Monday, • February 3, 1997, in the Council Chambers in said City. President Bob Dickman presided with the following Councilmembers present: Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Sarah "Sally" Hutton, Geneva • "Gene"Allen, Alan Stamper, Bing Welch and Larry Parker. The following business was had to-wit: • PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER ELSTRO 1 ROLL CALL 1 1' Nine present. 1: 1, Councilmember Hutton moved to open the agenda and add Ordinance No. 3 - 1997 on second reading, 1 second by Councilmember Parker and the motion was carried on a unanimous voice vote. 1° 17 APPROVAL OF MINUTES OF JANUARY 21.1997 1: 1 Councilmember Elstro moved to amend the minutes of January 21, 1997, incorporating the two changes 2$ made by the Clerk, second by Councilmember Lundy and the motion was carried on a unanimous voice 21 vote. Councilmember Hutton moved to approve the amended minutes,second by Councilmember Elstro and 2' the motion was carried on a unanimous voice vote. 2 2• COMMUNICATIONS FROM THE MAYOR 2. 2. Mayor Dennis Andrews outlined the 1997 priorities and goals for the City Administration. These goals in their 27 entirety are on file in the Clerk's office. The areas of work, the Mayor said, will be displayed in the Board of 2: Works room. They include Community Partnerships, Human Resources Office, Human Rights Office, Fire 2° Department, Police Department, Parks Department, Planning Department, Sanitary Department, Public 30 Works, Street Division, Law Department and Finance Department. 3� 3 He said in 1997 a new focus and energy is expected from the Main Street organization, UEA and Leadership 3 Wayne County and the Housing Authority in anticipation of joining to pursue a grant to update the City's 3� Comprehensive Housing Plan. 3. 3 He said there will be new plans taking shape for the Depot Building, the YMCA Building, the Atlas Building 3 and others. Also, he sees the Neighborhood Associations continuing to play a vital role in promoting a 3 renewed sense of community throughout Richmond. 3 4 Changes in 1997 will include construction and activity on many fronts such as the Northwest Industrial Park 4 and the uptown redevelopment. He also mentioned changes on the second floor of the City Building which 4 include the Second Congressional District Office for Congressman McIntosh located directl across from the 4 City Clerk's office, the relocation of the information desk to the Community Partnerships Office, and the considering of the commissioning for a pictorial history of Richmond to be displayed in the rotunda area after 4 physical removal of the information desk. 4 47 Councilmember Elstro commented on the sale of the house the City owned located on South 7th Street, 4: noting that it had brought a nice price, then commenting that he would like to see the remaining properties 4° owned by the City to be disposed of in that fashion so they could be placed back on the tax roles. 50 5 PRESENTATIONS OF REMONSTRANCES. MEMORIALS OR PUBLIC COMMENTS 5 5 RESOLUTION NO.3-1997 5, 5 President Dickman asked the Clerk to read Resolution No.3- 1997 50 5` "WHEREAS,Gertrude Luckhardt"Lucky"Ward was born May 27, 1923 in Mount Vernon, New York;and 5: 5° "WHEREAS, She graduated from Mount Holyoke College with an undergraduate degree in zoology;and 60 6 "WHEREAS, She earned a Ph.D in entomology from Purdue University;and 6 6 "WHEREAS, She moved to Wayne County in 1946;and 6, 6' 'WHEREAS, She worked at Joseph Moore Museum for 40 years;and BOS Common Council Minutes Cont'd February 3, 1997 Page 2 1 "WHEREAS, She taught in the ciologydepartment and was named an emeritusprofessor of biology at 9 P 9Y 2 Earlham College; and 3 4 "WHEREAS, She was a member of West Richmond Friends Meeting, Historic Centerville, the Indi.na 5 Academy of Science,the Historic Landmarks Foundation of Indiana and many other local organizations;a d 6 7 "WHEREAS, She was the author of several books about Wayne County, including "Richmond, A Picto ial 8 History";and 9 10 "WHEREAS,She founded Neighborhood Preservation Services; and 11 12 "WHEREAS, She was known throughout Wayne County as a biologist, a conservationist, a wildlife resc er, 13 a historian, and a preservationist;and 14 15 "WHEREAS, Lucky Ward passed away on MOnday,January 13, 1997 at her Wayne County home. 16 17 "NOW, THEREFORE, be it resolved by the Common Council of the City of Richmond, Indiana that he 18 contreibutions of Lucky Ward to the City of Richmond, Indiana and the surrounding area are herby 19 gratefully acknowledged and fondly remembered." 