PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND. INDIANA. MONDAY.JUNE 1. 1992
1 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday,June 1,
2 1992, in the Council Chambers in said City. President Elstro presided with the following Councilmembers
3 present:Lundy, Brookbank, Donat, McBride, Parker,Allen, Dickman and Hutton.The following business was
4 had to-wit:

16 Councilmember Donat moved to approve the minutes of the previous meeting as prepared, seconded by
17 Councilmember Hutton and on unanimous voice vote the motion was carried.

27 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY

29 Minutes of the May 21 meeting was included in Council packets.

31 Councilmember McBride complimented the Richmond High School baseball team, coaches, parents and
32 others responsible for the cleaning and painting of McBride Stadium. City Attorney Thomas Milligan said the
33 Board of Works would recognize the efforts of those involved.

35 In answer to President Elstro's question about the grant for the parking lot for Color Box, Milligan said the
36 grant was not in process when the new administration took office. In checking with the grants administrator
37 Milligan said he learned that the decision had been made to proceed without going forward with the grant.

39 Several of the Councilmembers had comments about the conditions of the railroad crossings throughout the
40 city. The Director of Public Works Earnest Jarvis assured them that he had been in contact with CONRAIL,
41 adding that if he did not get a satisfactory response the City could do the work and send them the bills.
42 Councilmember Parker said this had been going on for the past five to seven years, contacting them and
43 nothing ever happens. His suggestions were to either block the track or do the work and put a lien against
44 CONRAIL. Milligan responded that while blocking the track might prove emotionally satisfactory it is not a
45 legally pursuable option.Jarvis was to meet with CONRAIL representatives within the week.

49 Councilmember Lundy reported she would set the date for a Committee of the Whole meeting with the
50 county to discuss G.I.S.

52 President Elstro appointed Councilmembers Allen, Dickman and Brookbank to work with the City
53 administration on the 1993 budget.

61 Hutton said she will be working with other committee members on waste reduction the next 30 days and will

ORDINANCES ON FIRST READING
Councilmember Brookbank moved to suspend the rules and read on first reading by title only Ordinances
No. 32-and 33-1992. The motion was seconded by Councilmember McBride and on unanimous voice vote
the motion was carried.

AMENDING THE FEE SCHEDULE FOR THE RICHMOND SANITARY LANDFILL

1 President Elstro announced that the ordinance could go all the way. Milligan explained that the proposed
171 ordinance rewrites section 58.02 of the Richmond Code increasing certain user fees. This was done at the
18 request of the Richmond Sanitary Board of Commissioners at its May 26 meeting. He pointed out that the
1 landfill is an important asset but is also a costly one.

2 Councilmember Brookbank moved to suspend the rules and read on second reading and read by title only
2 Ordinance No. 32 - 1992. Councilmember McBride seconded the motion and on unanimous voice vote the
2 motion was carried.

2 President Elstro announced the ordinance was on public hearing. After hearing no response either for or
2 against, Councilmember McBride moved for engrossment, second by Councilmember Brookbank and
2 carried on unanimous voice vote.

Milligan noted that during a meeting with Director of Public Works Earnest Jarvis, a representative of the
3 Richmond Police Department and Ralph Willis, Manager of the Sanitary District, all agreed that the City
3 needs to address the problem of the various types of refuse and debris that's going into the landfill and the
3 source of some of those. He alerted Councilmembers that an ordinance is being prepared speaking to that
3 issue and will be brought to Council for its review and study in the fall.

5 AMENDING THE 1992 BUDGET

5 Chief Sticco explained items A and B which pertained to the Richmond Fire Department, noting that the
5 purpose was to remove $40,000 for clothing supplies from one account and designate it for clothing
5 allowance in another. City Controller Dennis Grimes explained items C and D, noting that $1,000 was to be
55 removed from the Mayors Office travel expense and added to the stationery and printing account in that
57 same office.

5 Councilmember Hutton moved to suspend the rules and advance Ordinance No. 33 - 1992 to second
5 reading and read by title only, second by Councilmember Brookbank and carried on a unanimous voice
6 vote.

