President Lundy presided with the following 3 Councilmembers present: Elstro, Brookbank, Donat, McBride, Parker, Allen, Dickman and Hutton. The 4 following business was had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 DEVOTIONS BY COUNCILMEMBER BROOKBANK 9 10 ROLL CALL 11 12 Nine present. 13 14 APPROVAL OF MINUTES OFJANUARY 19.1993 15 16 Councilmember McBride moved to approve the minutes of the previous meeting as prepared, seconded by 17 Councilmember Brookbank and by unanimous voice vote the motion was carried. 18 19 PRESENTATIONS OF REMONSTRANCES.PETITIONS AND MEMORIALS - 20 21 None presented. 22 23 COMMUNICATIONS FROM THE MAYOR 24 25 None 26 27 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY 28 29 Minutes of the meetings of January 14 and January 21, 1993, were in the Council packets. 30 31 In answer to Councilman Elstro's question about the debris on the east side of Sim Hodgin Parkway City 32 Engineer Robert Wiwi said material has been taken there since last fall to help fill that particular area, 33 stabilizing the street and the bank. He added that he hopes to have the area smoothed out by spring. 34 35 REPORTS FROM SPECIAL COMMITTEES 36 37 Councilmember McBride reminded fellow Councilmembers of the Committee of the Whole meeting at 7 p.m. 38 Thursday, February 11th in the Board of Works Room. He noted that under discussion will be Ordinance 10 39 -1993 which deals with smoking and Ordinance 11 -1993 which addresses residential parking. 40 41 REPORTS FROM STANDING COMMITTEES 42 43 Councilmember Brookbank reported that the highlight of the Reid Hospital Board meeting was discussion on 44 the renovation and expansion of the out-patient surgery area. 45 46 REPORTS FROM OTHER COUNCIL COMMITTEES 47 48 None were presented. 49 50 ORDINANCES 51 52 ORDINANCES ON FIRST READING 53 54 Councilmember Brookbank moved to suspend the rules and read on first reading by title only Ordinances 55 No. 10, 11 and 12-1993,second by Councilmember McBride and carried by unanimous voice vote. 56 57 ORDINANCE NO.10-1993 58 59 The Deputy Clerk read Ordinance No. 10-1993-A GENERAL ORDINANCE TO PROTECT THE CITIZENS 60 OF RICHMOND FROM ENVIRONMENTAL TOBACCO SMOKE TO BE COMMONLY KNOWN AS THE 61 CLEAN INDOOR AIR ORDINANCE 62 63 President Lundy noted that Councilmember Donat, sponsor of the ordinance, had supplied each 64 Councilmember with several pieces of literature and urged them to read it before the Committee of the 65 Whole meeting. 210 • Common Council Minutes Cont'd February 1, 1993 . Page 2 • • . • • ORDINANCE NO.11 -1993 The Deputy Clerk read Ordinance No.11 -1993- A GENERAL ORDINANCE AMENDING CHAPTER 74 OF • THE RICHMOND CODE WITH REGARD TO RESIDENTIAL PARKING PERMIT AREAS President Lundy said recommendations by the Traffic Safety Division of the Richmond Police Department will be discussed in the Committee of the Whole meeting. 1 ORDINANCE NO,12-1993 1 1 The Deputy Clerk read Ordinance No. 12 - 1993 - AN APPROPRIATION ORDINANCE AMENDING THE 1 1993 BUDGET 1 1 City Controller Dennis Grimes explained that the purpose of this ordinance is to delete $5,000 from the 1 insurance category in the Board of Works budget and add it to the other supplies category. He noted that in 1 the budgetary process the $5,000 had been cut out of the supplies account where it is needed for the 16 maintenance men to purchase the necessary supplies to properly maintain the building. 16 2¢ Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 12 - 1993 to second 21 reading and read by title only,second by Councilmember Parker and carried by a unanimous voice vote. 22 2 The Deputy Clerk read Ordinance No. 12-1993 on second reading. 2 2 President Lundy announced the ordinance was on public hearing. There being no comments either for or 2 against, Councilmember McBride moved for engrossment,second by Councilmember Parker and carried by 27 a unanimous voice vote. 28 12 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 12 - 1993 to third and 3 final reading and read by title only, second by Councilmember McBride and carried by a unanimous voice 3 vote. 32 3 The Deputy Clerk read Ordinance No. 12- 1993 on third reading. 3 3 Ordinance No. 12-1993 was adopted on the following call of the roll: 3 3 Ayes:Elstro, Brookbank, Donat, McBride, Parker,Allen, Dickman,Hutton and Lundy(9) 3 Nays:None 3. 4 ORDINANCES ON SECOND READING 4 4 ORDINANCE NO,73-1992 44 A GENERAL ORDINANCE AMENDING SECTION 155.05 OF THE RICHMOND CODE COMMONLY 4 e KNOWN AS THE 1992 COMPREHENSIVE PLAN FOR THE CITY OF RICHMOND, INDIANA 4 4• Councilmember Hutton moved to amend the ordinance, second by Councilmember Parker and carried by a 4 unanimous voice vote. President Lundy announced the ordinance was on public hearing. 4 5 Speaking in favor of the ordinance was Paul Lingle, 4884 Greenmount Pike, president of the Greater 5 Richmond Progress Committee, who asked for Council's approval of the ordinance. He noted that the Plan 5 will serve as a blueprint and a.guide for the community in the months and years ahead, adding that for too 5 long the method of crisis planning has been used. Explaining, he said it has been the policy to wait until 54 somebody wants to do something and the reaction has been to the emotion of the moment, adding that 5t5 nobody should have to endure this. He said it tends to discourage the investment because of the time and 5 money required to.prepare and present an idea, which has driven investors to look to other communities 5 with well defined plans and which provide a blueprint of action for the investors to follow. 