20 21 Councilmember Hutton moved to accept the resolution, second by Councilmember Elstro and the motion 22 was carried on a unanimous voice vote. 23 24 VACATION PETITION NO.2-1997 25 26 The Clerk read Vacation Petition No. 2 - 1997-A PETITION TO VACATE THE ALLEY BETWEEN SOU H 27 15TH STREET AND SOUTH 16TH STREET ALONG THE NORTH SIDE OF LOTS 14 AND 27 A D 28 ADJOINING LOT 14 AND PART OF LOT 15 ON THE EAST, AND ADJOINING LOT 27 AND PART OF L T 29 28 ON THE WEST. 30 31 President Dickman asked for comments and Councilmember Welch said he questioned as to whether or of 32 the direction was correct. It was discovered the Councilmembers did not have a copy of the revis d 33 directions but would address that and propose amendments when they discussed Ordinance No. 4 - 19s7 34 which is related to Vacation Petition No.2- 1997. He asked the Clerk to make copies for each Councilmember and put them in th-ir 53 packets for the next meeting. 54 55 Councilmember Hutton moved to appoint John Rusie of West End Savings Bank to replace Debor.h 56 Jenkins on the Redevelopment Commission, second by Councilmember Wissel and the motion was carri-d 57 on a unanimous voice vote. Councilmember Hutton moved to reappoint President Dickman to t e 58 Redevelopment Commissionn,second by Councilmember Allen and the motion was carried on a unanimo s 59 voice vote. 60 61 ORDINANCES 62 63 ORDINANCES ON FIRST READING 64 65 Councilmember Hutton moved to suspend the rules and read Ordinances No. 13 and 14 - 1997 on fist reading by title only, second by Councilmember Elstro and the motion was carried on a unanimous voi e vote. o Common Council Minutes Cont'd February-3,-1- 07 P-age-3 1 ORDINANCE NO.13-1997 2 3 The Clerk read Ordinance No. 13 - 1997 -A SPECIAL ORDINANCE ESTABLISHING A NON-REVERTING 4 FUND FOR ECONOMIC DEVELOPMENT COMMISSION FEES 5 6 Assistant City Attorney Steve Rabe explained that last year this Council restablished the Economic 7 Development Commission which assists with the issuance of industrial revenue bonds in the City and the 8 ordinance establishes a non-reverting fund. He said the Richmond Economic Development Commission did 9 pass a resolution authorizing a fee to be collected from applicants for industrial revenue bonds and this 10 non-reverting fund would handle the collection and disbursement of those fees. 11 12 In answer to a question asked by Councilmember Parker, Rabe said there is a flat fee of $500 and a 13 percentage which is capped at a maximum set by state code which he believes is about$10,000. He said the 14 fees will include those charged by the attorney and printing and the remaining funds would go into the City's 15 general fund. 16 17 Councilmember Hutton moved to suspend the rules and advance Ordinance No. 13- 1997 to second reading 18 and read by title only, second by Councilmember Elstro and the motion was carried on a unanimous voice 19 vote. 20 21 The Clerk read Ordinance No. 13- 1997 on second reading. 22 1 3 President Dickman declared Ordinance No. 13- 1997 on public hearing.There being no comments either for /� 4 or against the ordinance, Councilmember Elstro moved for engrossment, second by Councilmember Welch 5 and the motion was carried on a unanimous voice vote. 6 7 Councilmember Lundy moved to suspend the rules and advance Ordinance No. 13 - 1997 to third and final 8 reading and read by title only, second by Councilmember Welch and the motion was carried on a unanimous 9 voice vote. 0 1 Ordinance No. 13-1997 was adopted on the following call of the roll: 12 33 Ayes: Elstro, Lundy,Wissel, Hutton,Allen, Stamper,Welch, Parker and Dickman (9) 3�4 Nays: None. 315 3:6 ORDINANCE NO.14-1997 317 38 The Clerk read Ordinance No. 14 - 1997 - AN APPROPRIATION ORDINANCE AMENDING THE 1997 t3 BUDGET j, 1 Jeff Lamberson, operations manager at the airport, explained this ordinance approves a transfer from aviation fuel to motor equipment for the purpose of purchasing a snow blower desperately needed at the 4 airport. He distributed information about the snow blower to Councilmembers. President Dickman said the Airport Board is excited about this purchase because the equipment carries a price tag of $200,000 if purchased new and the City is getting it for$9,000 through the government surplus program. Councilmember Wissel explain-d 31 that the Planning Commission met January 28 and voted 9-0 to recommend passage, with two memb=rs 32 absent. 