President Elstro presided with the following Councilmembers 3 present:Lundy, Brookbank, Donat, McBride, Parker,Allen, Dickman and Hutton.The following business was 4 had to-wit: 5 6 PLEDGE OF ALLEGIANCE 7 8 PRAYER BY COUNCILMEMBER HUTTON 9 10 ROLL CALL 11 12 Nine present. 13 14 APPROVAL OF MINUTES OF DECEMBER 21.1992 15 16 Councilmember Allen moved to approve the minutes of the previous meeting as prepared, seconded by 17 Councilmember Brookbank and by unanimous voice vote the motion was carried. 18 19 COMMUNICATIONS FROM THE MAYOR 20 21 Mayor Roger Cornett's state of the city address in its entirety filed under Mayor Cornett in the City Clerk's 22 file.A copy is also attached to the minutes of the January 4, 1993 meeting in the Council file. 23 24 ELECTION OF COUNCIL OFFICERS FOR 1993 25 26 Councilmember Hutton nominated Councilmember Lundy for president, second by Councilmember 27 Brookbank, nominations closed by Councilmember McBride and second by Councilmember Brookbank.The 28 vote was unanimous.Councilmember Brookbank nominated Councilmember McBride for vice president and 29 chairman of Committee of the Whole, second by Councilmember Lundy, nominations closed by 30 Councilmember Brookbank and second by Councilmember Hutton. The vote was unanimous. None were presented. 53 54 ORDINANCES 55 56 ORDINANCES ON FIRST READING 57 58 Councilmember Brookbank moved to suspend the rules and read on first reading by title only Ordinances 59 No. 1,2,3 and 4-1993,second by Councilmember Elstro and carried by a unanimous voice vote. 60 61 ORDINANCE NO. 1 -1993 62 63 The Clerk read Ordinance No. 1 - 1993 - AN APPROPRIATION ORDINANCE AMENDING THE 1993 64 BUDGET 65 Common Council Minutes Cont'd January 4, 1993 Page 2 City Attorney Thomas Milligan explained that Ordinance No. 1 - 1993 requires a public hearing and will be • brought back before Council at its January 19 meeting. He noted that it provides for additional appropriations within the Cumulative Capital Development Fund and also in the local road and street fund to fund projects that have been reviewed in the past with Council members. • Additional appropriations in the CCDF include the bid for the McBride Stadium roof for under $12,000 • awarded by the Board of Works, the bid for the renovation of a fire engine for $37,000 has also been 1• awarded by the Board of Works subject to funding and the engineers' estimate of $20,000 has been made 1 for the fiber optic cable length to the Courthouse. He explained that additional money placed in the local 1- road and street fund of $134,000 for land purchases will enable the City to complete the purchase of the 1 Town & Country Motel for the opening up of South 37th Street and the$5,000 for appraisal services will be 1, used for special consultants to acquire the rest of the land as the move is made south overto Backmeyer 1- Road and eventually over to Hodgin Road. He,added that once the project gets underway, construction 1: costs and engineering costs will be provided by federal funds through the state highway department. 1 1: ORDINANCE NO.2-1993 1° 20 The Clerk read Ordinance No. 2 - 1993 - AN APPROPRIATION ORDINANCE AMENDING THE 1993 2 BUDGET 2 2 Milligan explained that this ordinance'enables the City to move money already appropriated for land 2, purchases, moving it from the Other Contract Services Account to the Land Purchases (South 37th Street) 2' Account. 2° 2 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 2 - 1993 on second 2a reading and read by title only,second by Councilmember McBride and carried by a unanimous voice vote. 2° 30 The Clerk read Ordinance No. 2- 1993 on second reading. 3 3. Ordinance No.2-1993 was adopted on the following call of the roll: Ayes:Elstro, Brookbank, Donat, McBride, Parker,Allen, Dickman,Hutton and Lundy y(9) 4 Nays:None 4° 4 ORDINANCE NO.3-1993 4: 4° The Clerk read Ordinance No. 3 - 1993 - AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY 50 OF RICHMOND TO RECEIVE A DONATION FROM TEAMSTERS LOCAL UNION NO. 135 5 . . . 5 President Lundy asked that the accompanying letter directed to Teamsters LocalUnion No. 135 from Police 5 Chief Dennis Rice be read by the City Clerk: 5. 5 "On Monday, the 21st of December Mayor Roger Cornett called me to his office to present a check in the 5° amount of.$150 from your Local for assistance given during the recent election. The check has been placed 5, into a special account for the purchase of crime prevention materials and equipment. I am enclosing a copy 5. of a recent publication our department has begun providing to the general public. You can;.see that it is not 5° printed by.a professional printer but by police officers. We will be able to improve the quality of printing with 60 the purchasing of a lazer printer. Local 135's gift will be used for that effort.Thank you and your local for this 6 gift to our community." 