President Geneva "Gene"Allen presided with the following Councilmembers present: Howard "Jack" Elstro, Bruce Wissel, Sarah "Sally" Hutton, Bob Dickman, Alan Stamper, Bing Welch and Larry Parker. Absent was Etta Lundy. The following business was had to-wit: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER ELSTRO 10 1 I ROLL CALL, 1- 1 Eight present. 1, 1- APPROVAL OF MINUTES OF NOVEMBER 18.1996 1: 1 Councilmember Wissel moved to approve the minutes of November 18, 1996, second by Councilmember 1: Hutton and the motion was carried on a unanimous voice vote. 1' 2. COMMUNICATIONS FROM THE MAYOR 21 2- City Controller Shelley Miller said it had been a busy month, noting that the field work for the 1995 audit had 2 been completed by the State Board of Accounts and they will be moving toward the report stage in February 2, or March of 1997. She stated that she would be going before the State Board of Tax Commissioners within 2- the next week, noting that all documentation on the 1997 budget is to be submitted by Wednesday, 2: December 4, and the hearing for the 1997 budget will be held on December 10. 2 2: In addition, Miller said, it has been a fairly successful year for the City, although difficult. She stated that is 2' due to the diligent management from many of the department heads who have absorbed a lot of unexpected 3, expenses as well. She said the City went into 1996 with about $180,000 in bills owed to RP & L and that 31 account has been caught up which means heading into 1997 with a clean slate. She said she has worked 3- toward building a reserve for police and fire pensions and will go into 1997 with some reserves. She noted 3 that she has been working with a student intern from IUPUI who has been contacting second class cities, 3, state budget agencies and other resources that he can find available. He hopes to come up with some 3- recommendations about what can be done to establish and build upon that reserve to help contain the 3: liability that the City will be experiencing in future years for the police and fire pensions prior to the 1977 3 P.E.R.F. She said she is also wanting to build a reserve in the health fund, noting that the City has had a 3: couple of bad histories during the claim process in the past two years making it impossible to build a reserve. 3'' But,she added,this year some amount of reserve toward that fund will be carried into 1997. 4I 41 44 President Allen recognized Boy Scout Troops 100 and 119 in the audience tonight. She noted that they had 4 been invited by President Parker during the RP & L Board meeting to come forward and introduce 4 themselves. John Iverson, who was late in arriving, introduced himself stating that he was chaperoning 4 tonight. 4 4 PRESENTATIONS OF REMONSTRANCES.PETITIONS. MEMORIALS OR PUBLIC COMMENTS 4 4 501 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 51 5 Minutes of the November 7 and 14 meetings were distributed to Councilmembers in their packets. 53 5 REPORTS FROM CITY DEPARTMENTS 5 56 571 REPORTS FROM SPECIAL COMMITTEES 58 I 599 President Allen stated that she had attended the audit interview with the State Board of Accounts, adding 60 that she felt the current administration is doing everything in its power to carry on with the resources it has. 61 She said she feels the City is going to have a good audit and was pleased with the comments she heard. 6 63 REPORTS FROM STANDING COMMITTEES 6, 65 REPORTS FROM ORGANIZATIONS • Common Council Minutes Cont'd December 2, 1996 Page 2 1 MISCELLANEOUS BUSINESS 2 3 President Allen announced the expiration of the terms of three members of the Enterprise Zone Board Df 4 Directors, which means that new appointments will have to be made by Council. The three are Sue Morris, 5 Paul Allen and Ira Carter. Councilmember Hutton said the three had said they would like to stay on the 6 Board and she moved to reappoint all three for four-year terms,second by Councilmember Dickman and th e 7 motion was carried on a unanimous voice vote. 8 9 Commenting that she had received the application for the Adopt-A-Street project, President Allen said sh e 10 had filled it out and was handing the information over to Councilmember Elstro to follow through, noting th t 11 there are other requirements which have to be met before Councilmembers are able to be official adoptees 12 13 President Allen also noted that Ordinance No. 116 - 1996 should be moved from first reading to seco d 14 reading on tonight's agenda. 15 16 ORDINANCES 17 18 ORDINANCES ON FIRST READING 19 20 Councilmember Elstro moved to suspend the rules and read Ordinances 124, 125, 126, 127, 128, 129, 150 21 and 132- 1996 on first reading by title only, second by Councilmember Wissel and the motion was carried 22 on a unanimous voice vote. 23 24 ORDINANCE NO. 124-1996 25 26 The Clerk read Ordinance No. 124 - 1996 - AN APPROPRIATION ORDINANCE AMENDING THE 19£6 27 BUDGET 28 29 Stan Lambert, superintendent of Parks& Recreation, explained that this ordinance transfers funds from th e 30 1000 to the 2000 category to be used to purchase floral supplies which were cut from the 1997 budget. 