33 34 Speaking in favor of the ordinance was Robert Burton,the attorney for the petitioner,who noted the prope y 35 is located at the far western edge of the fringe area on the west side of the NATCO property and is one a•re 36 owned by Rhett Baumgartner. He said it is zoned M-2 industrial and this zoning change asks for an 2 37 special use for a medical office building which will be used by Dr. William Rheuble who currently has is 38 office in Centerville. Mendenh II 64 to withdraw the zoning petition, requesting a substitution of a beauty salon/tanning salon business for t e 65 existing hardware business. He said the petition will be submitted to the Board of Zoning Appeals at is February 13 meeting. Common Council Minutes Cont'd February 3, 1997 Rage-5 1 Councilmember Hutton moved to strike Ordinance No. 2 - 1997, second by Councilmember Lundy and the 2 motion was carried on a unanimous voice vote. 3 4 ORDINANCE NO. 3-1997 5 6 The Clerk read Ordinance No. 3 - 1997 - A SPECIAL ORDINANCE VACATING THE ALLEY EXTENDING 7 FROM NORTH 10TH STREET 221.6 FEET TO THE WEST LINE OF LOT 41, SARAH SANDER'S 8 ADDITION IN THE RECTANGULAR BLOCK BOUNDED BY NORTH G STREET AND NORTH H STREET 9 LOCATION 10 11 Councilmember Hutton moved to strike Ordinance No. 3 - 1997, second by Councilmember Welch and the 1 motion was carried on a unanimous voice vote. 1 1 ORDINANCE NO. 4-1997 1 1 The Clerk read Ordinance No. 4 - 1997 - A SPECIAL ORDINANCE VACATING THE ALLEY BETWEEN 17 SOUTH 15TH STREET AND SOUTH 16TH STREET ALONG THE NORTH SIDE OF LOTS 14 AND 27 AND 18 ADJOINING LOT 27 AND PART OF LOT 28 ON THE WEST 19 0 Councilmember Hutton moved to amend Ordinance No. 4 - 1997, substituting the direction of south for north,second by Councilmember Allen and the motion was carried on a unanimous voice vote. Councilmember Wissel said this had been discussing at the Planning Commission January 28 and it has to 2, do with vacating undeveloped alleyways on the parking lot of First Friends Meetinghouse and the 2. Commission was strongly in favor of the ordinance. 2. 2r After some discussion about the wording, Councilmember Hutton also moved to strike the last few words 2: following "part of lot 28 on the west," second by Councilmember Allen and the motion was carried on a 2: unanimous voice vote. 3, 3 President Dickman declared Ordinance No. 4- 1997 on public hearing. In response, Goodwin said it 4' would be pure speculation on his part, but the alleys have never been built and he suspects they had been 4: vacated but there are no records to prove that. He noted that the structure is built on the right of way and this 4 needs to be done to clear the title because documentation is needed to show the vacation. Otherwise, he 4• said,there would be a cloud on the title if there is no documentation. STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 5r 6-1.1-12.1 5: 5: Councilmember Stamper explained Marion and Ella Cummins were asking for a tax abatement to build a 60 5,000 square foot addition to their business which would mean four new jobs and a $100,000 investment in 6 the Richmond community. He said they are doign this to expand both the electrical and electronics part of 6' their business. 6: 6, President Dickman declared Ordinance No. 9 - 1997 on public hearing. He said the portion adopted by Council is 5 North West 5th and Main Street to Indiana Avenue and cleanup should be four times a year. He said the 6 Street Department may now go ahead and place the sign in that area designating it as the one covered by Council. In answer to a question by Councilmember Allen as to when they were going to start, r: Councilmember Elstro commented that a Citywide cleanup is planned and Councilmember Hutton said that • date is April 19. It was agreed that should be the first outing for the Council in their cleanup efforts of their 1• designated area. 11 1'r President Dickman announced that Clerk Schroeder had told him she had received complaints about paper 1c shuffling by Councilmembers from TV viewers and asked Councilmembers to be more aware of that during 1, the meeting. 1'• 1[.
