1 The Common Council of the City of Richmond, Indiana met In regular session at 7:30 p.m. Monday, March
2 18, 1996, in the Council Chambers in said City. President Geneva "Gene" Allen presided with the following
3 Councilmembers present: Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Sarah "Sally" Hutton, Robert
4 Dickman, Alan Stamper, Bing Welch and Larry Parker. The following business was had to-wit:

21 Councilmember Hutton presented thank you letters to Mayor Dennis Andrews and City Clerk Norma
22 Schroeder written by the 33 Seton School students who toured the City Building Friday.

24 COMMUNICATIONS FROM THE MAYOR

26 Mayor Andrews stated that the tax abatement applications will now be handled by the Finance Department.
27 He also commented on the copy fees which had been discussed in a previous meeting and presented a fee
28 schedule which, he said,will eventually find its way into a resolution through the Board of Works. He said the
29 schedule was put together after a survey of the various departments within the administration.

31 City Controller Shelley Miller commented that she had distributed to Councilmembers the January and
32 February financial statements and explained the contents. She added that she is still awaiting the final
33 budget order from the State Board of Tax Commissioners, hoping that it will be'received within the next
34 several weeks.

38 The minutes of the February 29 and March 7, 1996, meetings were in the Council packets.

40 REPORTS FROM STANDING COMMITTEES

42 Councilmember Stamper reported that the Tax Abatement Committee had met in a Committee of the Whole
43 meeting Monday to discuss the tax abatement process and get public input. He added that he hopes to have
44 a meeting of the committee next week and have something as far as a resolution to bring to the next Council
45 meeting. -

47 REPORTS FROM SPECIAL ORGANIZATIONS

49 Councilmember Welch reported on a special Parks Board meeting held for revising the design contract for
50 McBride Stadium. He said they had retained the current consultant and designer to prepare the preliminary
51 design. He noted that the final contract, with the addition of the preliminary design, comes to just about
52 $12,000. Councilmember Welch said immediately following that meeting there was a presentation of the
53 gorge development plan. He said it was a well presented review of what will be happening in the gorge and
54 with the trail system in the very near future, noting that it appears that with the money that is committed there
55 will be action some time late this year in developing part of the nature trails down through the gorge. He
56 noted there will be hard pavement placed on the trails through the gorge and extending all the way to
57 Marion. He added that WCTV carried a good feature on the presentation for the general public to view.

59 Councilmember Dickman reported on the meeting of the Board of Aviation Commissioners noting that
60 detailed engineering plans for the extensive runway overlay project were presented and are currently under
61 study in the City Engineer's office.

63 MISCELLANEOUS BUSINE

65 President Allen read a letter from Janet Hibner stating that the Department of Personnel and Code
Enforcement will distribute Council packets between 12:30 and 4:30 p.m. each Thursday before the Council
meetings the following Monday. John Lindley is the inspector who will be doing this on a regular basis and
Wayne Jackson will be his backup.

2, Councilmember Parker asked Councilmember Welch if the Street Tree Commission has any type of fund set
2 aside for the maintenance of the street trees in the future. Councilmember Welch said there is none because
2° the Commission is strapped for funds to purchase the trees. Councilmember Parker said his concern is that
2' 25 to 50 years down the road it is going to be a tremendous expense to take down and replace those trees
2: and he feels a small percentage of these donations and/or the budget should be used for that.
2° Councilmember Welch said the Commission has been projecting forward in addressing that because in
30 years past the street trees have been fast growing and have a short growing life before they start drying out
3 and dieing. He said the Commission is now buying different types of trees,the slower growing kind which are
3 less apt to die out at an early age. That means, he said, they are looking at a maintenance free 20-plus
3 years of growing time.

3' Councilmember Welch added that this donation is greatly appreciated by the Street Tree Commission,
3° because without it and others like it they could not be purchasing the slow growing trees at the tree auctions.
3 He said part of the trees bought last year with this type of contribution have been shallow planted and rooted
3: in the Parks Department and many of these will be planted on Arbor Day of this year. He added that these
3° funds will be used to go to another tree auction to buy more trees to keep up the continued planting and
40 replacement of trees around the City. Mayor Andrews commented that at the most recent administration
4 meeting the departments of Public Works and Engineering, Sanitary and Parks agreed to work with each
4 other this spring, summer and fall to begin to develop a plan and get as much out of the$30,000 in the Parks
Department for street trees as they possibly can.

55 Councilmember Hutton said her committee met via the telephone and after talking with the Mayor it was
56 decided to establish a set term for each member with those terms to be staggered in order to provide
57 continuity for the Telecommunications Council. She said the Mayor will have two appointments with one
58 being a two-year term and the other a four-year term. And the Common Council will have three which will be
59 a one two- year term, one three-year term and one four-year term. Councilmember Dickman said this
60 ordinance could be adopted tonight and the appointments could be made at Council's next meeting.

12 Councilmember Hutton said the main thing about the discussion was that everyone agreed that -
13 Telecommunications Council is still needed. Councilmember Dickman suggested Councilmembers conta•
14 either Councilmember Hutton or President Allen to suggest names for those appointments before the ne t
15 Council meeting. At the suggestion of Mayor Andrews, President Allen read the last part of the ordinance
16 which stated: " Successors to all members of the commission shall be appointed for terms of four year-
17 except when appointed to fill a vacancy, in which case the appointment shall be for the unexpired term.A I
18 terms shall run by calendar year from January 1 (or date of appointment)through December 31."

39 Councilmember Parker-stated that the way he interpreted this ordinance is that the primary use of the zonin,
40 was not for the seven acres but for the 1.2 acres. Bob Goodwin, planning director, said that was trua.
41 Councilmember Parker then asked if the ordinance is adopted does it open up all the land for the C-
42 zoning. Goodwin answered that that is already true because the land is zoned C-2 and it is just a matter «f
43 getting access to it. He added that it was previously thought that the access would come through the Bis
44 Blue Store or the land where County Market is but that did not happen for these people and they sought thi
45 rezoning.

•7 Councilmember Welch said that he understood that after hearing this ordinance the Planning Commissio
•8 directed Goodwin's office to make application to rezone all the property south of this lot in question to the
•9 National Road or down to the commercial property. Goodwin said they wanted the rezoning to go west t•
.0 Porterfield, noting that the difficulty faced is that the lots are only 30 feet wide and even though it is zone,
•1 residential it places no value on those lots because they are currently unusable. Goodwin said th-t
•2 ordinance would be prepared by April. Councilmember Parker asked what harm it would do to hold thi.
•3 ordinance until the final determination of the Planning Commission. Goodwin said he felt the develop:r
•4 should speak to that.

•6 Attorney Tom Seal, speaking for the petitioner, said the Planning Commission had already approved the
•7 plans presented, adding that his client is anxious to get started. He noted that obviously there is a real nee.
•8 for storage facilities on the west side of the City, adding that further delay causes an economic impact on hi-

3 Councilmember Stamper asked Mayor Andrews what Council could do to get across to the State that the
4 recent hole in the Main Street bridge might create a safety problem. Mayor Andrews said he had met with
5 City Engineer Bob Wiwi and officials from the State about the bridge and Wiwi had met with State officials
6 during the problem with the bridge. He said since that time, in spite of additional assurances that have been
7 received about inspections and further work they are going to look at, he sent a letter this morning to the
8 State and project engineer concerning the scheduling of that work considering the present condition of the
9 bridge.

11 Mayor Andrews said accepting the bridge is safe when holes like that open in it is not something that he
12 agrees with and he has put the State on notice. He added that he will be happy to give Council a copy of that
13 letter.
