HomeMy Public PortalAbout06-21-1993 261 PROCEEDINGS—OF—THE—COMMON—COUNCIL-OF—THE CITY OF--RICHMOND,=INDIANA-_MONDAY—J11NE-2l,1993- 1 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday,June 21, 2 1993, in the Council Chambers in said City. Vice President Don McBride presided with the following 111 3 Councilmembers present: Jack Elstro, Jane Brookbank, Mary Ellen Donat, Larry Parker, Gene Allen, Bob 4 Dickman and Sally Hutton. President Etta Lundy was absent.The following business was had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 PRAYER BY COUNCILMEMBER BROOKBANK 9 10 ROLL CALL, 11 12 Eight present. 13 14 APPROVAL OF MINUTES OFJUNE 7.1993 15 16 Councilmember Brookbank moved to approve the minutes of the previous meeting as prepared, seconded 17 by Councilmember Parker and by unanimous voice vote the motion was carried. 18 19 COMMUNICATIONS FROM THE MAYOR 20 21 Mayor Roger Cornett commended Dan Cappa and the Rose Festival Board and all other volunteers who 22 worked on this year's Rose Festival which he noted was exceptionally successful. He commented on the 23 "Sub grub" contest between the Mayor's team of City personnel and the six Councilmembers, with 24 Councilmember Hutton responding that the Mayor's team was the winner of the competition between the two 25 teams.The Mayor also thanked the number of City employees who participated in the Rose Festival events, 26 giving an extra effort. He mentioned the participation of the community in making the upcoming fireworks an 27 event to look forward to, congratulated the Richmond High School golf team on its state championship and 28 added his support of the Richmond High School baseball team which was vieing for still another state 29 championship. He noted that these accomplishment were something each citizen could be proud of. 30 111 31 PRESENTATIONS OF REMONSTRANCES.PETITIONS AND MEMORIALS 32 33 None presented. 34 35 REPORTS FROM CITY DEPARTMENTS 36 37 REPORTS FROM OTHER OFFICES 38 39 Councilmember Brookbank said she had spoken with an individual who had been having a big problem with 40 drainage for a long time and he said the problem had been taken care of by this administration and he was 41 extremely appreciative. Directing her comments to the Mayor and Earnest Jarvis, director of Publis Works & 42 Safety,she noted that people do appreciate what they are doing. 43 44 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 45 46 Minutes of the June 3 and June 10 meetings were included in the Council packets. 47 48 Councilmember Elstro said he had received further complaints about the property at 1431 South 13th Street, 49 noting that although the grass had been cut nothing had been done about the clutter and he asked who the 50 caller should direct his complaints to. Milligan said the clutter is a matter of another ordinance, noting that in 51 those cases the property owner is approached and allowed to set his or her own deadline in which to get rid 52 of the problem. If that is not done,the City then files a mandatory injunction forcing the owner to do it. In the 53 past, he said, the services of the street division and solid waste division have been utilized, however this 54 administration has refrained from doing that because the cost is so difficult to recover and employees are 55 busy with their other work. He reminded Councilmember Elstro that he had brought attention last year to a 56 situation on Boston Pike that had existed for a number of years and the City had taken care of it by 57 threatening legal action which caused the owner to evict the people living there and cleaning up everything. 58 He added that that is probably what will be done at 1431 South 13th Street. 59 60 61 Councilmember Parker expressed his appreciation for the quick action taken in trimming the trees at the 62 location on Peacock Road at the entrance to the parking lot maintained by the Richmond Evening Optimist 63 Club.Jarvis accepted Councilmember Parker's thanks, noting that it was his department,the Department of 64 Public Works,and not the Board of Public Works,which had accomplished the task. 65 Common Council Minutes Cont'd June 21, 1993 Page 2 REPORTS FROM SPECIAL COMMITTEES Discussion centered around the upcoming Committee of the Whole meeting scheduled for Thursday,July 8. It was noted that Council President Etta Lundy is the sponsor of Ordinance No. 40 - 1993. The tax abatement issue will be discussed at a later date in the fall. It was also noted by Councilmember Brookbank that Ordinance No. 20- 1993,which deals with the southeast annexation,will not be on public hearing.Vice President McBride said it was his understanding that discussion would center around the acquifer. Councilmember Donat said she thought the ordinance would be discussed section by section to talk about the concerns. Milligan interjected that the purpose of a committee of the whole meeting is for 1 Councilmembers to discuss the issues among themselves but if they invite people in the audience to talk 1 that tends to open up the discussion. 