GS OF THE COMMON COUNCIL OF THE CI-T-Y-OF-RICHMOND-INDIANA-MONDAY-FEBRUARY-7-1994 1 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday, 2 February 7, 1994, in the Council Chambers in said City. President Parker presided with the following 3 Councilmembers present: Howard "Jack" Elstro, Etta Lundy, Jane Brookbank, Mary Ellen Donat, Don 4 McBride, Gene Allen, Bob Dickman and Sally Hutton. The following business was had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 PRAYER BY COUNCILMEMBER HUTTON 9 10 ROLL CALL 11 12 Nine present. 13 14 APPROVAL OF MINUTES 15 16 None available for approval. President Parker presented a gavel to Howard "Jack" Elstro in appreciation of 17 his efforts as President of Council in 1992, and one to Etta J. Lundy for her term as President of the 1993 18 Council. 19 20 COMMUNICATIO NS FROM THE MAYOR 21 22 There were none. 23 24 PRESENTATIONS OF REMONSTRANCES, PETITIONS AND MEMORIALS 25 26 REPORT FROM CITY DEPARTMENTS 27 28 REPORT FROIM OTHER OFFICES 29 t 30 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 31 32 Minutes of the January 13,20 and 27 meetings in the Council packets. 33 34 REPORTS FROM SPECIAL COMMITTEES 35 36 Councilmember Hutton announced a Committee of the Whole meeting at 7 p.m. Thursday, February 17, in 37 the Council Chambers to discuss the historic review board. 38 39 REPORTS FROM STANDING COMMITTEES 40 41 None were presented. 42 43 REPORTS FROM OTHER COUNCIL COMMITTEES 44 45 ORDINANCES 46 47 ORDINANCES ON FIRST READING 48 49 Councilmember Brookbank moved to suspend the rules and read Ordinances No. 7 and 8 - 1994, on first 50 reading and read by title only, second by Councilmember McBride and the motion was carried on a 51 unanimous voice vote. 52 53 ORDINANCE NO.7-1994 54 55 The Clerk read Ordinance No. 7- 1994-A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 509 56 SOUTH 10TH STREET 57 58 President Parker announced that Ordinance No. 7- 1994 would go to the Planning Department. 59 60 ORDINANCE NO.8-1994 61 62 The Clerk read Ordinance No. 8 - 1994 - A SPECIAL ORDINANCE DESIGNATING VISUAL 63 ENHANCEMENT DISTRICTS ON THE RICHMOND ZONING MAP 64 65 President Parker announced that Ordinance No. 8- 1994 would go to the Planning Department. Common Council Minutes Cont'd February 7, 1994 Page 2 1 ORDINANCES ON SECOND READING G The Clerk read Ordinance No. 2- 1994-A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 410 4 ' SOUTH D STREET E E Robert Goodwin, director of the Planning Department, stepped to the lecturn to explain the ordinance. He ' said the petitioners, represented by Attorney Gayle Gardner, were present. The request is to utilize the • property as a surveying office, Goodwin said, adding that the planning staff recommended approval. • Councilmember Allen noted that the information received by Councilmembers was very explicit. 1. 1 Gardner spoke in favor of Ordinance No. 2 - 1994, noting that he represented the purchaser, Doug Kramer, 1- owner of Kramer&Associates, an engineering and surveying business originally located in Eaton, Ohio. He 1 said much of Kramer's work has been done in Wayne County for the past 16 years and he has rented office 1. space but has continually looked for a property to purchase and 410 South D Street is the one he has 1' selected. 1. 17 Gardner said the Planning Commission gave its unanimous approval and even Gertrude "Lucky" Ward 1 appeared at the Commission meeting and spoke in favor of approval. Gardner added that he believes this to 1 be a positive step for the historical district, noting that the ordinance really gives an opportunity to analyze 20 something and deal with it in a positive manner. He read part of the ordinance in which it stated that the 2' intent is to allow special uses in existing structures in R-3 and R-4 districts for the purpose of preventing the 22 physical deterioration of certain structures in neighborhoods as well as helping to maintain a neighborhood 21 in its present state when in good repair. 2 25 Kramer commented on the past locations of his office site, adding that he has a historical background in the 24 surveying business and is excited about locating in the Old Richmond district. He said he plans no major 27 changes to the outside except for finishing the painting of the picket fence. He said he thinks the building will I2 fit in well with the beautification ordinance with a nicely landscaped corner. He noted that his business is 2 composed of two offices covering an area from Columbus, Ohio, to Columbus, Indiana, adding that 80 3 percent of his work is in Wayne County, Indiana, and Preble County, Ohio. He displayed a large color 3 picture of the structure at 410 South D Street. 3 3 Councilmember Brookbank commented that she feels Kramer will be a wonderful neighbor, noting that she 3 is excited about him locating in Old Richmond. Kramer said his office has been actively involved with the 3 work on Industries Road, the Elks Road extension project and the Civic Hall site, Cox's Market on the west 3 side and Hill's Pet Foods. 371 38 Hearing no further comments for and none against, Councilmember Dickman moved for engrossment, 3 second by Councilmember Hutton and the motion was carried on a unanimous voice vote. 4 4 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 2 - 1994 to third and 4 final reading and read by title only, second by Councilmember McBride and the motion was carried on a 4J unanimous voice vote. 4 4 The Clerk read Ordinance No.2- 1994 on third reading. 4 4 Ordinance No.2-1994 was adopted on the following call of the roll: f 4 4 Ayes: Elstro, Lundy, Brookbank, Donat, McBride,Allen, Dickman, Hutton and Parker(9) 5 Nays:None 5 5 5 ORDINANCES ON THIRD READING 5 5 There were none. 5 57 OLD BUSINESS 58 56 Councilmember Brookbank commented that although she and fellow Councilmembers would discuss hiring 60 an attorney in an executive session immediately following the Council meeting tonight she noted the 6' preliminary bill for $560 which had been received from Charles Braddock, the attorney from Anderson, and 62 said she wondered how much more he was going to charge. Councilmember Donat explained that this is a 6 final bill except for the addition for two more hours. She said this bill included charges for the background 6. research the attorney did for Ordinance No.4- 1994 to make sure everything was recorded. 6 419 Common Council Minutes Cont'd February 7. 1994 Pa.e-3 1 MISCELLANEOUS BUSINESS 2 3 President Parker commented on a photograph of the two flags on the City's parking garage which appeared 4 in the Palladium-Item a few weeks ago. He said the City was aware that the flags were in such bad condition 5 but unfortunately the only safe way to get them down or replacing them is to use the Fire Department's aerial 6 truck and with the wind-chill factors and the heavy snowfall it was decided to wait for better weather. He said 7 a concerned citizen, William Jefferies, had donated an American flag and had talked with Representative 8 Richard Bodiker who donated a state flag for the City to use.
