The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday,June 17 1996, in the Council Chambers in said City. Vice President Robert Dickman presided with the following Councilmembers present: Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Alan Stamper, Bing Welch and Larry Parker. Absent were President Geneva "Gene"Allen and Councilmember Sarah "Sally" Hutton. The following business was had to-wit: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILMEMBER PARKER 1. 1 ROLL CALL 1' 1: Seven members were present. Vice President Dickman explained that President Allen was in Atlanta, Ga.at 1 the annual RP & L conference and Councilmember Hutton had been in attendance earlier but was called 1. away because of a family illness. 1• 1✓ APPROVAL OF MINUTES OF JUNE 3.1996 1: 1! Councilmember Welch moved to approve the minutes of June 3, 1996, second by Councilmember Parker 2 t and the motion was carried on a unanimous voice vote. 2 2' PRESENTATIONS.MEMORIALS.REMONSTRANCES.INTRODUCTIONS.MOTIONS.RESOLUTIONS 2: 2, Councilmember Lundy moved to open the agenda to add Resolution 4-1996,second by Councilmember 2 Elstro and the motion was carried on a unanimous voice vote. 2 2, The Clerk read Resolution No.4-1996-A SPECIAL RESOLUTION CONGRATULATING THE 1996 BOYS 2: GOLF STATE CHAMPIONS 2° 3(1 "WHEREAS Richmond High School's young women and young men have been a source of great pride and 3 i enjoyment because of their many and varied accomplishments in academic,artistic and athletic pursuits, 3:' and 3; 3, "WHEREAS there is nothing quite as spectacular as being"number one"in any activity,and 3' 3• "WHEREAS the Richmond Red Devil Boys Golf Team has won the 1996 State Championship 3' 3: "NOW,THEREFORE,be it resolved by the Common Council of the City of Richmond, Indiana,that: 39 4° "1.June 20, 1996 be officially celebrated as Ryan Cate day(All State Award Recipient); 4 "2.June 21, 1996 be officially celebrated as Del MeMao Day(All State Award Recipient); 4: "3.June 24, 1996 be officially celebrated as Joey Wuertemberger Day; 4• "4.June 25, 1996 be officially celebrated as David Moehring Day; "5.June 26, 1996 be officially celebrated as David Cottongim Day(Academic All State Award Recipient); 4' "6.June 27, 1996 be officially celebrated as Frank Paterak Day; 4. REPORTS FROM STANDING COMMITTEES 6 6, None. 6- • Common Council Minutes Cont'd June.17, 1996 Page 2 • 1 REPORTS FROM SPECIAL COMMITTEES • 2 3 Councilmember Lundy announced a celebration by the North Richmond Neighborhood Association from 5 4 7 p.m.June 21 at the 1106 North I Street where they have renovated a house. 5 6 Councilmember Welch reported on the meeting of the Street Tree Commission, stating that trees had bee 7 planted in theareas of North 13th, North 14th and North 16th as well as Townsend Community Center. H 8 added that the area Boy Scouts had also helped with the planting. Councilmember Lundy stated that one of 9 her neighbors on North G Street was disappointed because she did not get a tree. 10 11 Vice President Dickman recognized Bob Zinkan's summer school government class made up of studen's 12 from Centerville, Northeastern and Richmond High Schools. 13 14 REPORTS FROM ORGANIZATIONS 15 16 MISCELLANEOUS BUSINESS 17 18 ORDINANCES 19 20 ORDINANCES ON FIRST READING 21 22 Councilmember Elstro moved to suspend the rules and read Ordinances No. 44 and 45 - 1996 by title onl 23 second by Councilmember Lundy and the motion was carried on a unanimous voice vote. 24 25 ORDINANCE NO.44-1996 26 27 The Clerk read Ordinance No. 44 - 1996 - A SPECIAL ORDINANCE VACATING THE ALLEY BETWEE 28 NORTH 3RD STREET AND NORTH 4TH STREET IN THE RECTANGULAR BLOCK BOUNDED B 29 NORTH A STREET AND NORTH C STREET 30 31 Vice President Dickman announced the ordinance would be referred to the Planning Commission. 32 33 ORDINANCE NO.45-1996 34 35 The Clerk read Ordinance No. 45 - 1996 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP A. 36 639 SOUTH FIFTH STREET, RICHMOND, INDIANA 37 38 Vice President Dickman announced the ordinance would be referred to the Planning Commission. In answ=r 39 to a question posed by Councilmember Elstro, Bob Goodwin,director of planning and redevelopment, said t 40 was a matter of housekeeping to change the zoning from M-1 to C-4, noting that is what the master pla 41 calls for. He added that the site will be used for wholesale autos. 42 43 ORDINANCES ON SECOND READING 44 45 There were none. 46 47 ORDINANCES ON THIRD READING 48 49 There were none. 50 51 UNFINISHED BUSINESS 52 53 Councilmember Welch questioned the letter Councilmembers had received from the Mayor about ba 54 taxes owed by the City. City Controller Shelley Miller explained that the State Board of Accounts whit= 55 auditing the daily procedures became aware of the lack of filing and the City has proceeded to take steps to 56 resolve the issue. She said the back taxes for the three previous years total $62,742. She said she ha. 57 worked with the State Board of Accounts on the items in question as far as some revenues that may not b= 58 taxable at this time and has been in contact with the Department of Revenue on the amounts the City i 59 aware are due. 60 61 Councilmember Welch said as he read through the letter he saw references to landfill revenues and Rosi- 62 Roller revenues and he had heard that the City is also being asked to pay taxes on golf fees and user fee- 63 Miller responded that landfill fees are the revenues that are in question at this time that the Department o' 64 Revenue feels are taxable. She added that the State Board of Accounts feels there is no clear case stating 65 that they are taxable. 195 Common Council Minutes Cont'd Juno 17, 1996 Pago 3 1 Miller said that issue has been turned over to City Attorney. Bob Bever before the City pays on that amount 2 that it is not sure is taxable. She added that again the City is looking at any type of revenue it receives as a 3 competitive revenue such as weed cutting,concessions and greens fees. Councilmember Welch commented 4 that the State Board of Accounts feels that landfill fees are not taxable because it is not counted as general 5 revenue but more of a maintenance charge. He added that he would have thought that would have been 6 ironed out a long time age by the City's accounting system. He commended Miller and her department for 7 finding out where the City has been negligent, but said he could not be as complimentary to those who 8 proceeded her. Miller said the state agreed to go back only three years and to waive any penalties that the 9 City would have incurred. She added that the cost there would have been substantial.