1 1 REPORTS FROM STANDING COMMITTEES 1 1 None were presented. 1 1 REPORTS FROM OTHER COUNCIL COMMITTEES 1 1 None were presented. 22 ORDINANCES 2 2 ORDINANCES ON FIRST READING 2, 2 Councilmember Hutton moved to suspend the rules and read Ordinances No. 42, 43, 44 and 45 - 1993 on 2° first reading by title only and Ordinance No. 46 in its entirety, second by Councilmember Allen and the 2 motion was carried by a unanimous voice vote. 2: 2° ORDINANCE NO. 42 -1993 30 3 The Clerk read Ordinance No. 42 - 1993 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP ON 3 CART ROAD IMMEDIATELY EAST OF HIGHLAND LAKE GOLF COURSE 3 3- Vice President McBride announced that Ordinance No.42-1993 would go to the Plan Commission. 3• 3 ORDINANCE NO.43-1993 3 3 The Clerk read Ordinance No. 43 - 1993 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 3 820 WEST NATIONAL ROAD 4 4 Vice President McBride announced that Ordinance No.43-1993 would go to the Plan Commission. 4 ORDINANCE NO.44-1993 14� The Clerk read Ordinance No. 44 - 1993 - AN APPROPRIATION ORDINANCE AMENDING THE 1993 4 BUDGET 4 4 In answer to a question posed by Councilmember Allen, City Attorney Thomas Milligan explained that the 4 purpose of Ordinance No. 44 - 1993 was to put all of the items pertaining to the Richmond Economic 5 Development office into one category. He added that the reasoning behind it was that it eliminates switching 5 it from one department to another which would mean an additional appropriation, public hearing and an 5 appearance before the State Board of Accounts. He said he and City Controller Dennis Grimes had 5 developed this strategy and it had met with the approval of the State Board of Accounts. He said money that 5 is left in this account, after all the bills are presented during July incurred previous to that time, are no longer 15 going to be needed in this appropriation category. He noted that the Board of Works had entered into a 5 contract two weeks ago with the Wayne County Economic Development Commission to pay out the money 5 that was left in this department in equal installments the 15th of each month beginning August 15 through 5 December 15th. He added that Mayor Cornett will sign off for the former department heads and all that will 5 be paid to the Wayne County Economic Development Commission. 6 6 Donat suggested that when ordinances such as this one are going to be brought before Common Council 6 that members have them in their hands earlier than the Friday before the Monday meeting. Mayor Cornett 6 pointed out the process of having three readings on ordinances but commented that he heard what she was 6, saying. 6 263 Common Council Minutes Cont'd J une214993 Paqe-3 1 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 44 - 1993 to second 2 reading and read by title only, second by Councilmember Dickman and the motion was carried by a 3 unanimous voice vote. 4 5 The Clerk read Ordinance No.44-1993 on second reading. 6 7 Vice President McBride announced the ordinance was on public hearing.There being no comments either for 8 or against, Councilmember Brookbank moved for engrossment, second by Councilmember Hutton and the 9 motion was carried by a unanimous voice vote. 10 11 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 44 - 1993 to third 12 reading and read by title only,second by Councilmember Parker and the motion was carried by a unanimous 13 voice vote. 14 15 The Clerk read Ordinance No.44- 1993 on third reading. 16 17 Ordinance No.44-1993 was adopted on the following call of the roll: 18 19 Ayes: Elstro, Brookbank, Donat, Parker,Allen, Dickman, Hutton and McBride(8) 20 Nayes:None 21 Absent:Lundy 22 23 ORDINANCE NO,45-1993 24 25 The Clerk read Ordinance No. 45 - 1993 - A SPECIAL ORDINANCE RE-ESTABLISHING THE 26 CUMULATIVE CAPITAL DEVELOPMENT FUND FOR 1994, 1995 AND 1996 27 28 Vice President McBride announced that it was through a request of the administration to hold Ordinance No. 29 45 - 1993 and not advance it tonight. Milligan explained the purpose of the ordinance for the benefit of the 30 public as requested by Councilmember Brookbank. 