CALL TO ORDER — Being that Mayor attended the meeting remotely, Assistant Mayor
Cohen chaired and called the meeting to order at 5:02 P.M.

BUDGET HEARING AGENDA
R7 — Resolutions/Public Hearings
Mr. Gonzalez announced the proposed millage rate (1.9654 mills), the rolled -back rate
(1.8221 mills), and the percentage that the proposed millage rate differs from the rolled -
back rate (4.64% reduction).
R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE,
FLORIDA, ADOPTING THE FINAL MILLAGE RATE OF THE VILLAGE FOR THE
FISCAL YEAR COMMENCING OCTOBER 1, 2015 THROUGH SEPTEMBER 30, 2016,
PURSUANT TO SECTION 200.065, FLORIDA STATUTES; PROVIDING FOR

CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE. Public Hearing

A Motion to Approve was Moved by Councilman Seth Salver and Seconded by
Councilman Jaime M. Sanz.
Mr. Gonzalez introduced the resolution and explained that the proposed millage rate
was identical to that set during the First Budget Hearing held September 8, 2015 and
was consistent with the rate set during the July 21 Regular Council Meeting a 4.64%
reduction of the previous Fiscal Year.
Mayor Packer commended Mr. Gonzalez and the Village Staff for their work on the
2015-2016 Budget.
Vote: The Motion carried by unanimous voice vote (5-0).
R7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR, VILLAGE,
FLORIDA, APPROVING AND ADOPTING THE FINAL BUDGET FOR BAL HARBOUR
VILLAGE FOR FISCAL YEAR 2015-16; PROVIDING FOR EXPENDITURE OF FUNDS;
PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE. Public Hearing

A Motion to Approve was Moved by Councilman Seth Salver, and Seconded by
Councilman Jaime M. Sanz.
Mr. Gonzalez introduced the Resolution highlighting the proposed enhancements for
recreational programing, and capital projects, including a shade structure and a
restroom facility, and reiterated that these items would return to the Council for final
approval. He then commended the work done by the Budget Review Committee and by
Finance Director Amber Riviere.
Mr. Raj Singh, Chair of the Budget Review Committee related his experience with the
Committee and stated that the Committee made sure that funding for enhancements
were in the budget, but the final approval would be that of the Council. He commended
the other members of the Committee and the Mayor.
Assistant Mayor Cohen and Councilman Sanz also commended Mr. Singh, the
Committee, the Manager and all others involved in the Budget process.

Dina Cellini (211 Bal Cross Dr.) spoke regarding the past process utilized for the budget
for the Gated Community, specifically in regards to the line item regarding electricity.
She emphasized that policy changes should be conducted with public discussion.
Mr. Gonzalez, referring to Ms. Cellini's example, explained that the expressed policy
was that costs for the Gated Community should be borne by the assessment of the
Gated Community and that expenditures mistakenly made counter to that policy were
corrected by journal entries.
Councilman Groisman and Assistant Mayor Cohen commented that issue presented by
Ms. Cellini brings to light a need to clarify procedures.
A general discussion ensued with all agreeing that anything else of a similar nature will
be brought to Council for public discussion.
Vote: A Motion to approve R7B carried by unanimous voice vote (5-0).
R7C A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, ESTABLISHING SANITARY
SEWER AND WATER RATES FOR THE 2015-16 FISCAL YEAR; ESTABLISHING AN
EFFECTIVE DATE. Public Hearing

A Motion to Approve was Moved by Councilman Jaime M. Sanz, and Seconded by
Councilman Seth Salver.
Mr. Gonzalez introduced the Resolution stating that increased water rate was a result of
increased wholesale rates of Miami -Dade County and the pass -through fee charged by
Miami Beach, and that the Village's costs remain the same.
Vote: A Motion carried by unanimous voice vote (5-0).
R7D A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE,
FLORIDA, ADOPTING A CONSOLIDATED SCHEDULE OF FEES IMPOSED BY THE
VILLAGE FOR THE PROVISION OF SERVICES; PROVIDING FOR CONFLICT;
PROVIDING FOR IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE.

A Motion to Approve was Moved by Mayor Martin Packer, and Seconded by
Councilman Seth Salver.
Mr. Gonzalez introduced the Resolution stating that all fees remain the same except for
water (previously discussed) and off -duty police officers.

Council Groisman asked the Chief Mark Overton to comment on whether the increase
of the fee would affect police officers being hired, to which Chief Overton responded
that this would be a prudent move. Mr. Gonzalez clarified that the agreement with the
Consultatio would remain intact.
Vote: The Motion carried by unanimous voice vote (5-0).

R7E A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE,
FLORIDA, PROVIDING FOR RATIFICATION OF THE COLLECTIVE

BARGAINING AGREEMENT BETWEEN THE DADE COUNTY POLICE
BENEVOLENT ASSOCIATION [POLICE OFFICERS, SERGEANTS AND
DETECTIVES] AND BAL HARBOUR VILLAGE IN EFFECT FROM OCTOBER 1,
2015 THROUGH SEPTEMBER 30, 2018; AUTHORIZING THE VILLAGE
MANAGER TO SIGN THE COLLECTIVE BARGAINING AGREEMENT ON
BEHALF OF THE VILLAGE; AUTHORIZING THE VILLAGE MANAGER TO
TAKE ALL ACTIONS NECESSARY TO IMPLEMENT THE COLLECTIVE
BARGAINING AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE.

A Motion to Approve was Moved by Councilman Seth Salver, and Seconded by
Mayor Martin Packer.
Mr. Gonzalez introduced the Resolution and described the history of the process in
negotiating with the Police Benevolent Association, emphasizing that all new employees
would be enrolled in the Florida Retirement System which, overtime, will generate
significant savings, while current employees would have the option of moving to FRS or
remaining in their current plan.
Brett Schneider (Labor Attorney from Weiss Serota Helfman Cole & Bierman) explained
the collective bargaining process that culminated in a 3-year contract. He then
described the elements of the proposed agreement.
Mr. Gonzalez commented that this was a good agreement that provides savings to the
Village and maintains positive morale.
Vote: The Motion was carried by unanimous voice vote (5-0).
Councilman Groisman, Assistant Mayor Cohen, and Mayor Packer commended all
those involved in the negotiations of the agreement.
Councilman Salver expressed that he would be in favor of setting a timeline for the
moving the process along regarding the Bal Harbour Shops expansion. Mayor Packer
commented that pending changes could significantly affect the timeline.
Councilman Groisman asked if a new plan had been submitted to the Village, to which
Mr. Gonzalez replied that he had not received a new plan. Councilman Groisman stated
that he had received a new plan and it should be discussed after it is submitted to the
Village
The Council then conducted a brief discussion on setting a timeline for a public
discussion on the Bal Harbour Shops expansion
