordinance No. 55 - 1997 - AN APPROPRIATION ORDINANCE AMENDING THE 1 : 1997 BUDGET 1.? 1 City Controller Shelley Miller said Ordinances No. 55 - and 56 - 1997 deal with moving funds into the 1. appropriate accounts to deal with the expenditures included in getting the computer software in place for the 1 ' Richmond Police Department. She reminded Councilmembers that the City brought before them the 1 t• additional appropriation for CCDF for capital money that was appropriated originally in 1996 that is now 1^ available in 1997. She said Ordinance No. 55- 1997 deletes $11,500 from the City insurance in the Board of 20 Works General Fund and adds it to Computer Equipment and Ordinance No. 56- 1997 deletes$10,000 from 2 City Insurance and adds it to Computer Equipment in the Police Department General Fund. 2: 2. Councilmember Welch moved to suspend the rules and advance Ordinance No. 55 - 1997 to second reading 2' and read by title only, second by Councilmember Parker and the motion was carried on a unanimous voice 2 vote. 2 The Deputy Clerk read Ordinance No. 55 - 1997 on second reading. 2: 2:, President Dickman declared Ordinance No. 55 - 1997 on public hearing. Speaking in favor of the ordinance 3 was Police Chief Bill Shake who explained the background of the computer project and the upgrading of the 3 system. In answer to Councilmember Welch, Chief Shake said this is the computer operating system used 31 for the storing of criminal records, reports, stolen property files and the data sent to the FBI. He said the 3 : dictation system is separate and is currently operating. There being no further comments for the ordinance . 3, and none against, Councilmember Elstro moved for engrossment, second by Councilmember Lundy and the 3' motion was carried on a unanimous voice vote. 3. 3 Councilmember Elstro moved to suspend the rules and advance Ordinance No. 55 - 1997 to third and final 3: reading and read by title only, second by Councilmember Stamper and the motion was carried on a 3' unanimous voice vote. 41 4! Councilmember Wissel so moved, second by Councilmember Stamper and the motion was carries 12 on a unanimous voice vote. 13 14 ORDINANCE NO.37-1997 15 16 The Deputy Clerk read Ordinance No. 37 - 1997 - A GENERAL ORDINANCE AMENDING CHAPTER 151 17 OF THE CITY OF RICHMOND CODE 18 19 President Dickman declared Ordinance No.37- 1997 on public hearing. 20 21 Assistant City Attorney Steve Rabe explained that Councilmembers have the amended version of Ordinan - 22 No. 37 - 1997 as discussed in the Committee of the Whole meeting and it needs to be formally adopte. 23 before engrossment. He explained the amendment changes the City's fees to $5 from $25 for applican s 24 testing for electrical and HVAC licenses. Councilmember Elstro moved to amend the ordinance, second .� 25 Councilmember Welch and the motion was carried on a unanimous voice vote. 26 27 President Dickman announced Ordinance No. 37- 1997 on public hearing. He said the advantage is that the company does not have to stop its current 1 n production line and has more flexibility to try to get new clients. 1 1' President Dickman declared Ordinance No.46- 1997 on public hearing. Councilmember Wissel explained that the Advisory Planning Commission held a special meeting Thursday, 3: May 15, 1997 to consider the vacation. He said this is a petition made by the City of Richmond which is the 3-' owner of the property commonly known as the alley located between East Main Street and Sailor Street 3`, immediately west of 1014 East Main Street in Richmond. Bob Goodwin, acting as agent, requested vacation 3,, of this public place which is 10 feet wide and approximately 135 feet.