16 The Clerk read on second reading Ordinance No. 26 - 1992 - A SPECIAL ORDINANCE AMENDING THE
17 ZONING MAP AT 102 SOUTH 18TH STREET

19 Councilmember Dickman made a motion the ordinance be amended to request that the property located at
20 102 South 18th Street which carries an R-2 SU One Family Residence Special Use District for an
21 architectural office be changed to an R-3 SU One To Eight Family Residence Special Use District to permit
22 the installation of a professional office building. The petition had incorrectly requested another R-2 Special
23 Use designation. Councilmember McBride seconded the motion and it carried on a unanimous voice vote.

25 Councilmember Brookbank proposed another amendment designating special hours for clients. Milligan said
26 that although certain standards can be imposed 104 in the Code Book, Article 48 in Chapter 154 which is the
27 zoning code does not set forth hours of operation. He further stated there had been no discussion of hours at
28 the Planning Commission and although the ordinance could be amended hours of operation were not among
29 the items listed as special conditions. After listening to Milligan's explanation, Councilmember Brookbank
30 made her amendment designating that the hours of operation shall be reasonable and in keeping with the
31 residential nature of the surrounding neighborhood, second by Dickman and carried on a unanimous voice
32 vote.

34 President Elstro announced the ordinance was on public hearing. Speaking in favor of the ordinance was one
35 of the owners, James Backmeyer, noting that he had sent information concerning the ordinance to each of
36 the council members prior to the meeting. He said he was available to answer any questions
37 Councilmembers wished to ask.

39 Hearing no questions and no comments against the ordinance Councilmember McBride moved for
40 engrossment, second by Councilmember Hutton and carried on a unanimous voice vote.

42 Councilmember Lundy moved to suspend the rules and advance Ordinance No. 26 - 1992 to third and final
43 reading and read by title only,second by Councilmember Brookbank and carried on a unanimous voice vote.

55 ZONING MAP FROM 200 SOUTH NINTH STREET TO 435 SOUTH NINTH STREET

57 President Elstro asked for comments from Councilmembers and Councilmember Dickman made a motion to
58 amend the title, to read as above, second by Councilmember McBride and carried on a unanimous voice
59 vote. Lundy asked if the changed title covered the same area and Milligan responded that the amended type
60 of heading will be used in all of the titles in the future.

62 President Elstro announced the ordinance on public hearing. Dan Stiffler, owner of property at 328 and 330
63 South Ninth Street and agent for 35 of the properties affected by the ordinance,said he believes rezoning the
64 area from R-4 Multi-Family Residence District to C-4 General Business District to increase the market value
65 of the property is a good move and will help his street. He said he counted 15 businesses from South B to
South E plus several vacant lots which may be developed at a later date. He said the signatures he secured
for the petition in favor of the re-zoning is signed by those who actually live on the street.

There being no comments against the ordinance, Councilmember Brookbank moved for engrossment,
second by Councilmember McBride and carried on a unanimous voice vote.
Councilmember Brookbank moved to advance Ordinance No. 31 - 1992 to third and final reading and read
° by title only. Lundy added that the rules be suspended, second by McBride and carried on a unanimous
voice vote.
The Clerk read Ordinance No.31 -1992 on third and final reading.

1 Before the vote, Councilmember Lundy noted that this area is in her district and she had no calls against the
1 ordinance. Councilmember McBride commented that the Plan Commission had recommended with a vote of
1 11 to 0 to approve the ordinance. President Elstro noted that the ordinance would take an area from an R-4
1 to a C-4 which is quite a jump. He added that in all the years he has served on Council he has voted against
1 • re-zoning to make the value of the property go up and said he would exercise that same choice when the
16 vote was taken.

2° After a brief discussion which revealed that since several of the Councilmembers will be attending a seminar
30 in Washington, D.C.there would not be a quorum for the next regular meeting June 16, it was agreed to skip
3 the meeting which moved the next Council meeting to the first Monday in July which will fall on July 6.
