President Bob Dickman presided with the following 3 Councilmembers present: Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Sarah "Sally" Hutton, Geneva 4 "Gene"Allen, Alan Stamper, Bing Welch and Larry Parker. The following business was had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 PRAYER BY COUNCILMEMBER ALLEN 9 0 ROLL CALL 1 2 Nine present. 3 4 APPROVAL OF MINUTES OF MARCH 17,1997 15 16 The minutes of the March 17, 1997 meeting were approved on a motion by Councilmember Hutton, second 17 by Councilmember Allen and was carried on a unanimous voice vote. 18 19 COMMUNICATIONS FROM THE MAYOR 1°1 PRESENTATIONS OF REMONSTRANCES, PETITIONS. MEMORIALS OR PUBLIC COMMENTS Mayor Dennis Andrews read a proclamation to Richmond's Lisa Shepherd who has been named Indiana's Miss Basketball. She accepted the proclamation making a few brief comments. b 6 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Included in the Council packets were the minutes of the meetings held March 6, 13 and 20, 1997. 3e REPORTS FROM CITY DEPARTMENTS 3 3• REPORTS FROM SPECIAL COMMITTEES 3a 3, REPORTS FROM STANDING COMMITTEES 3. 3. REPORTS FROM ORGANIZATIONS 3r 3: MISCELLANEOUS BUSINESS 3= 40 Councilmember Hutton announced the Gorge cleanup will be from 9 a.m. to noon this coming Saturday and 4 reminded Councilmembers of their commitment to clean their designated area on North West 5th Street 4' during the city-wide cleanup April 19. Councilmember Elstro said he feels Councilmembers should join the 4' Chamber of Commerce in helping clean the corridors of the City on that day and do their area at a later date. 4, They will meet at 9:30 a.m. at the Chamber office. 4 4. ORDINANCES 4 4 ORDINANCES ON FIRST READING 4° 50 Councilmember Elstro moved to suspend the rules and read Ordinances No. 30, 31, 32, 33, and 34 - 1997 5 on first reading by title only, and Ordinance No. 35 - 1997 in its entirety, second by Councilmember Lundy 5 and the motion was carried on a unanimous voice vote. 5 54 ORDINANCE NO.30-1997 5 5. The Clerk read Ordinance No. 30- 1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A 5 STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 5: 6-1.1-12.1 5" 60 Councilmember Stamper said this ordinance is for Vandor which is creating 20 new jobs and retaining 70. 6 He said part of the project is to expand which includes new docks and new parking. President Dickman 6. stated this ordinance will come back on second reading. 6 6, ORDINANCE NO.31 -1997 6 The Clerk read Ordinance No.20- 1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 Common Council Minutes Cont'd April 7, 1997 Page 2 1 Councilmember Stamper said this ordinance pertains to Carlos Casket Shell Inc. at 1501 South 8th St eet 2 which will create one new job and retain 115. He said he will have more details later, noting the company will 3 be adding manufacturing equipment as well as a facility. President Dickman said it will come bac on 4 second reading. 5 6 ORDINANCE NO.32-1997 7 8 The Clerk read Ordinance No.26-1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL F A 9 STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 10 6-1.1-12.1 11 12 Councilmember Stamper explained this ordinance pertains to Elder Davis which is adding 5 new jobs nd 13 retaining 112 and they are looking at assembly equipment for their facility on Industries Road. Presi ent 14 Dickman said it will come back on second reading. 15 16 ORDINANCE NO.33-1997 17 18 The Clerk read Ordinance No.33- 1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A 19 STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 20 6-1.1-12.1 21 22 Councilmember Stamper said this ordinance is also for Elder Davis seeking to add dock doors and park ng. 23 President Dickman said it will come back on second reading. 24 25 ORDINANCE NO.34-1997 26 27 The Clerk read Ordinance No.34- 1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL 0 A 28 STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 29 6-1.1-12.1 30 31 Councilmember Stamper said this ordinance pertains to Richmond Center LLC at 1050 Industries Road 32 seeking to add dock doors,gutter system, heating system and electrical system. The estimated new valu'- is 33 $500,000 and will create 30 new jobs and retain 180. President Dickman said it will come back on second 34 reading. 35 36 ORDINANCE NO.35-1997 37 38 The Clerk read Ordinance No. 35 - 1997- AN APPROPRIATION ORDINANCE AUTHORIZING THE C TY 39 OF RICHMOND,TO RECEIVE A DONATION 40 41 "WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific 42 purpose;and 43 44 "WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of s ch 45 property for the intended purpose. 