31 32 He said the ordinance is to re-establish the cumulative capital development fund for the years 1994, 1995 33 and 1996. He added that the fund was first set up by an ordinance in 1984 and it has to be renewed each 34 three-year period. He noted that this is the fund that enables the City to accomplish constructions in the 35 public works projects in the various categories shown which include bridges, airport construction projects,fire 36 fighting equipment, police radios and buses. It can also be used for municipal purposes such as street 37 improvement, sanitary and storm sewers, park purposes and in an emergeny the Mayor is permitted to use 38 this fund for public health welfare and safety where immediate action is demanded. 39 40 He said the fund is a useful device for cities and previous Councils have authorized this fund to continue and 41 this administration asks that this Council do the same. He explained that a public hearing has to be set up 42 with two advertisements to that effect in the local newspaper. He said it will be advertised this week and next 43 and the hearing is set for the Council's first meeting in July which occurs on July 6. On that night, Milligan 44 said, a public hearing will be conducted and if Council sees fit it can go ahead and pass it on that night. After 45 that,the ordinance,plus proof of publication,plus the transcript of the proceedings goes to the State Board of 46 Accounts and if that unit approves it the Cumulative Capital Development fund can be continued. 47 Councilmember Parker asked if 15 cents per hundred had always been the cost and Milligan said that was 48 the maximum and had been that amount since 1986. 49 50 ORDINANCE NO.46-1993 51 52 The Clerk read Ordinance No. 46 - 1993 -A SPECIAL ORDINANCE CONGRATULATING THE 1993 BOYS 53 GOLF STATE CHAMPIONS 54 55 WHEREAS Richmond High School's young women and young men have been a source of great pride and 56 enjoyment because of their many and varied accomplishments in academic, artistic and athletic pursuits, and 57 58 WHEREAS there is nothing quite as spectacular as being"number one"in any activity, and 59 60 WHEREAS the Richmond Red Devil Boys Golf Team has won the 1993 State Championship, 61 62 NOW,THEREFORE,be it ordained by the Common Council of the City of Richmond, Indiana,that: 63 64 1.June 22, 1993 be officially celebrated as Bo Van Pelt Day; 65 2.June 23, 1993 be officially celebrated as Ron Melling Day; 3.June 24, 1993 be officially celebrated as Chad Witherby Day; 4.June 25, 1993 be officially celebrated as Greg"Hole-In-One"Givens Day; 264 Common Council Minutes Cont'd June 21, 1993 Pap-4 5.June 26, 1993 be officially celebrated as J.J.Cornett Day; 6.June 27, 1993 be officially celebrated as Coach Joe Moehring Day; 7.June 28, 1993 be officially celebrated as Coach Paul Bechtold Day; 8.The citizens of Richmond take special delight in the second State Boys Golf Championship,the first being in 1941, and ° 9. The year 1993 be remembered as the State Championship Year in Boys Golf on signs throughout the City. ° In response to the invitation for questions and comments from Vice President McBride, Councilmember 10 Dickman congratulated the Mayor on the accomplishments of his son, J.J. Cornett, a member of the team. 1 The Mayor suggested that the name of Ryan Cate, the alternate, be added. Councilmember Dickman so 1 moved,second by Councilmember Parker and the motion was carried by a unanimous voice vote. 1 • 1• Councilmember Brookbank commented on articles she had read in the newspaper about family decline and 1 . noted that the Cornett family was a fine example of the family unit. She said she felt the support of the family 1. unit is important to children, noting that the Cornetts must be proud parents at the completion of their last 1 child's high school career. 1: 1° Adding her comments was City Clerk Norma Carnes who said Mayor Cornett was expected to be five 20 different places at the same time last week during Rose Festival which was the same time the golf team was 2 competing and other members of the administration filled in for him. Milligan recommended that the name of 2 Ryan Cate be inserted in the No. 6 slot and the two coaches be moved to No. 7 and No. 8. He added that 2 the corrected ordinance would be in the City Clerk's office the next morning for Board members to sign. 2. 2 Councilmember Hutton moved to suspend the rules and advance Ordinance No. 46 - 1993 to second 2• reading and read by title only,second by Councilmember Parker and the motion was carried by a unanimous 2 voice vote. 2: 2: The Clerk read Ordinance No.46-1993 on second reading. 3. 3 Vice President McBride declared the ordinance on public hearing.