5 5 Lingle noted that each portion of the.Comprehensive Plan will be assigned to a GRPC task force. He added 6 that these have been and will continua to be made up of citizens from every segment of our community. He 61 said this assures Council that the entire community is speaking as specifics of the Plan are developed and 6' the. Mayor comes before this body for implementation. He assured CoUncilmembers that the GRPC is 6 working directly with the Richmond Planning office,the Mayor's office and the Redevelopment Commission, 6, noting.that it was through the Redevelopment Commission and Councilman Elstro that the design center 6 was established.Through the Center,the City now has the ability to produce models,gather enough 211 Common Council Minutes Cont'd February 1, 1993 Page-3 • 1 research and do the designing to answer specific questions before implementation. Concluding, Lingle said 2 the GRPC and its 110 volunteers ask for Council's approval of the Comprehensive Plan to allow the 3 community to go forward in a totally unified manner. 4 5 Mary Bradley, 6155 Roby Lane,said she was opposed to annexing the area from Industrial Road to the state 6 line. She said there is no property involved and that area consists of all privately owned homes. She added 7 that the City will gain nothing for development,only gain taxes, and said she feels it will not benefit the City. 8 9 President Lundy said Council had decided that each annexation will be handled individually which means 10 hearings will be held,giving citizens every opportunity to be heard. 11 12 Councilmember Parker moved for engrossment, second by Councilmember McBride and carried by a 13 unanimous voice vote. 14 15 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 73 - 1992 to third and 16 final reading and read by title only, second by Councilmember McBride and carried by a unanimous voice 17 vote. 18 19 The Deputy Clerk read Ordinance No.73-1992 on third reading. . 20 21 Ordinance No.73-1993 was adopted on the following call of the roll: 22 23 Ayes:Elstro, Brookbank, Donat, McBride,Parker,Allen, Dickman, Hutton and Lundy(9) 24 Nays:None 25 26 ORDINANCE NO.5-1993 27 28 The Deputy Clerk read Ordinance No.5- 1993-A SPECIAL ORDINANCE AMENDING THE ZONING MAP 29 AT 810 INDIANA AVENUE 30 31 Councilmember Brookbank made a motion to amend Ordinance No. 5 - 1993, second by Councilmember 32 Parker and carried by a unanimous voice vote. 33 34 Councilmember Elstro asked for an explanation which was given by City Attorney Thomas Milligan. He said 35 the amendment was to correctly identify the new zoning district as an R-4 Multi-family residence special use 36 district, noting that the word "special use"was not in the original draft. He added that that designation ties it 37 down and it specificially can only be used for a mobile home court. He said Exhibit A is a real estate 38 description whereas Exhibits B, C and D are conditions of development, standards and specifications 39 presented in the public hearing before the Planning Commission and actually become a part of the 40 ordinance. He added that the developer is accountable to adhere to these written specifications. 41 42 Speaking in favor of the ordinance was Kevin Ault, representing the developer, Charles Butler. He said the 43 fence and landscaping will hide the road and compared it with Mobile Manor which has the same type of 44 frontage. He said the City can be assured there will be a buffer and every effort will be put forth to make it 45 attractive with paved roadways and substantial improvement. Councilmember McBride said neighbors have 46 voiced their concern about having mobile homes right up against their homes. Ault said every lot size in the 47 mobile home park is over and above the required lot size by the state. Milligan assured Councilmembers that 48 if the development is approved the City will see that the area is cleaned up. 49 50 President Lundy announced Ordinance No. 5 - 1993 on public hearing. There being no comments either for 51 or against, Councilmember Hutton moved for engrossment,second by Councilmember Parker and carried by 52 a unanimous voice vote. 53 54 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 5 - 1993 to third and 55 final reading and read by title only, second by Councilmember McBride and carried by a unanimous voice 56 vote. 57 58 The Deputy Clerk read Ordinance No.5-1993 on third reading. 59 60 Before the roll call, Councilman Elstro asked about the starting date and was told that construction is 61 scheduled to start around April or May. 62 63 Ordinance No.5- 1993 was adopted on the following call of the roll: 64 65 Ayes:Elstro, Brookbank, Donat, McBride, Parker,Allen, Dickman, Hutton and Lundy(9) Nays:None :• Common Council-Minutes Cont'd . . -.