46 47 "NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond Indiana, that all 48 donations during the calendar year 1997 for the following Parks and Recreation programs shall be gratef Ily 49 acknowledged by the citizens of Richmond: 50 51 "Gorge Clean up; March for Parks; Arbor Day; Sizzling Summer 5K; Family Outdoor Movie Series; Y uth 52 Challenges; Pool Theme Parties; Rose Festival 5K; J.U.K.O.; Kids Kamp; Pre-School Prograns; 53 Sports/Fitness Festival;Jr./Adult Golf Tournament; Fishing Tournaments; Reservoir Operations; Family Fun 54 Festival; Fright Night; Haunted Forest;Celebration of Lights; Flower/Garden Classes;and Junior Rangers" 55 56 Councilmember Hutton moved to suspend the rules and advance Ordinance No. 35 - 1997 to second 57 reading and read by title only, second by Cfouncilmember Allen and the motion was carried on a unanim us 58 voice vote. 59 60 The Clerk read Ordinance No.35 - 1997 on second reading. 61 62 President Dickman declared Ordinance No.35- 1997 on public hearing. 63 64 Speaking in favor of the ordinance was Stan Lambert, superintendent of Parks & Recreation, ho 65 recommended approval saying it will enable the department to provide a higher quality of service to i he community. Common Council Minutes Cont'd April-7, 1097 Page 3 1 Councilmember Welch asked Lambert if he had a list of contributors who provided funds, materials or prizes 2 for these activities. Lambert said they started collecting that information and had given Councilmembers 3 copies of it last year. He added that they had just completed the last six month data and will get that 4 information and details of all donations and sponsorships received to Councilmembers. Councilmember 5 Welch suggested that he would like to see that list filed with the ordinance and also given to the news media. 6 Hearing no further comments for and none against the ordinance, Councilmember Elstro moved for 7 engrossment,second by Councilmember Hutton and the motion was carried on a unanimous voice vote. 8 9 Councilmember Allen moved to suspend the rules and advance Ordinance No. 35 - 1997 to third and final 0 reading and read by title only, second by Councilmember Welch and the motion was carried on a unanimous 1 voice vote. 2 3 The Clerk read Ordinance No.35-1997 on third reading. 4 5 Ordinance No.35-1997 was adopted on the following call of the roll: 6 7 Ayes: Elstro, Lundy,Wissel, Hutton,Allen, Stamper,Welch, Parker and Dickman (9) 8 Nays: None 9 0 ORDINANCES ON SECOND READING 1 2 ORDINANCE NO.20-1997 3 4 The Clerk read Ordinance No.20- 1997-A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 609 5 NORTHWEST"L"STREET 67 Councilmember Wissel explained that the Plan Commission had met and the petitioner Michael Foust, 8 represented by Attorney Ron Cross, asked to rezone from an R-2 one family residential district to a C-4 9 general business district located at 609 North West L Street. He said the Commission voted 9-0 in favor with 0 2 absent. 1 2 President Dickman declared Ordinance No.20- 1997 on public hearing. 3 4 Speaking in favor of the ordinance was Ron Cross who provided a photo of the 3.8 acre parcel in question. 5 He said Foust wants to build a garden and lawn retail outlet and have a site for the cultivation and growing of 6 plants which means constructing a 24- by 48-foot building for retail customer contact and a 24- by 64-foot 7 greenhouse at the rear of the lot. Cross said Foust plans to build a privacy fence along the western 8 boundary, adding that he had two petitions signed by people throughout the neighborhood. Councilmember 9 Welch asked about Foust's garden center now and Cross said that will be relocated to this site, adding that 0 there will be screening to the east in the form of scrubbery. He said Foust as a vested interest in securing the 1 premises. In answer to a question by Councilmember Parker, Cross said the exit will be off North West L •2 Street. There being no further comments for the ordinance and none against, Councilmember Allen moved •3 for engrossment, second by Councilmember Hutton and the motion was carried on a unanimous voice vote. •4 •5 Councilmember Hutton moved to suspend the rules and advance Ordinance No. 20 - 1997 to third and final 6 reading and read by title only, second by Councilmember Allen and the motion was carried on a unanimous .7 voice vote. •8 •9 The Clerk read Ordinance No.20- 1997 on third reading. '•0 1 Ordinance No.20-1997 was adopted on the following call of the roll: '.2 3 Ayes: Elstro, Lundy,Wissel,Hutton,Allen, Stamper,Welch, Parker and Dickman (9) 4 Nays: None 5 •6 ORDINANCE NO.24-1997 .7 8 The Clerk read Ordinance No. 24 - 1997 - A SPECIAL ORDINANCE VACATING A PUBLIC PLACE •9 DESCRIBED AS PART OF LOTS 1,2, AND 3 OF MADDEN SUBDIVISION AND PART OF VACATED I/ .0 RANDOLPH STREET AND PART OF 10 FEET OF VACATED ALLEY •1 .2 Councilmember Wissel said the City has waived any interest in acquiring a portion of this vacated property, .3 noting that Emily Stone spoke on behalf of the First Church of God and Catherine Stevens-Jacobson at the •4 Plan Commission. He said the Commission determined the land was of no use to the city or local utilities and «5 recommended the vacation be granted subject to the recipients providing an access and maintaining an easement to the existing RP &L and sanitary facilities.The Commission voted 9-0 in favor with 2 absent. 