6 6. In answer to a question posed by Councilmember Hutton, Chief Rice explained that officers had'offered their 6 assistance in the union's recent election. • 6' . Janice 26 Passmore, applied to the Governor's Council on Impaired and Dangerous Driving for a grant for the overtime 27 compensation for patrolmen. He added that the grant for $9,250 will enable the department to place 28 additional patrols into service at specific times of the year when more drunk drivers are on the road than 29 normal,between December 1, 1992 and September 30, 1992. 30 31 Councilmember Brookbank moved to suspend the rules and advance Ordinance No. 4 - 1993 to second 32 reading and read by title only,second by Councilmember McBride and carried by a unanimous voice vote. 33 34 The Clerk read Ordinance No.4-1993 on second reading. 35 36 President Lundy declared Ordinance No. 4- 1993 on public hearing. Councilmember Elstro said he 59 personally doesn't like the ordinance, but after talking to Milligan,felt it could be voted on. Milligan explained 60 that this specification of districts will not actually be used until the City election in 1995. In the meantime, 61 there will be a general election in 1994 and any changes in the precincts will line up then as well obtaining 62 additional data. Councilmember Elstro said the ordinance could be brought back to the floor six months from 63 now if need be. Councilmember Hutton suggested that when this is done again that an effort be put forth to 64 try to keep the neighborhoods together and President Lundy suggested that perhaps Council members could 65 take an active role in seeing to it that such a thing happens. 202 • Common Council Minutes Cont'd - ' - • . Councilmember Elstro said he would be voting ° against the ordinance mainly because adopting:it will mean'removing Precinct 6,a big part of the south end, 1 o from his district and placing it on-the west side. 1 • 1 Ordinance No.84-1992 was adopted on the following call of,the roll: 1 1- Ayes: Brookbank, Donat, McBride,Parker,Allen, Dickman and Lundy(7) 1 Nays:Elstro and Hutton (2) 1° • 1 ORDINANCE NO.63-1992 - 1 1° The Clerk read Ordinance No. 63- 1992-A GENERAL ORDINANCE AMENDING SECTION 91.17 OF THE 20 RICHMOND CODE, COMMONLY REFERRED TO AS THE DANGEROUS OR .VICIOUS DOG 2 ORDINANCE - 2. 2 President Lundy announced that this ordinance could be engrossed,stricken or referred to the Committee of 2- the Whole. • - • 2 2° Councilmember Allen said the basis for the ordinance was to remove the word"vicious"from the terminology 2 s and leave in"dangerous"and also to terminate the rights of the owner,allowing for an appeal process for the 2* dog. In answer to Councilmember Hutton's inquiry about the vicious dog law that is now in the State 2° Legislature, Milligan said any state act will supercede anything local but would still involve local police 30 officers. 3 3- Milligan responded to a question posed by Councilmember Brookbank, speaking as chairman of the Board 3 of Works which administered the sanction,which was the destruction of a dog in November. He noted that it 3- was the first time that action had been taken. 3- 3° Councilmember Elstro moved to strike Ordinance No.63-1992, noting that the Board of Works had done its 3 job well,second by Councilmember Brookbank and followed by a roll call vote. 3: 3* Ordinance No.63 1992 was stricken on the following call of.the role: 40 4 Ayes:Elstro, Brookbank, McBride, Dickman and Hutton(5) 4• Nays: Lundy, Donat,Allen and Parker(4) ORDINANCE NO.'73-1992 4 4° The Clerk read Ordinance No. 73 - 1992 - A GENERAL ORDINANCE AMENDING SECTION 155:05 OF 4 THE RICHMOND CODE TO BE COMMONLY KNOWN AS THE 1992 COMPREHENSIVE.PLAN FOR THE 4: CITY OF RICHMOND, INDIANA 4° 50 President Lundy said this ordinance'could 'be passed or returned to the Committee of the WFrole. 5 Councilmembers felt they needed to have more input -- a map of the area pinpointed for annexation and 5 some language changes. The issue will be discussed at the Committee of the Whole meeting Thursday, 5 January 21.Councilmember McBride requested that Planning Director Robert Goodwin also attend. 5 5 Councilmember Hutton moved to appoint Robert Fix as the business representative to the Enterprise Zone 5° Board and-Joni Martin and Dorothy Barber as the zone representatives, second by Councilmember 5 Brookbank and carried by a unanimous voice vote. 5: 5° Council will -meet.Tuesday, January 19, due to Martin Luther King Jr.'s birthday observance Monday, 60 January 18. 6 6' ADJOURNMENT 6• 6- There being no further business,on a motion duly made,seconded and passed,the meeting was adjourned. 6 0 • - Etta J.
