1 The Common Council of the City of Richmond, Indiana met in regular session at 7:30 p.m. Monday, April 20,
2 1992, in the Council Chambers in said City. President Elstro presided with the following Councilmembers
3 present:Lundy, Brookbank, Donat, McBride, Parker, Allen, Dickman and Hutton.The following business was
4 had to-wit:

14 President Elstro announced that the minutes of April 6, 1992 will be approved later. Councilmember
15 Brookbank asked if that meant the approval of the minutes would be deferred and he answered in the
16 affirmative.

18 COMMUNICATIONS FROM THE MAYOR

20 Mayor Roger Cornett reported that water problems had the Sanitary District employees out most of the day
21 and evening Saturday. He said these are old problems which need a fresh approach to get new effort into
22 the problems. He noted that the current program in effect will be continued but added to in order to resolve
23 the problem as quickly as possible. He added that the City is committed to getting the problem solved.

29 President Elstro asked the Clerk to read Vacation Petition No. 2 - 1992 - A PETITION TO VACATE TWO
30 ALLEYS IN BENTON HEIGHTS ADDITION TO THE CITY OF RICHMOND.

32 In answer to President Elstro's question, City Attorney Tom Milligan said Council would not vote on the
33 petition but merely conduct a public hearing. The Ordinance to be introduced later in the meeting is what
34 Council members will vote on. President Elstro announced the opening of the public hearing.
35 Councilmember McBride said he was aware of the situation and said he would be remiss if he didn't vote for
36 approval on it because it will greatly improve the area which is in the Fairview district between Laird Street,
37 N.W. L St. and the Railroad.

39 Milligan said if the ordinance is passed, the City abandons its rights and it's the private property owners
40 responsibility from then on. There is no alley because the property has never been improved.

49 No formal report was presented but Councilmember Lundy noted the roughness of the Railroad crossing at
50 North 12th Street. President Elstro added that all of the tracks at intersections are in bad shape. He also
51 noted that the trucks emerging from the recycling center on South I Street when it rains leave mud on the
52 streets making the street look like a dirt road. He said there is an ordinance against dragging excess dirt
53 onto city streets. Milligan said he's check into it.

2 Councilmember Brookbank moved to read on first reading and read by title only Ordinances No. 20, 21, 22,
2 23 and 24 - 1992, seconded by Councilmember Hutton and on unanimous voice vote the motion was
2. carried.

2 Before the reading, President Elstro recognized the presence of Richmond High School students from three
2 classes of Robert Zinkan.

3 The Clerk read Ordinance No. 20 - 1992-A GENERAL ORDINANCE TO AMEND THE COMPOSITION OF
3 THE STREET TREE COMMISSION.

3 Councilmember McBride explained the reason for the ordinance was to clarify the makeup of the Street Tree
3 Commission, removing the Street Tree Commissioner and adding the Director of Department of Public
3 Works.

4 Councilmember Hutton moved to suspend the rules and advance Ordinance No. 20 - 1992 to second
4 reading and read by title only, seconded by Councilmember Parker and on unanimous voice vote the motion
4 was carried.

4 President Elstro asked for comments from Councilmembers then announced the ordinance was on public
4 hearing.

4 There being no comments for or against Councilmember Parker moved for engrossment, seconded by

52 Councilmember Parker moved to suspend the rules and advance Ordinance No. 20 - 1992 to third and final
5 reading and read by title only, seconded by Councilmember McBride and on unanimous voice vote the
5 motion was carried.

PARKING PERMIT AREA NUMBER 8.

1 Councilmember Hutton asked why South West First was not considered on the request. Milligan said it was
2 ascertained by the police captain who surveyed the neighborhood that the residents on that street said it was
3 not necessary. He also noted that there was no contact with anyone after it was advertised and at the Board
4 of Works meeting at Richmond High School not one request was made by a resident on that street for
5 restricted parking. President Elstro said he had had four calls and requested that the ordinance stay on first
6 reading until he was able to visit in the area and assess the situation.

8 Councilmember Hutton moved to advance Ordinance No. 21 - 1992 to second reading and read by title only,
9 ,seconded by Councilmember Brookbank and on unanimous voice vote the motion was carried.

13 President Elstro explained that if passed the ordinance would restrict parking to two hours in the designated
14 areas but homeowners could purchase a yearly parking permit for $3 enabling them to park in front of their
15 homes.

17 Councilmember Donat questioned the $3 charge for homeowners. Discussion revealed no objections raised
18 by residents. Milligan said no one objected at the Board of Works meeting and the $3 charge covers the cost
19 of issuing the stickers for the cars.

21 Councilmember Parker suggested the Clerk read the designated streets covered by the Ordinance to help
22 students in the audience to understand the area being discussed. The Clerk read the list in its entirety.

26 Hearing no comments either for against the ordinance it remained on second reading. President Elstro
27 directed the Clerk to read Ordinance No.22- 1992.

31 The Clerk read Ordinance No. 22- 1992 -A SPECIAL ORDINANCE AUTHORIZING MODIFICATION OF A
32 GRANT APPLICATION TO THE INDIANA DEPARTMENT OF COMMERCE.

34 Councilmember Lundy commented that the ordinance would provide for a modification of one adopted earlier
35 by Council.

37 Councilmember Hutton moved to suspend the rules and advance Ordinance No.22- 1992 to second reading
38 and read by title only,seconded by Councilmember Lundy and carried on a unanimous voice vote.

42 President Elstro asked for comments from Council. In answer to a question posed by Councilmember Parker,
43 City Attorney Milligan noted that the grant application was originally for $300,000 for 10 homes. The
44 modification called for the building of seven or eight homes for a total cost of$330,000 which provides that all
45 funds in excess of $300,000 be provided from local sources including program income and recaptured grant
46 funds for the purpose of administering the Infull Housing Program in accordance with the grant agreement.

51 Councilmember Parker and carried on a unanimous voice vote.

President Elstro commented that the ordinance would have to go to the Planning Commission but
questioned Milligan as to why. Milligan explained that any time you vacate it has to go to the Planning
Commission.That ordinance goes back to 1967.

The Clerk read Ordinance No. 24 - 1992 - AN APPROPRIATION ORDINANCE AMENDING THE 1992
BUDGET
19 Councilmember Brookbank moved that Ordinance No. 24 - 1992 be advanced to second reading and read
1 by title only,seconded by Councilmember McBride and carried with a unanimous voice vote.
1 The Clerk read the ordinance on second reading.
1 Explaining the ordinance was Director of Public Works Ernie Jarvis. He noted it was to allow the purchase of
1 a new towmotor tractor for the airport to replace the 1979 model being used. He said the airport is trying to
1 attract larger more modern aircraft and the new towmotor will not only move the larger airplanes but will
1 allow airport personnel to start jets and other aircraft that need assistance.

2 President Elstro declared the ordinance on public hearing. With no comments for or or against,
2 Councilmember McBride moved for engrossment, seconded by Councilmember Parker and carried with a
2 unanimous voice vote.

24 Councilmember Lundy moved to suspend the rules and advance the ordinance to third and final reading and
25 read by title only, seconded by Councilmean Parker and carried with a unanimous voice vote.
