PROCEEDINGS OF THE COMMON COUNCIL OF THE

1 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday,
2 November 2, 1992, in the Council Chambers in said City. President Elstro presided with the following
3 Councilmembers present: Lundy, Brookbank, Donat, McBride, Parker, Allen, Dickman and Hutton. The
4 following business was had to-wit:

16 Councilmember McBride moved to approve the minutes of the previous meeting as prepared,seconded by
17 Councilmember Parker and by unanimous voice vote the motion was carried.

23 COMMUNICATIONS FROM THE MAYOR

25 None. However, Councilmember Brookbank recognized the efforts of the Mayor's son,J.J. Cornett and Rick
26 McElhaney,for their accomplishments as members of the Richmond High School tennis team.

28 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

30 Minutes of the October 15 meeting were included in Council packets.

32 Councilmember McBride expressed his appreciation for the repair work being done to the railroad crossings.
33 Earnest Jarvis, Director of the Department of Public Works, responded to the question from Councilmember
34 Parker about the left lane turn signal on Chester Boulevard at the entrance to Reid Hospital.Jarvis said after
35 the study done by the state it was recommended the arrow be taken out, however, he stated the City has
36 gone on record against the decision and has asked the state to re-study the area.

38 Robert Goens, 2724 North West A Street, appeared before the Council asking members to reconsider
39 returning the zoning at Salisbury and West Main Street from a C-2 status to a C-1 or even to an R-1.

41 City Attorney Thomas Milligan said there are three ways to do this - a petition signed by 50 percent of the
42 property owners; Council can initiate an ordinance which would be referred to the Planning Commission for
43 public hearing and return to Council to pass it or reject it on third reading after engrossment;or the Planning
44 Commission can recommend Council initiate an ordinance, conducts its own public hearing and make a
45 recommendation to the Council.

49 Councilmember Lundy announced that the date of the meeting of the Committee of the Whole to discuss the
50 Master Plan has been changed and will be at 7 p.m. Monday, Nov.9, in the Board of Works room.

52 REPORTS FROM STANDING COMMITTEES

54 Councilmember Brookbank reported on Reid Board meeting, explaining the circumstances involved in Dr.
55 Burnett leaving town.She said the agreement with Reid Hospital when he came here was to set up practice.
56 She added that he, basically, closed his doors and left 1,000 patients, however, Reid recovered part of the
57 contract. She said two letters have been received from Dr. Burnett's father in Ashland, Ky. where he chose
58 to go when he left Richmond.

2. Before the vote Councilmember Parker explained the purpose of the ordinance was to delete $150 for fire
2t pension legal services and transfer that amount for office supplies for the fire department.

3 Councilmember Parker explained the ordinance deletes $1,000 from the Public Works temporary help
4 category and adds it to the Engineering Division temporary help.The purpose is to help fund the engineering
4 aide position in engineering for the remainder of 1992.

37 Milligan suggested those Councilmembers having questions on statistical information contact Jan Hibner in
38 the Department of Law. He said Councilmembers will continue to represent the districts as they were elected
39 in 1991.The redistricting will not be subject to an actual election until 1995.

51 Milligan explained the additional clauses in the ordinance, reading: "Whereas the proposed rates and
52 charges attached hereto as Exhibit"A"are designed so that they are nondiscriminatory, "reasonable and just
53 rates and charges"for services within the meaning of IC 8- 1.5-3-8 and follow more closely cost of service
54 by customer class;and
55
56 Whereas the proposed rates and charges attached hereto as Exhibiti "A" reflect therein the election of the
57 Common Council to include in such rates and charges each of the elements of "reasonable and just rates
58 and charges"under IC 8-1.5-3-8, including reasonable return on plant of approximately 6.50 percent."

60 Milligan explained that the ordinance complies with.wishes of Council acting in the capacity of the RP & L
61 Board. Irving Huffman, RP& L Manager,said he had reviewed and approved the ordinance.