32 Common Council Minutes Cont'd April 7, 1997 gage-4 1 President Dickman declared Ordinance No.24- 1997 on public hearing. 2 3 Speaking in favor of the ordinance was Emily Stone who said they had been mowing and caring for the rea 4 trying to keep teenagers out of it for fear they might abuse the property. She said the church already ha the 5 front portion for its parking lot and the residents park in the back. There being no further comments fo the 6 ordinance and none against, Councilmember Wissel moved for engrossment, second by Councilme ber 7 Hutton and the motion was carried on a unanimous voice vote. 8 9 Councilmember Elstro moved to suspend the rules and advance Ordinance No. 24 - 1997 to third and inal 10 reading and read by title only, second by Councilmember Parker and the motion was carried n a 11 unanimous voice vote. 12 13 The Clerk read Ordinance No.24-1997 on third reading. 14 15 Ordinance No.24- 1997 was adopted on the following call of the roll: 16 17 Ayes:Elstro, Lundy,Wissel, Hutton,Allen, Stamper,Welch, Parker and Dickman (9) 18 Nays: None 19 20 ORDINANCE NO. 25-1997 21 22 The Clerk read Ordinance No. 25 - 1997 -A SPECIAL ORDINANCE VACATING THE EAST/WEST AL EY 23 RUNNING EAST FROM SOUTHWEST 15TH STREET BETWEEN LOTS 89 AND 90 IN EARL AM 24 HEIGHTS ADDITION TO THE EAST WHERE IT INTERSECTS WITH A NORTH/SOUTH ALLEY 25 26 Councilmember Wissel explained that Charles Castle and Barbara J. Davis are the petitioners nd 27 represented by Attorney John Sayre. He said the Plan Commission voted 9-0 in favor with 2 absent. Syre 28 stepped forward and spoke in favor of the ordinance, commenting that it is unusable and has never been 29 developed. 30 31 President Dickman declared Ordinance No. 25 - 1997 on public hearing. There being no further comm-nts 32 for the ordinance and none against, Councilmember Elstro moved for engrossment, second by 33 Councilmember Allen and the motion was carried on a unanimous voice vote. 34 35 Councilmember Allen moved to suspend the rules and advance Ordinance No. 25 - 1997 to third and final 36 reading and read by title only, second by Councilmember Parker and the motion was carried o a 37 unanimous voice vote. 38 39 The Clerk read Ordinance No.25-1997 on third reading. 40 41 Ordinance No.25- 1997 was adopted on the following call of the roll: 42 43 Ayes: Elstro, Lundy, Wissel, Hutton,Allen, Stamper, Welch, Parker and Dickman (9) 44 Nays:None 45 46 ORDINANCE NO.26-1997 47 48 The Clerk read Ordinance No.26- 1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL 0 A 49 STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER .C. 50 6-1.1-12.1 51 52 Councilmember Stamper explained David and Sharon Karn are creating 7 new jobs and investing $350,!00 53 building a new structure for an auto repair shop at their facility on North West L Street. 54 55 President Dickman declared Ordinance No. 26- 1997 on public hearing.There being no comments eithe for 56 or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember A len 57 and the motion was carried on a unanimous voice vote. 58 59 Councilmember Allen moved to suspend the rules and advance Ordinance No. 26 - 1997 to third and final 60 reading and read by title only, second by Councilmember Wissel and the motion was carried o a 61 unanimous voice vote. 62 _ 63 The Clerk read Ordinance No.26 -1997 on third reading. 64 65 Ordinance No.26- 1997 was adopted on the following call of the roll: Ayes: Elstro, Lundy, Wissel, Hutton,Allen, Stamper, Welch and Parker(9) Nays: 2 33 Common Council Minutes Cont'd April 7. 1997 Page 5 1 ORDINANCE NO.27-1997 2 3 The clerk read Ordinance No.27- 1997-A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A 4 STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 5 6-1.1-12.1 6 7 Councilmember Stamper explained that this is the second request for David and Sharon Karn who will be 8 investing$350,000 in a 10,000 square foot facility addition at 511 Industrial Parkway creating 5 new jobs and 9 retaining 13.There being no comments either for or against, Councilmember Elstro moved for engrossment, 10 second by Councilmember Welch and the motion was carried on a unanimous voice vote. 11 12 Councilmember Allen moved to suspend the rules and advance Ordinance No. 27- 1997 to third and final 13 reading and read by title only, second by Councilmember Elstro and the motion was carried on a unanimous 14 voice vote. 15 16 The Clerk read Ordinance No.27- 1997 on third reading. 17 18 Ordinance No.27-1997 was adopted on the following call of the roll: 19 20 Ayes: Elstro, Lundy,Wissel, Hutton,Allen,Stamper,Welch,Parker and Dickman (9) 21 Nays: None 22 23 ORDINANCES ON THIRD READING 24 25 There were none. 26 27 UNFINISHED BUSINESS 28 29 Councilmember Stamper asked Mayor Andrews when South 37th Street would be open and the Mayor 30 answered that the question should be posed to the City Engineer Bob Wiwi.