31 32 Councilmember Elstro moved to suspend the rules and advance Ordinance No. 124 - 1996 to secor d 33 reading and read by title only, second by Councilmember Hutton and the motion was carried on a 34 unanimous voice vote. 35 36 The Clerk read Ordinance No. 124-1996 on second reading. 37 38 President Allen declared Ordinance No. 124- 1996 on public hearing. This 62 estimated new value, he said, is$50,000. His question to the Councilmembers was,since this is the second 63 request for the same process and deals with upgrading what has been done before, do they wish to act 64 upon the ordinance tonight and adopt it. It was agreed that since the company did not request quick action 65 and there seemed to be no urgency that the ordinance be held on first reading. It is also to cover final expenses, he said, that 4b came about at the end of last year for the reorganization process in getting the final documents ready for the report that was generated. Councilmember Parker asked what the cost was for the consulting service and Lambert estimated it was about$8,000. c 4° Councilmember Dickman moved to suspend the rules and advance Ordinance No. 126 - 1996 to second 4. reading and read by title only, second by Councilmember Welch and the motion was carried on a unanimous 4 voice vote. 4: 4! L 4 PARKING PERMIT AREA 5 6 Assistant City Attorney Steve Rabe explained that this ordinance establishes a two-hour restricted park g 7 permit area on South West 3rd Street. He said a hearing was held by the Board of Works and it as 8 recommended that Council approve this ordinance. Councilmember Hutton said this ordinance is a resul of 9 her request on behalf of several homeowners who asked for this last year and it was denied.She said thi is 10 only for the south half of South West 3rd Street from 431 South West 3rd Street to South West E. He said it provides for an exception for maintenance vehicles, servi•: 43 vehicles and non-occupant landlords so they will be able to work on their properties without being tickete1. 44 Rabe said this has been a past practice by the Richmond Police Department which tries not to ticket the if 45 they know who they are. He added that this ordinance merely formalizes that procedure. 46 47 Councilmember Dickman commented that these vehicles do have to have a sticker, and Rabe said they ill 48 be issued upon request. Councilmember Hutton questioned as to why the landlord would not have to buy a 49 ticket when the residents are required to. She said when she first came to Council during the initial stages of the budget process, the City pledged to reduce the 1996 budget by $302,355 and this ordinance is for $273,425. Pa R 6 • 1 ORDINANCES ON SECOND READING 2 3 ORDINANCE NO.110-1996 4 5 The Clerk read Ordinance No. 110- 1996-A SPECIAL ORDINANCE AMENDING THE ZONING MAP F R 6 REAL ESTATE AT LOT 42 SS, IN THE 900 BLOCK OF NORTH H STREET 7 8 Councilmember Wissel explained that the Plan Commission met November 26 to consider this ordina ce 9 which is a request for a rezoning from an R-3 one- to eight-family residence district to a C-4 gen ral 10 business district. He said this property is to the west of the old Hook's Drug Store which burned sev ral 11 months ago. He said the vote was 8 in favor with one absent to amend the ordinance to read a rezo ing 12 from an R-3 to a C-2 commercial district instead of a C-4 and the commission recommended passage of the 13 amendment. 14 15 In answer to a question by Councilmember Elstro as to what the plans are for the location, Councilmem er 16 Wissel said no specific plans were announced, however, the owners have been unsuccessful in fin ing 17 someone to buy or lease the site and the rezoning had been requested to make it more available to m re 18 enterprise. He said when he asked what the reasoning was behind it,they 0 explained that there had been a fire over the weekend caused by defective wiring which blew a transformer 1 in the basement area under the press room. He said he was glad to hear them say that the response time of 2 the fire and police departments was excellent at 2 a.m.and they took care of things in a courteous manner. 3 4 Councilmember Stamper asked Shelley Miller if she could give Council an audit of the funds received relative 5 to the fee that is now charged for a tax abatment and explain where those funds are and what part of that 6 would be available to set up a permanent system to be able to account for those tax abatements so that 7 whoever does this job next year could hopefully benefit from what we have done this year. 8 9 After a brief discussion about the appointments to Boards and Committee made by Council, it was agreed 0 that the subject of appointments should be brought up at one meeting and not acted upon until the next 411 meeting.
