YEAR 2000 TORT CLAIMS
WHEREAS, there is increasing concern over the approach of the year 2000 and the
potential problems which may exist as some computer software or chips fail to
function properly because they are unable to process the year 2000 correctly; and
WHEREAS, while virtually every level of government has and is making a concerted
effort to identify and correct all potential operational problems, it is, nevertheless,
possible that some problems may not be identified and corrected before December 31,
1999; and
WHEREAS, the potential result is that numerous tort claims may be asserted against
the State, counties, municipalities, and public authorities and agencies for everything
ranging from the potential failure of traffic lights, alarm systems, water and sewer
systems and communication systems to the misfunctioning of computers containing
financial information and other records: and
WHEREAS, companion bills S-1421 and A2511, have been introduced by
Senators Connors and Matheussen and Assemblymen Arnone and Garcia to address
this potential year 2000 problem by providing that a public entity shall not be liable
in an civil action for damages to property or personal injury resulting from or caused
directly or indirectly by the failure of computer processor to accurately or properly
recognize, calculate, display, sort or otherwise process dates or times.
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the
Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
I That the Mayor and Borough Council endorse Senate Bill No. 1421 and
Assembly Bill No. 2511 and call upon the members of the 19th Legislative
District to support this legislation: and
2. That a certified copy of this resolution be forwarded to Governor Christine
Whitman; Senate President DiFrancesco; Assembly Speaker Collins; the
19th District Representatives, Senators Connors and Matheussen and
Assemblymen Arnone and Gareia, the N.J. State League of Municipalities
and Middlesex County municipalities
