THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. 3YO AN ORDINANCE CONCERNING THE REZONING OF TWO PARCELS OF LAND OWNED BY THE CATHOLIC DIOCESE OF WICHITA. WHEREAS, The Catholic Diocese has submitted an application for the rezoning of two tracts of land in accordance with the standards set forth in Article 11-100(B); WHEREAS, The description of the tracts of land, and the requested zoning change, are as follows: TRACT I Applicant requests zoning be changed from B-1 to R-4 A tract of land lying in a portion of Lot 2, Block 1, CATHOLIC LIFE 1st ADDITION, an addition to Bel Aire, Sedgwick County, Kansas, more particularly described as follows: Beginning at the Northwest corner of said Lot 2; thence S 900 00' 00" E, 500.00 feet along the North line to the Northeast corner of said Lot 2; thence S 000 00' 02" E, 663.90 feet along the East line of said Lot 2; thence N 900 00' 00" W, 92,09 feet to a point on a curve to the right; thence along said curve 486.93 feet, said curve having a central angle of 860 06' 24", a radius of 324,01 feet, and a long chord of 442,39 feet, bearing N 460 56' 49" W; thence N 900 00' 00" W, 84.65 feet to a point on the West line of said Lot 2; thence N 000 00' 02" W, 361,89 feet along said West line to the point of beginning. TRACT 2 Applicant requests zoning be changed from R-4 to B-1 A tract of land lying in a portion of Lot 1, Block 1, CATHOLIC LIFE 1st ADDITION, an addition to Bel Aire, Sedgwick County, Kansas, more particularly described as follows: Beginning at the Southwest corner of said Lot 1, thence N 000 00' 02" W, 326.91 feet along the West line of said Lot 1; thence S 900 00' 00" E, 188.01 feet to a point on a curve to the right; thence along said curve 52.54 feet, said curve having a central angle of 320 03' 30", a radius of 93.91 feet, and a long chord of 51,86 feet, bearing S 730 58' 15" E to a point on a curve to the left, said point being on the West line of a 45 foot platted Utility Easement; thence along said curve and Utility Easement, 285.20 feet, said curve having a central angle of 36000' 42", a radius of 453.77 feet, and a long chord of 280.53 feet, bearing S 160 29' 08" W to a point on a curve to the left, said point lying on the South line of said Lot 1; thence along said curve and said South line, 164.20 feet, said curve having a central angle of 050 40' 50", a radius of 1656.21 feet, and a long chord of 164.14 feet, bearing S 740 36' 00" W to the point of beginning; WHEREAS, The Planning Commission has submitted a report to the Governing Body dated March 30, 2001 setting forth their findings of fact in reference to this matter in conformance with the guidelines set forth in Articles 11-100(F) and (H) of the Zoning Regulations of the City of Bel Aire, Kansas; 1 WHEREAS, A public hearing was convened on the matter of rezoning Tract 1, as described above, from B-1 to R-4, and for Tract 2, as described above, from R-4 to B-1 on February 12, 2001, continued on March 12, 2001, and concluded on March 26, 2001 by the Planning Commission for the City of Bel Aire, Kansas in conformance with the requirements set forth in Article 11-1 OO(E) of the Zoning Regulations of the City of Bel Aire, Kansas; WHEREAS, Following the public hearing, the Planning Commission found that evidence supported recommending approval of this requested zone change based upon the guidelines set forth in Article 11-100(H) of the Zoning Regulations of the City of Bel Aire, Kansas; WHEREAS, The Planning Commission recommends approval of the application by the Catholic Diocese of Wichita - Development Office for a zoning change for Tract 1, as described above, from B-1 to R-4, and for Tract 2, as described above, from R-4 to B-1; WHEREAS, The Governing Body has reviewed the Planning Commission's findings of fact and the factors upon which their recommendation is based; AND WHEREAS, the Governing Body has considered the factors set forth in Article 11-1 OO(H) of the Zoning Regulations of the City of Bel Aire, Kansas. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: Section 1. The Governing Body adopts the recommendation of the Bel Aire Planning Commission and approves the Catholic Diocese's request for rezoning of Tract 1, as described above, from B-1 to R-4, and for Tract 2, as described above, from R-4 to B-1. Section 2. This Ordinance shall take effect and be in force from and after its publication in the official city newspaper. Passed by the City Council this';; ~t! day of ~~ ,2001.
